PURPOSE OF HEARING — DISANNEXATION OF APPROXIMATELY 9.9932 ACRES BEING PART OF THE H.T. AND B.R.R. COMPANY SURVEY, ABSTRACT NO. 300, BRAZORIA COUNTY, TEXAS. Mr. Darrin Coker, City Attorney. STAFF REVIEW City Attorney Darrin Coker stated this Public Hearing is for the proposed disannexation of approximately 9.9 acres located on the east side of SH 288, directly to the south of the Cinemark Theater. The applicant is requesting the annexation in order to be annexed into Municipal Utility District (MUD) Number 6 (Six). The MUD will provide them with utility services. If Council goes with this, then on future agenda there would be several documents for Council to consider. Also, there would be a disannexation Ordinance. Mr. Coker stated he spoke with the developer and he apologized that he would be unable to attend the meeting tonight. The property will be developed with the same guidelines as the Silverlake Home Owners Association. Page 1 of 2 — 9/12/2005 CITIZEN COMMENTS Michael Klaus, 5016 Groveton, addressed Council and asked how long it would be before this property is annexed back into the City. COUNCIL/STAFF DISCUSSION City Attorney Darrin Coker stated it is too soon to know when the property would be back into the City. In 2011, the City would have the ability to annex it back from Municipal Utility District (MUD) No. 6. The City does not have a Strategic Partnership Agreement with MUD No. 6, but there is a Sales Tax Agreement. City Manager Bill Eisen stated that there are no utilities in the area and will not be for a number of years. He stated this is why the City has considered the disannexation. Councilmember Larry Marcott asked if the City knew when the final build -out was on this property. City Attorney Darrin Coker stated the City does not know the specifics at this time.
