2004-09-13 CITY COUNCIL PUBLIC HEARING MEETING MINUTES - SPAMINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON SEPTEMBER 13, 2004, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. Others in attendance: Deputy City Manager Alan Mueller; Executive Director of Community Services Nick Finan; Executive Director of Economic Development Corporation Fred Welch; City Engineer Doug Kneupper; Public Affairs Liaison Lynn Munford; Project Director Joe Wertz; Planner 1 Theresa Grahmann. PURPOSE OF HEARING — TO GATHER PUBLIC COMMENT AND TESTIMONY REGARDING AN AMENDMENT TO THE STRATEGIC PARTNERSHIP AGREEMENT BETWEEN THE CITY AND BRAZORIA COUNTY MUNICIPAL DISTRICT NO. 16. STAFF REVIEW OF THE SERVICE PLAN Deputy City Manager Alan Mueller stated a previous Workshop took place regarding this topic. The Strategic Partnership Agreement states that a portion of the commercial property on the frontage of FM 518 and its portion of the detention would be allowed to be included in the future detention ponds of the 65 -acre property purchased from MHI. The Drainage District is reluctant to approve the drainage plan for the property because there is no detention pond currently in place and no set schedule for placement of the pond. The developer will now provide detention for the commercial property within their own detention pond located on the south side of the creek. The estimated amount of detention has been converted. It is suggested that the agreement be amended to show that 24.4 acre feet have been reserved for their detention pond when it is built. This agreement has no impact on the City in terms of the volume committed. This is just a way for the agreement to be more flexible and continue with the project. Page 1 of 3 — 9/13/2004 CITIZEN COMMENTS None COUNCIUSTAFF DISCUSSION Councilmember Marcott asked for clarification regarding the change from 32.69 to 20.04. Deputy City Manager Alan Mueller stated the engineer's original calculation was more generous in terms of what the developer thought should be attributable to the property. Higher runoff coefficients than normal were used. Less detention is not being provided than should, but the initial run was a little over generous. Councilmember Marcott asked if the 30.04 is in accordance with the City's criteria. Deputy City Manager Alan Mueller stated it is in accordance with the City's criteria. City Engineer Doug Kneupper stated this calculates to approximately .68 acre-feet per acre. The City's new criteria establishes a minimum at .35 acre feet per acre. The developer is slightly above the new criteria. Deputy City Manager stated they are required to provide whatever detention is deemed necessary for the commercial property, which may be more after the specifics are completed. This is only saying that up to 20.04 acre feet will be allowed for use in the City's detention pond. Councilmember Marcott asked if there is a time and place for the north portion of the project. Deputy City Manager Alan Mueller stated there is no timing on the north portion of the project at this point. In the budget, there are some additional planning funds for layout and geo-technical work. Construction funding is not in the budget at this point. Councilmember Marcott asked if there is a time in place for the north portion of the project as related to the developer and their detention pond. Deputy City Manager Alan Mueller stated Phase One is under construction now. At this point there is nothing in the construction process on the northern section. He stated there would be an additional Public Hearing conducted by the City and two Public Hearings conducted by the Municipal Utility District.
