The meeting was called to order with the following present:

PURPOSE OF HEARING — ABANDONMENT OF UNUSED DEDICATED WATER AND
SEWER EASEMENT LOCATED ON A TRACT OF LAND AT THE SOUTHEAST
CORNER OF THE INTERSECTION OF E. BROADWAY AND LIBERTY DRIVE.
STAFF REVIEW OF THE SERVICE PLAN
City Attorney Darrin Coker stated this is a request for abandonment of a water and
sewer easement located off Liberty Drive at the Country Club Plaza Shopping Center.
A copy of the survey was reviewed regarding the easement area. The owner of the
shopping center is looking to develop the corner site. In the process of doing so, the
owner realized set back issues would occur due to the right-of-way of the City.
CITIZEN COMMENTS
Michael Klaus, 5016 Groveton, addressed Council and stated some of the documents
he has seen referencing, water subsidence and water levels are related to this area. He
wants to make sure that this is looked at because this is one of the areas in Pearland
where the adjustments to subsidence are located.

COUNCIUSTAFF DISCUSSION
Councilmember Cole stated he would like the information Mr. Klaus stated present
before voting on the abandonment.
Councilmember Marcott asked if there is anything underground in that area.
City Engineer Doug Kneupper stated the City is not aware of anything being
underground in that area.
A brief discussion ensued among Council and Staff regarding the easement.
Jay Javadi, owner of the Country Club Plaza, addressed Council and stated the pasture
in the area was developed by the previous owner in 1979. He stated the City of
Pearland did not pay anything for the easement.
Councilmember Woody Owens asked for clarification regarding the water and sewer
easement and where it is located on the property.
City Attorney Darrin Coker stated he thinks this went through the platting process to
ensure separate ownership as a means of getting services and does not think the City
had to pay anything for the easement.
Councilmember Marcott stated this needs to be verified.
Councilmember Owens stated it also shows a pipeline marker on the survey.
