2006-06-05 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTESMINUTES OF THE JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON JUNE 5, 2006, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS CALL TO ORDER The public hearing was called to order at 6:44 p.m. Mayor Tom Reid opened the hearing for both the City Council and the Planning and Zoning Commission, with the following present: Mayor Tom Reid Councilmember Kevin Cole Councilmember Steve Saboe Councilmember Felicia Kyle Councilmember Helen Beckman Councilmember Richard Tetens P & Z Vice -Chairperson Sheryl Greiner P & Z Commissioner Neil West P & Z Commissioner Henry Fuertes P & Z Commissioner Susan Sherrouse P & Z Commissioner Darrell Diggs P & Z Commissioner Jerry Koza, Jr. Also in attendance: City Attorney Darrin Coker; City Manager Bill Eisen; Assistant City Manager Nicholas Finan; Deputy City Attorney Nghiem Doan, Planning Director Lata Krishnarao; Senior Planner Theresa Grahmann, Plan and Plat Administrator Richard Keller, Planner I Diana DuCroz and Planning Administrative Secretary Judy Krajca. Mayor Reid opened the hearing for Old Townsite Ordinance at 6:44 p.m. PURPOSE OF HEARING A. OLD TOWNSITE ORDINANCE A request of the City of Pearland, for approval of the Old Townsite Ordinance, generally affecting properties on the North Side of Walnut, on the South Side of Orange Street, on the West Side of Galveston Street, and on the East Side of Mykawa Road. P&Z Vice -Chairperson Sheryl Greiner read the purpose into the record. Planning Director Lata Krishnarao presented the Staff Report. Ms. Krishnarao recognized the Steering Committee members present, and thanked them for coming. Topics discussed were aesthetics, land use, development standards, walkable pedestrian friendly district. Also discussed were three proposed districts within the Townsite, being Old Townsite General Business Page 1 of 5, JPH (OTGB), Old Townsite Residential (OT -R), and Old Townsite Mixed Use District (OT -MU). Senior Planner Theresa Grahmann passed out the Proposed Zoning Map of the Old Townsite, as the map was revised on June 5, 2006. Ms. Krishnarao passed out pages 57 & 58 of Chapter 2, from the Unified Development Code, regarding section 2.4.3.4 OT, Old Townsite District. Ms. Krishnarao completed her presentation with the conclusion of doing a follow-up of: Relaxation of Building Codes, Streetscape plan for Old Townsite, and Amendment to the City's Right -of -Way Ordinance. There were three people present to ask questions about the Old Townsite Ordinance. Mr. Luther Cunningham, of the Old Townsite Steering Committee, and Betty Callaway spoke in regards to clarification of moving buildings in from Houston, and how does one do this. Ms. Alma Nolen, also of the Steering Committee, addressed the Council and Commission regarding drainage. Councilmember Helen Beckman asked about the existing residential area, where the Reading Center owns land and would the Reading Center still be allowed to exist. Planning Director Krishnarao addressed the issue of moving buildings in, and relaxing the codes. Ms. Krishnarao stated that the questions to ask would be who decides what is historical or architectural, in order to move something of this stature into the Old Townsite District. Councilmember Kevin Cole asked what the process and the codes were. Assistant City Manager Nick Finan addressed this issue, stating that the City would have to get certified letters from the other City, and could require a performance bond. He offered some examples of how this has been handled previously in other cities, namely League City. Councilmember Felicia Kyle addressed the terms and definitions in the Old Townsite, and in Chapter 5 of the Unified Development Code asking that clarification of these terms and definitions be addressed for the public to better understand. Councilmember Kevin Cole inquired about the 75% glass on the lower level storefront, and felt this should be addressed. Ms. Krishnarao stated that when the consultant presented this initially, it was figured there would be sidewalks with shops and offices. It now needs to be re -addressed. Councilmember Kyle stated she agreed with Councilmember Cole on this issue, and Councilmember Beckman stated she did as well. Page 2 of 5, JPH Planning Director Krishnarao asked the Council and Commission if Staff should move away from the percentage of glass required. Councilmember Cole felt it needed to be lowered. Councilmember Steve Saboe felt it needed to be addressed, with setbacks. Ms. Krishnarao addressed Ms. Alma Nolen's concern of the drainage, and stated the city would address flood issues in the future. Councilmember Saboe expressed concern that there was not any positive feedback from the OTS Steering Committee. Mickey Mark, of the Old Townsite praised Planning Director Krishnarao and the Planning Staff. He feels that the City is moving in the right direction. Commissioner Darrell Diggs asked about the 50 feet minimum lot width in the General Business and Mixed Use Districts. Planning Director Krishnarao addressed his concern. Planning Director Krishnarao thanked the legal department, specifically the City Attorney Darrin Coker, and Deputy City Attorney Nghiem Doan for their assistance in this Ordinance. The Public Hearing for Old Townsite Ordinance was adjourned at 7:25 p.m. The Public Hearing for Updated Zoning Map opened at 7:26 p.m. B. UPDATED ZONING MAP A request by the City of Pearland, for an amendment to Ordinance No. 2000M, the Zoning Map of the City of Pearland, for approval on an Updated Zoning Map, affecting various properties throughout the City of Pearland. P&Z Vice -Chairperson Sheryl Greiner read the purpose into the record. Senior Planner Theresa Grahmann presented the Staff Report. She reminded the Council and the Commission of the adoption of the Unified Development Code and the Zoning Map, in February 2006. Ms. Grahmann stated that in using the new zoning map, staff has come across areas needing to be addressed. These areas are: • The Cullen Mixed Use District and Zapalac Rd. • Garden O'Day Mixed Use District • Miller Ranch Road and Broadway St. Page 3 of 5, JPH Property off of Max Road McLean Road toward the park Old Townsite proposed Zoning Map There was no one present to speak for or against this updated zoning map. Discussion included concerns from Councilmember Cole regarding a hotel near the Miller Ranch Road tract, and where it would be located. Senior Planner Grahmann stated it would be in the R-1 area and would need to be applied for rezoning by the owner. He also questioned a piece of property located on Pearland Parkway that Mr. Tom Alexander had addressed during a previous workshop. Assistant City Manager Nick Finan stated it was addressed later, after the adoption of the new Zoning Map. The owner could come back and apply for a zone change if he chose. Councilmember Steve Saboe had questions regarding the owners on Map No. 4, and the buffers and masonry fence on Map No. 5. He also questioned Mr. Alexander's request for the change in zoning. City Attorney Darrin Coker stated that Mr. Alexander was told he could apply for a zone change. Councilmember Saboe was concerned with why the City did not change it, like we are doing with property tonight. Planning Director Krishnarao stated that the Planning Staff would come back before Council and Commission with corrections to the Zoning Map on an as needed basis. Councilmember Cole asked if an error was identified on the map, does Council/Staff/Legal have a process to discuss this.
