2004-07-19 CITY COUNCIL PUBLIC HEARING MEETING MINUTES - ABANDONMENTMINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON JULY 19, 2004, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Mayor Pro-Tem Councilmember Councilmember Councilmember City Manager City Attorney City Secretary Tom Reid Charles Viktorin Woody Owens Larry Marcott Kevin Cole Bill Eisen Darrin Coker Young Lorfing Absent: Councilmember Richard Tetens. Others in attendance: Deputy City Manager Alan Mueller. PURPOSE OF HEARING - ABANDONMENT OF UNUSED DEDICATED SANITARY CONTROL EASEMENTS THAT PREVIOUSLY SERVED THE WEST LEA WATER COMPANY. Mr. Darrin Coker, City Attomey. STAFF REVIEW OF THE PROPOSED ABANDONMENT City Attorney Darrin Coker stated diagrams have been provided to Council regarding two sanitary control easements, which were acquired by the City when the City acquired the West Lea Water Company. Those wells have been capped and the sanitary control easements no longer serve any purpose for the surrounding properties encumbered by the easements. CITIZEN COMMENTS None COUNCIL/STAFF DISCUSSION Councilmember Marcott asked if the City purchased the easements. City Attorney' Darrin Coker stated the City paid for the assets of the company and also the right to go into this area and place water lines and sewer lines. The easements that Page 1 of 2 - 7/19/2004 exist do not give the City any rights. Since the City is not giving away any rights, the City should not seek any compensation for the abandonment. A brief discussion ensued among Council and Staff regarding the City's responsibility to maintain the easements. Councilmember Marcott asked for information on how the wells were capped. City Attorney Darrin Coker stated he did not have information on how the wells were capped. The Texas Commission on Environmental Quality regulates this requirement. Councilmember Viktorin asked if the abandonment would be taken away from the City's assets for accounting purposes. City Manager Bill Eisen stated the easement abandonment should be struck from the City's assets. Practically, the easements give the City no rights; the value ef the easements is zero. A brief discussion ensued among Council and Staff regarding the well sites and sanitary control easements.
