CALL TO ORDER The Regular Meeting was called to order at 6.30 pm with the following present: P &Z Chairperson Ruby Sandars P &Z Commissioner David Ransom P & Z Commissioner Neil West P &Z Commissioner Sheryl Greiner P &Z Commissioner Joe McWhorter P &Z Commissioner Peter Dumont (from 6.44 p m.) Absent was Vice Chairperson Todd locco Also in attendance Executive Director of Community Services Nick Finan, Planning Director Lata Krishnarao, Senior Planner Theresa Grahmann, Plans and Plat Administrator Richard Keller, Planner 1 Diana DuCroz, Deputy City Attorney Nghiem Doan and Planning Administrative Secretary Melisa Durham II. APPROVAL OF MINUTES March 21, 2005— Regular Meeting following a Joint Public Hearing March 21, 2005—Joint Public Hearing (pending City Council approval) Commissioner West made a motion to approve the minutes as presented, and Commissioner Ransom seconded Minutes were approved 5-0 III. NEW BUSINESS A. CONSIDERATION & POSSIBLE ACTION — Preliminary Plat Of Pearland Corner Phase Two A request by Chris L. Hendrick, The Wilson Survey Group, Inc., for Land Quest, LLC, for approval of a Preliminary Plat subdivision of 1 7452 acres zoned Commercial (C) for one lot intended for commercial use The plat is located on the east side of Dixie Farm Road, north of Broadway, and is described as follows A subdivision of 1 7452 acres in the W D C Hall League, Abstract No 70 in the City of Pearland, Brazoria County, Texas. Planner 1 Diana DuCroz gave the staff report. CONSIDERATION & POSSIBLE ACTION—Preliminary Plat of Shadow Creek Ranch Commercial Site No. 3 A request by Jason R. Banda, LJA Engineering & Surveying, Inc. for Pearland Investments, LLP, for approval of a Preliminary Plat of 2 963 acres in Shadow Creek Ranch for one lot for commercial use The plat is located at northeast corner of the intersection of Kirby Dr and Broadway (F M 518) in the Shadow Creek Ranch PUD, and is described as follows. 2.963 acres, being out of the T C R.R. Co Survey, Section 3, Abstract 678, and the T C R.R. Co Survey, Section 4, Abstract 675, City of Pearland, Brazoria County, Texas. Planner 1 Diana DuCroz gave the staff report. There is one outstanding item regarding streetlights. Commissioner Ransom made a motion to approve with staff's comments, and Commissioner McWhorter seconded Vote was 5-0 for approval C CONSIDERATION & POSSIBLE ACTION — Preliminary Plat of Shadow Creek Ranch Commercial Site No. 18A A request by Jason R. Banda, LJA Engineering & Surveying, Inc. for Pearland Investments, LLP, for approval of a Preliminary Plat of 27 160 acres in Shadow Creek Ranch for five lots for commercial use, with 4 310 acres reserved for drainage The plat is located at the northeast corner of the intersection of Kirby Dr and Shadow Creek Parkway (F M 2234) in the Shadow Creek Ranch PUD, and is described as follows. 27 160 acres, being out of the T C R.R. Co Survey, Section 3, Abstract 678, and the T C R.R. Co Survey, Section 4, Abstract 675, and the Obediah Pitts Survey, Abstract 717, City of Pearland, Brazoria County, Texas Planner 1 Diana DuCroz gave the staff report. There are two outstanding items. Commissioner Ransom made a motion to approve with staff's comments, and Commissioner McWhorter seconded Vote was 5-0 for approval D. CONSIDERATION & POSSIBLE ACTION -Zone Change Application No. 1213 A request by Jack McGuff, Jr , AIA, applicant for Massoud Motamedi, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Neighborhood Service (NS), on the following described property, to wit: Legal Description 5 00 acres, being part of Lots 78 and 79, of the Figland Orchard Subdivision, Abstract 240, H T & B R.R. Company Survey, City of Pearland, Brazoria County, Texas (generally located on the East Side of Harkey Road, and North of Fite Road) Minutes—P&Z oedowea, 91H 105 Page 2 of 4 PLANNING & ZONING COMMISSION Senior Planner Theresa Grahmann gave the staff report. The Planning & Zoning Commission denied a zone change for the subject property to GB on February 21, 2005 due to traffic, safety, access to Bardet Street and intensity of GB zoning in that location. Staff recommends approval of the revised zone change to NS, as proposed by the applicant, because it is consistent and compatible with other NS and GB zonings in the area. Commissioner Ransom made a motion to approve, and Commissioner McWhorter seconded There was some discussion regarding Bardet Street access and the allowed uses under NS zoning Vote was 5-0 for approval E. CONSIDERATION & POSSIBLE ACTION -Zone Change Application No 1214 A request by Jack McGuff, Jr , AIA, applicant for Massoud Motamedi, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Office & Professional (OP), on the following described property, to wit: Legal Description Lots 13 and 14, of Garden Acres Subdivision, Section 3, as recorded in Volume 10, Page 77 of the Brazoria County Plat Records, Abstract 219, H T & B R.R. Company Survey, City of Pearland, Brazoria County, Texas (generally located on the West Side of O'Day Road, and South of Gardenia Street) Senior Planner Theresa Grahmann gave the staff report. The Planning & Zoning Commission denied a zone change to GB on February 21, 2005 due to non-conformity with the Comprehensive Plan Staff recommends denial of the zone change for OP, as proposed by the applicant, because of the potentially negative impact on the adjacent residential uses, adjacency issues, screening issues and incompatibility with the Comprehensive Plan The applicant, Massoud Motamedi, made a presentation to the Commission He feels that the information he gathered before purchasing the property led him to believe he could operate a business at this location There was much discussion regarding the zoning of the surrounding properties, traffic, noise, and the impact of allowing another business in an area that is largely residential The upcoming Unified Development Code was also discussed as to how it may affect the zoning when it is implemented The applicant withdrew his application for zone change. No further action was taken.
