2003-11-10 CITY COUNCIL PUBLIC HEARING MEETING MINUTES - ABANDONMENTr MINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON NOVEMBER 10, 2003, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Tom Reid Mayor Pro -Tem Richard Tetens Councilmember Charles Viktorin Councilmember Larry Marcott Councilmember Klaus Seeger City Manager Bill Eisen City Attorney Darrin Coker City Secretary Young Lorfing Absent: Councilmember Woody Owens. Others in attendance: Deputy City Manager Alan Mueller; Executive Director of Community Services Tobin Maples; Executive Director of Economic Development Corporation Fred Welch; City Engineer Doug Kneupper; Public Works Superintendent Cecil Bowery; Planning Manager of Community Development Lata Krishnarao. PURPOSE OF HEARING — ABANDONMENT OF UNUSED PUBLIC UTILITY EASEMENT CONSISTING OF 0.548 ACRES AS DESCRIBED IN THE J. CRAWLEY SURVEY, ABSTRACT 174, AND THE WILLIAM MORRIS SURVEY, ABSTRACT 344, BRAZORIA COUNTY, TEXAS. Mr. Darrin Coker, City Attorney. STAFF REVIEW City Attorney, Darrin Coker, stated an Ordinance was passed several years ago regarding the procedures for the abandonment of any City right-of-way or easement. This Public Hearing is one of the procedural requirements. The easement is a 14 foot public utility easement located in Shadow Creek Ranch. The purpose for the abandonment of the easement is to accommodate a hospital that will be located on the property and the realignment of Medical Center Drive. The easement will be moved to the other side of the road. CITIZEN COMMENTS None Page 1 of 2 —11/10/2003 COUNCIL/STAFF DISCUSSION Councilmember Marcott asked if this adds about 50 feet to the right-of-way and if this is for a future water/sewer line. Deputy City Manager, Alan Mueller, stated it would be for a HOuston Lighting & Power line. The power line would be moved. The City does not have any intention of doing anything with this easement, and it was dedicated for the use of power lines to Shadow Creek Ranch. After the final configurations for the hospital were completed, it was discovered that the dedicated easement was not in the right location. The power line and a pipe line needed relocating for the hospital. Councilmember Marcott asked if the extra 50 feet would have an economic impact on the City. Deputy City Manager, Alan Mueller, stated it would not have an economic impact on the City. All of the utilities would be in the street right of way. Those utilities are all being funded by the developer through TIRZ. City Attorney, Darrin Coker, stated the first reading of the Ordinance abandoning the easement would be read at tonight's regular Council meeting.
