2005-03-07 CITY COUNCIL PUBLIC HEARING MEETING MINUTESMINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON MARCH 7, 2005, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Tom Reid Mayor Pro -Tem Charles Viktorin Councilmember Richard Tetens Councilmember Woody Owens Councilmember Larry Marcott Councilmember Kevin Cole City Manager Bill Eisen City Attorney Darrin Coker City Secretary Young Lorfing Others in attendance: Deputy City Manager Alan Mueller; Executive Director of Community Services Nick Finan; Marketing Manager of P.E.D.C. Will Benson; and Planning Manager of Community Development Lata Krishnarao. PURPOSE OF HEARING — PROPOSED ANNEXATION OF APPROXIMATELY 432 ACRES OF LAND. Approximately 432 acre tract generally located south of Beltway 8, north of Clear Creek, west of SH 288 and east of Old Airline Road (also called County Road 48 and Almeda School Road.) STAFF REVIEW City Manager Bill Eisen stated this is the first of two Public Hearings. He stated Deputy City Manager Alan Mueller would discuss the proposed Service Plan in the event of annexation. Deputy City Manager Alan Mueller gave a brief description of the area as related to the vicinity map. Along the southern boundary of the property is Clear Creek. SH 288 is to the east of the property and Beltway 8 is to the north. The properties north, east, and south to the tract are already within the City limits. Within the boundaries of the property, public roads would be included. Those roads are Fruge Road, Cooper Road, and Riley Road. The western boundary includes the Almeda School Road, however the road itself would not be included within the annexation. The Service Plan provides the level of service currently available to other parts of the City that are similar to the tract. Page 1 of 4 — 3/7/2005 The City would provide services by any means or methods that are already in use by the City. Services may include an application, eligibility, and fee process. The services would be provided immediately upon annexation. Those items include Police, Fire, EMS, and solid waste collection services with one exception. Currently this area is within the service area of the Fire Department. Waste Management would provide trash pick-up to the area as provided within the City's franchise agreement. Any existing carriers providing service within the area could continue to do so for a two-year time period. There are no active public water or sewer systems for the area. The City would not take on any current operating requirements for water or sewer. The City would maintain the roads for the area. There are no public parks, playgrounds, swimming pools, or any other public facilities. Additional services provided by the City are Library service, health services, code enforcement, and any additional services available to all citizens within the City. No capital improvement program would be necessary to provide any additional Police, Fire, EMS, or solid waste services. The area would be serviced from an existing infrastructure. A water, sewer, and road project is currently in design for the area. This project is associated with the extension of Kirby Drive. This road would provide additional access to the area and water and sewer trunk facilities. No additional infrastructure is needed for parks or playgrounds. CITIZEN COMMENTS Richard Martini, 1306 E. Anderson Road, Houston, addressed Council and stated he is a landowner within the proposed annexation area. He asked if there is any significance in not annexing County Road 48. He asked if there is a Comprehensive Plan for the annexation of the property. He asked if there is a co -classification regarding the zoning of the property. In addition, he asked if the 100 ft. set -back along Clear Creek would apply to this tract. Darlene McCorey, 15011 Almeda School Road, addressed Council and asked for cost that would apply to her. R.H. Martini, 1306 E. Anderson Road, Houston, addressed Council and stated his family operates a cattle farm within the proposed annexation area. He understands that County Road 48 would not be annexed. He is opposed to the annexation. COUNCIL/STAFF DISCUSSION Deputy City Manager Alan Mueller stated there is a City policy not to annex down the center of a street and this is why County Road 48 is not part of the proposed annexation. Annexing down the center of a street creates a maintenance problem and problems associated with calls for Police and EMS services. Typically, the City would Page 2 of 4 — 3/7/2005 annex the street that is adjacent to the property being annexed. Upon annexation, the property would be zoned as pertaining to the Comprehensive Plan. This area would be located in the new Spectrum District; the zoning category is currently in process and should be adopted within the next few months. Upon the finalization of the Spectrum District, this property will temporarily be zoned Suburban Development. A separate zoning hearing will take place once the Spectrum District zoning category is finalized. The 100 ft. set -back from Clear Creek is currently within the City Limits. The current tax rate is .694755 per $100 of value. A preliminary plat has been submitted by Shadow Creek Ranch for the improvements to the Almeda School Road from Shadow Creek Parkway up to Clear Creek. The expected completion of the improvements should be within the middle of 2006. Councilmember Cole asked Staff to share the City's policy regarding Clear Creek. Deputy City Manager Alan Mueller stated any property within the Clear Creek area has to get approval from both the City and Harris County Flood Control. The City of Pearland would maintain any roadside ditches that are within the City of Pearland. Harris County would still maintain the road and ditches of the Almeda School Road. Councilmember Marcott asked if the portion of Almeda School Road south of the creek is located within the City Limits. Deputy City Manger Alan Mueller stated that portion is within the City Limits. A brief discussion ensued among Council and Staff regarding the construction to this portion of the road in order to allow the better flow of emergency services to the area. Councilmember Cole asked for more information regarding the road and bridge construction on County Road 48. Deputy City Manger Alan Mueller stated the bridge is a concrete, two-lane bridge. Harris County is possibly considering replacing and widening the bridge. The road was not closed due to the bridge, but for other reasons. Approximately 20.5 acres of land generally located north of Romero Drive, and being parts of Villa Verde Section 2 and Section 3. STAFF REVIEW Deputy City Manager Alan Mueller stated the vicinity map gives a clearer picture of the area of the proposed annexation. He briefly described the area as referenced on the vicinity map. The area being annexed is part of Villa Verde Section Two and Section Three. During a previous annexation into the extraterritorial jurisdiction, this portion was part of Houston. Houston allowed the City of Pearland to extend the extraterritorial jurisdiction to now include the two mentioned sections. The street, water, and sewer facilities are already in place. The balance of these 20.5 acres will now be annexed into the City. The Service Plan includes infrastructure and infrastructure maintenance currently available to the City. Some of the services may include an eligibility, application, and fee process. The services will be available immediately upon annexation, which include Police, Fire, EMS, and solid waste collection. Existing water and sewer facilities will be maintained and operated by the City. The City will also take over the jurisdiction over the streets. There are no public parks, playgrounds, swimming Page 1 of 2 — 3/7/2005 pools, or any other public facilities within the area. Waste Management will provide trash pick-up for the area, conducting this service under the current franchise agreement. The Pearland Volunteer Fire Department in conjunction with the Southeast Volunteer Fire Department will service this area. Library services, health services, code enforcement services, and all other City services are available to the residents. No capital improvement is necessary to serve this tract. Public Safety will be served from existing facilities and the construction of streets and sewer already exist in this area. This property was built in conformance with the City's R-2 zoning. A zoning hearing will be conducted for this property on March 21, 2005. CITIZEN COMMENTS: None. COUNCIL/STAFF DISCUSSION Councilmember Marcott asked for clarification regarding the road near Dixie Farm. Deputy City Manager Alan Mueller stated the road near Dixie Farm is a Harris County Project, which is Black Hawk. It will not be within the annexed area. Councilmember Marcott asked if this would conflict with the current Dixie Farm Road Project. Deputy City Manager Alan Mueller stated the City would need to make sure to incorporate this location into the plans because it was not part of the original plans. Councilmember Cole asked if this annexation was requested. Deputy City Manager Alan Mueller stated the City initiated this annexation.
