2005-10-03 CITY COUNCIL AND PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTESPLANNING & ZONING COMMISSION MINUTES REGULAR MEETING CITY OF PEARLAND PLANNING AND ZONING COMMISSION OCTOBER 3, 2005 AT 6:30 P.M., IMMEDIATELY FOLLOWING A JOINT PUBLIC HEARING, 2ND FLOOR CONFERENCE ROOM, CITY HALL 3519 LIBERTY DRIVE, PEARLAND, TX The Planning and Zoning convened immediately following the Joint Public Hearing. Those in attendance were: Chairperson Ruby Sandars 777FCommissioner Neil West Vice -Chairperson Todd locco I Commissioner Sheryl Greiner Also in attendance were Planning Director Lata Krishnarao, Senior Planner Theresa Grahmann, Plat and Plan Administrator Richard Keller, Deputy City Attorney Nghiem Doan and Planning Administrative Secretary Judy Krajca. I. CALL TO ORDER Chairperson Ruby Sandars called the Planning and Zoning Meeting to order at 8:42 p.m. II. NEW BUSINESS A. CONSIDERATION & POSSIBLE ACTION — Preliminary Plat of Shadow Creek Ranch SF -46A A request by Jason R. Banda, LJA Engineering & Surveying, Inc. for Pearland Investments, LLP, for approval of a Preliminary Plat subdivision of 21.256 acres in Shadow Creek Ranch for 69 residential lots, with seven reserves totaling 3.585 acres for landscaping, open space, and pipeline and power line easements. The plat is located in the western portion of Shadow Creek Ranch in Fort Bend County, and is described as follows: 21.256 acres, being out of the George Mac Donald Survey, Abstract 557, the I.C. Stafford Survey, Abstract 668, and the S.G. Haynie Survey, Abstract 620, City of Pearland, Fort Bend County, Texas. P&Z Minutes Page 1 10/3/2005 PLANNING & ZONING COMMISSION Plan and Plat Administrator Keller read the staff report. There were no outstanding items. Vice -Chairperson locco made a motion to approve, and Commissioner West seconded. No comments from Commissioners/Staff. The vote was 4-0 for approval of the plat. B. CONSIDERATION & POSSIBLE ACTION — Preliminary Plat of Shadow Creek Ranch SF -46B A request by Jason R. Banda, LJA Engineering & Surveying, Inc. for Pearland Investments, LLP, for approval of a Preliminary Plat subdivision of 15.641 acres in Shadow Creek Ranch for 60 residential lots, with six reserves of 1.209 acres for landscaping, open space, drainage, and pipeline easements. The plat is located in the western portion of Shadow Creek Ranch west of Trinity Bay Drive in Fort Bend County, and is described as follows: 15.641 acres, being out of the George Mac Donald Survey, Abstract 557, and the H.T. & B.R.R. Co. Survey, Section 83, Abstract 761, City of Pearland, Fort Bend County, Texas. Plans and Plat Administrator Keller read the staff report. There were no outstanding items. Vice -Chairperson locco made a motion to approve, and Commissioner West seconded. There was no discussion from Commissioners/Staff. The vote was 4-0 for approval of the plat. C. CONSIDERATION & POSSIBLE ACTION — The Proposed Unified Development Code and Zoning Map for the City of Pearland. P&Z Minutes Page 2 10/3/2005 PLANNING & ZONING COMMISSION Commissioner Greiner recommended that the Commissioners accept the UDC recommendations, and Commissioner West seconded. There was much discussion among the Commissioners/Staff/Deputy Attorney regarding changes between the UDC and the existing ordinance. Vice -Chairperson locco asked staff to view Page 2 — 102, on Plumbing Shops. He questioned why a plumbing shop was not permitted in M-2. Much discussion ensued on the subject of Plumbing, and Vice - Chairperson locco stated this needed to be addressed and needed to add Plumbing under M-2. He also questioned what the definition of a Plumbing Wholesaler and Electrical Wholesaler was. Commissioner West asked what Vice -Chairperson locco wanted. He stated he would like to see a"P" under Plumbing in M-2, and a definition of a Plumbing Shop. He also asked where Electrical Supplier fell into all of this. Staff definitely needs to look at 2-102 in the UDC draft. Commissioner West asked Deputy Attorney Doan what his opinion of the UDC draft is. Deputy Attorney Doan stated that the chart should be reviewed before adopting it. Discussion continued in great detail on the definitions, especially the word 'shop'. A vote was called on the motion made earlier, with the following amendments: 1. A plumbing shop be listed as a permitted use under the M-2 district 2. The schedule of uses be examined by staff prior to final approval by the City Council The vote passed 4-0. D. TRAINING SESSION — Subdivision Ordinance and Variances The Training Session was postponed until the vacancies for the Planning and Zoning Commissioners were filled. VI. ADJOURNMENT Vice -Chairperson locco made a motion to adjourn, and Commissioner Greiner seconded.
