2005-03-21 CITY COUNCIL PUBLIC HEARING MEETING MINUTESMINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON MARCH 21, 2005, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. PURPOSE OF HEARING — PROPOSED ANNEXATION OF APPROXIMATELY 432 ACRES OF LAND. Approximately 432 acre tract generally located south of Beltway 8, north of Clear Creek, west of SH 288 and east of Old Airline Road (also called County Road 48 and Almeda School Road.) STAFF REVIEW Deputy City Manager Alan Mueller gave a brief review and summary of the Service Plan. He stated the Service Plan is in conformance with State Law. The Service Plan will provide a level of services. He gave a brief description of the area. The Service Plan provides the level of service currently available to other parts of the City that are similar to the tract. The City would provide services by any means or methods that are already in use by the City. Services may include an application, eligibility, and fee process. The services would be provided immediately upon annexation. Those items include Police, Fire, EMS, and solid waste collection services with one exception. Currently this area is within the service area of the Fire Department. Waste Management would provide trash pick-up to the area as provided within the City's Page 1 of 3 — 3/21/2005 continue to do so for a two-year time period. There are no active public water or sewer systems for the area. The City would not take on any current operating requirements for water or sewer. The City would maintain the roads for the area. There are no public parks, playgrounds, swimming pools, or any other public facilities. Additional services provided by the City are Library services, health services, code enforcement, and any additional services available to all citizens within the City. No capital improvement program would be necessary to provide any additional Police, Fire, EMS, or solid waste services. The area would be serviced from an existing infrastructure. A water, sewer, and road project is currently in design for the area. This project is associated with the extension of Kirby Drive. This road would provide additional access to the area and water and sewer trunk facilities. No capital improvements are needed for parks, playgrounds, swimming pools, or other publicly owned facilities within the tract. CITIZEN COMMENTS Richard Martini, 1306 E. Anderson Road, Houston, addressed Council and stated he is a landowner within the proposed annexation area. His family owns approximately 150 acres on the western edged of the proposed annexation area. He noticed the zoning requested would permit 171 uses of the property. He does not feel that this annexation is in the best interest of his family and the ownership of their property. COUNCIL/STAFF DISCUSSION Deputy City Manager Alan Mueller stated this is the second and final Public Hearing. The first reading of the Ordinance will take place at the first Council Meeting in April. The second and final reading will take place at the second Council Meeting in April. This area will be zoned as the Spectrum District, which is currently in the process of being developed. It will be zoned Suburban Development until the Spectrum District has been established. PURPOSE OF HEARING — PROPOSED ANNEXATION OF APPROXIMATELY 20.5 ACRES OF LAND. Approximately 20.5 acres of land generally located north of Romero Drive, and being parts of Villa Verde Section 2 and Section 3. STAFF REVIEW Deputy City Manager Alan Mueller gave an explanation of the vicinity map and stated it displays the back side of the Villa Verde Subdivision. It is bounded by a Harris County Flood Control Ditch on the northeast side and a Harris County Flood Control Detention Pond on the other side. The area being annexed is part of Villa Verde Section Two and Section Three. During a previous annexation into the extraterritorial jurisdiction, this portion was part of Houston. Houston allowed the City of Pearland to extend the extraterritorial jurisdiction to now include the two mentioned sections. The Service Plan includes infrastructure and infrastructure maintenance currently available to the City. Some of the services may include an eligibility, application, and fee process. The services will be available immediately upon annexation, which include Police, Fire, EMS, and solid waste collection. There are no waste collection services in place for the area. Under the City's current franchise agreement with Waste Management, collection Page 1 of 2 — 3/21/2005 services will be provided to the area. Existing water and sewer facilities will be maintained and operated by the City. The City will also take over the jurisdiction of the streets. There are no public parks, playgrounds, swimming pools, or any other public facilities within the area. The Pearland Volunteer Fire Department in conjunction with the Southeast Volunteer Fire Department will service this area. Library services, health services, code enforcement services, and all other City services are available to the residents. No capital improvement is necessary to serve this tract. Public Safety will be served from existing facilities and the construction of streets and sewer already exist in this area. This property was built in conformance with the City's R-2 zoning. A zoning hearing will be conducted for this property later tonight during the Joint Public Hearing. CITIZEN COMMENTS: None. COUNCIL/STAFF DISCUSSION Deputy City Manager Alan Mueller stated this is the second and final Public Hearing. The first reading of the Ordinance will take place during the first Council Meeting in April. The second and final reading of the Ordinance will take place during the second Council Meeting in April.
