MINUTES
OF THE REGULAR MEETING FOR THE PLANNING AND ZONING COMMISSION OF
THE CITY OF PEARLAND, TEXAS, HELD ON FEBRUARY 7, 2005 AT 6 30 P M , IN
THE FIRST FLOOR CONFERENCE ROOM OF CITY HALL, 3519 LIBERTY DRIVE,
PEARLAND, TEXAS
The meeting was called to order at 6 30 p.m with the following present:

NEW BUSINESS
A. DISCUSSION ITEM —Status of the Old Townsite Study
Executive Director of Community Services Nicholas Finan introduced John Hoal of
H3 Studio, Consultant for the Old Townsite Mr Hoal then made a presentation of
the culmination of information to this point by H3 Studio, the Steering Committee
and the Public Workshops Discussion ensued regarding design, parking,
acceptance by the citizens, perimeters of the Old Townsite area, build-out time,
phasing, zoning, density, cost, financial resources, developers' incentives, and
commitment by the public and the City
B. DISCUSSION ITEM — P &Z Commissioners Survey
Planning Director Lata Krishnarao mentioned a few key areas of improvement to the
P&Z process, which are changes to the agenda regarding platting information, a
concise staff report and creation of a sign up sheet for persons wishing to speak for
or against on a zoning request. Each Commissioner is requested to complete a
survey to help the Planning Department provide them with better service, and have
them ready by the next meeting
C CONSIDERATION & POSSIBLE ACTION — Final Plat of CMAS Interest, LLC
A request by CMAS Interest, LLC, for Final Plat approval of a 4 2357-acre parcel in
the City of Pearland ETJ for commercial use, located on C R. 94 north of the
Silverlake Wal-Mart, and described as follows.
4 2357 acres of land in the H T & B R.R. Survey, Section 85, Abstract 304, Brazoria
County, Texas

D CONSIDERATION & POSSIBLE ACTION — Preliminary Plat of Cooper Estates
A request by Patrick and Mary Cooper for Preliminary Plat approval of a one-acre
residential property located at 2150 Linda Lane, north of Hughes Ranch Road,
zoned Single Family (R-1), and described as follows
0 9999 acres of Land, out of Lot 7 of the Allison Richey Gulf Coast Home Company
Subdivision of Section 20, H T & B R.R. Co Survey, Abstract 506, City of Pearland,
Brazoria County, Texas.
Planner 1 Diana DuCroz presented the staff report. There are no outstanding
items
Commissioner Ransom made a motion to approve, and Commissioner West
seconded Chairperson Sandars asked why they are platting just a portion of this
property, and Ms. Krishnarao and Ms DuCroz explained that they want to build an
addition on the structure
The vote was 5 to 0 for approval.
E. CONSIDERATION & POSSIBLE ACTION — Final Plat of Dynamic Lighting
A request by J Ray Laney, R.P L.S , for Dynamic Lighting, Inc. for Final Plat
approval of a 16 5-acre parcel zoned Light Industrial (M-1) for an existing light
industrial use, located at 5220 Shank Rd, and is described as follows
16 5374 acre tract out of Lots 6 and 15 of the H Masterson Subdivision of Section
5, of the H T & B R.R. Co Survey, Abstract 237, City of Pearland, Brazoria County,
Texas
Planner 1 Diana DuCroz presented the staff report. There are no outstanding
items
Commissioner Ransom made a motion to approve, and Commissioner West
seconded.

F CONSIDERATION & POSSIBLE ACTION — Final Plat of Kids "R" Kids Texas
No. 42
A request by Arthur Pisana of Benchmark Engineering for a Final Plat approval of a
1 6941-acre parcel in Shadow Creek Ranch for a day-care facility, located at the
northeast corner of Halfmoon Bay Drive and Broadway in the Shadow Creek Ranch
Planned Unit Development (PUD), and described as follows.
A subdivision of 1 6941 acres being out of the H T & B R.R. Co Survey, Section
82, Abstract 565, City of Pearland, Brazoria County, Texas

G. PUBLIC HEARING — Replat of W C Properties Commercial Center
A subdivision of 17 9147 acres of land is Section 85 of the H T & B RR. Co Survey,
Abstract 304, in the City of Pearland, Brazoria County, Texas, Being a Replat of
W C Properties Commercial Center together with an Unplatted Tract.
Plans and Plat Administrator Richard Keller presented the staff report.
Steve Gardner, representative for the applicant, explained the replat.
There were no persons to speak for or against the proposed replat.
H. CONSIDERATION & POSSIBLE ACTION — Final Plat of W C Properties

A request by Steven Gardner, P E., Huitt-Zollars, Inc., for Final Plat approval of a
17 9147-acre parcel into 4 Lots zoned General Business (GB), located at the
northeast corner of Broadway and Miller Ranch Road, and described as follows

land in Shadow Creek Ranch for a portion of Arcadia Bay Drive, located in the
southwestern section of the Shadow Creek Ranch Planned Unit Development
(PUD), Fort Bend County, and described as follows

Richard Keller presented the outstanding items.
Commissioner Ransom made a motion to approve with staff recommendations.
Commissioner Greiner seconded There was discussion regarding this property not
complying with the densities recommended by the Comprehensive Plan, and is in
the ETJ area. The applicant, Jason Christian of JKC &Associates, stated that they
have a development agreement with the City concerning the lot size Chairperson
Sandars requested that Planning Director Lata Krishnarao discuss this issue with
the Unified Development Code consultant firm
The vote was 5 to 0 for approval
M CONSIDERATION & POSSIBLE ACTION —Consider the request initiated by the

P DISCUSSION ITEM — Procedures for P &Z Commissioners to Consider
Chairperson Sandars presented some issues that have been arisen from previous
Planning & Zoning Commission meetings. Items discussed were (1)
appropriateness of comments, (2) responsibility of Commissioners is to evaluate the
best use of land and consistent use of land, and (3) question of hardship, pertaining
to finances
