The meeting was called to order with the following present:

PURPOSE OF HEARING DISANNEXATION OF A TRACT OF LAND CONTAINING
APPROXIMATELY 21.43 ACRES OF LAND LOCATED IN THE H.T.&B.R.R.
COMPANY SURVEY, ABSTRACT NO. 300, BRAZORIA COUNTY, TEXAS.

STAFF REVIEW
City Attorney, Darrin Coker, stated the City Council previously adopted a payment in
lieu of taxes agreement regarding the property. This Public Hearing is required before
the disannextion of the property. The purpose of the disannexation would be to allow
the 20 acres of land to subsequently be annexed into Municipal Utility District No. 6. A
sales tax agreement is in place, and any sales tax revenue generated from the property
would go to the City. The property is located at the Northeast corner of SH 288 and CR
59. He further stated the City is not able to provide services to the property at this time.
Municipal Utility District No. 6 would be able to provide the services needed. Municipal
Utility District No. 6 has contacted the owner and came to an agreement regarding the
annexation of the property into the District. The owner would have to meet all
architectural design standards established by Silverlake Development Regulations.

COUNCIVSTAFF DISCUSSION
Councilmember Marcott stated he is concerned about the disannexed property at Wal-
Mart. He stated after disannexing the property, a very high sign was placed on the
property. He stated this is not allowed in the City's Sign Ordinance, but it is allowed by
the Municipal Utility District. He stated he would like for the Ordinances currently in
place for the City to be taken in consideration for properties being disannexed.
City Attorney, Darrin Coker, stated these issues can be discussed and are excellent
comments. The first reading of the Ordinance is on the Regular Business Meeting
Agenda for tonight. He recommended the second reading not take place for quite some
time because of a time gap of disannexation from the City and annexation into the
Municipal Utility District. He stated this is a concern because during that time, the
property would be located within the County and not be subject to the regulations of the
City. The second reading of the Ordinance should be postponed until a petition of
consent to annex the property into the Municipal Utility District is given to the City. He
further stated sign regulations can be resolved by processing a development agreement
with the developer or inputting a deed regulation/restriction.
Mayor Reid stated in general, the signs in the Municipal Utility District have been
attractive.
A brief discussion ensued among Council and Staff regarding signage within and
outside the City limits.
City Attorney, Darrin Coker, stated with the postponing of the second reading, the City
could look into the signage issue further.
