CALL REGULAR MEETING TO ORDER The regular meeting was called to order at 6:1 Opm. The following people were in attendance: Dale Pillow Chairperson Anne Talbot Board Member Willard Briley Board Member Don Glenn Board Member Marvin Elam Board Member Lata Krishnarao Planning Manager Theresa Grahmann Planner II. APPROVAL OF MINUTES FROM MAY 69 2004 There were no minutes for approval. III. NEW BUSINESS A. VARIANCE APPLICATION NO. 04-13 1. CALL PUBLIC HEARING TO ORDER The public hearing was called to order at 6:1 1pm. 2. PURPOSE OF HEARING: A request by Olga Ramirez, owner, for a variance from the requirements of Section 8.4(2)(b) Yard Setback Requirements, of the Land Use and Urban Development Ordinance of said City., on the following described property, to wit: Legal Description: South Hampton Sec 2 (A0304 HT&BRR) (Pearland), Block 2, Lot 5 (9701 Berkshire Trace) Page 1 of 2 (06-03-04) 3. STAFF REPORT Lata Krishnarao, Planning Manager, explained that this applicant is requesting a variance from the rear yard setbacks. The subject property is located on the North side of Berkshire Trace. It is a corner lot. The owner is proposing to build a sunroom on the back of the house, but there is a 20 -foot rear -yard setback, which would result in an encroachment of 10 feet. 4. APPLICANT PRESENTATION John Holiday, 14506 Cocoa Valley, Exterior Designer representing Ms. Ramirez, explained that the backyard of this house is only 20 feet deep. The setback takes up the whole yard. There are two other homes on the street that have a sunroom and covered patio. He also explained that the sunroom would not be seen from the street. It is a glass enclosure for plants. He also added that the owner has received approval from the Home Owner's Association. 5. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST None 6. STAFF / BOARD / APPLICANT DISCUSSION Board Member Anne Talbot asked how big the sunroom would be. Mr. Holiday said that the sunroom would be 10 feet by 20 feet. 7. ADJOURNMENT OF PUBLIC HEARING The public hearing was adjourned at 6:22pm. 8. CONSIDERATION AND POSSIBLE ACTION OF APPLICATION 04-13 Board Member Willard Briley made a motion to approve the variance. Board Member Don Glenn seconded the motion. The vote was 0 to 5. The variance was denied. IV. ADJOURNMENT OF REGULAR MEETING The regular meeting was adjourned at 6:24pm.
