MINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON FEBRUARY 25, 2003, AT 6:30 P.M., AT THE COUNTRY PLACE GOLF SHOP MEETING ROOM, 313 FLOWERFIELD, PEARLAND, TEXAS. PURPOSE OF HEARING — TO GATHER PUBLIC COMMENT AND TESTIMONY REGARDING THE ADOPTION OF A STRATEGIC PARTNERSHIP AGREEMENT AND A SALES & USE TAX AGREEMENT BETWEEN THE CITY AND BRAZORIA COUNTY MUNICIPAL UTILITY DISTRICT NO. 4. STAFF REVIEW OF PROPOSED SERVICE PLAN City Manager, Bill Eisen, gave a brief overview of the Strategic Partnership Agreement and the Sales and Use Tax Agreement. Mr. Eisen stated the proposed date that has been established for the annexation of Municipal Utility District No. 4 is December 31, 2012. He further explained the creation of a Strategic Partnership Committee that will be formed to represent the Municipal Utility District during the transition period. The Page 1 of 3 - 2/25/2003 3� operation of the Municipal Utility District No. 4 will remain the same until the annexation with the exception of an additional charge of $4.38 per month collected on the utility bill. This charge will be used to offset the City's costs in providing Fire and EMS Services to Municipal Utility District No. 4. Municipal Utility District No. 4 Board member Thomas Goss stated the $4.38 would be paid out of District's funds. Mr. Eisen further stated any funds the Municipal Utility District has on hand Cqt the time of annexation would be used within Municipal Utility District No. 4. Tim Austin, Municipal Utility District No. 4 Attorney stated the City could annex the District at any time after giving the proper three-year notice. However, through the agreement the City will delay that process for 10 years and will allow for the transition to be phased in. Mr. Austin further explained how a Municipal Utility Districts are formed and operates. CITIZEN COMMENTS Dick Dalberg, expressed his concerns regarding garbage pickup and what options would be available for those residents who cannot take their garbage to the curb. Bill Eisen, City Manager, stated this is something that can be taken into consideration at the time of annexation. A brief discussion ensued between Mr. Eisen and a resident regarding the Traffic Control Station. Mr. Eisen stated the Traffic Control Station should be able to continue. Also, from the floor there was discussion regarding Country Place having a polling place on site for their residents. Mr. Eisen stated that would also be considered when the annexation is complete. Residents from the floor expressed concerns regarding the $4.38 fee being assessed on their utility bill. Mr. Eisen gave a brief explanation of the fees and a brief overview of the EMS services that will be provided. Additional discussion ensued between Mr. Eisen, Mr. Austin, and concerned citizens from the floor regarding Municipal Utility Districts No. 4 taxes and City property taxes. Page 2 of 3 - 2/25/2003 Brian Long, Lakeside, expressed his concerns regarding private streets and the maintenance of the streets when they are annexed. Mr. Eisen stated the streets will remain private and will continue to be maintained by the Homeowners Association. Brief discussion ensued between the concerned residents and Mr. Eisen regarding the possibility of a Police Sub -station being located on the west side of Pearland. Mr. Eisen, assured the residents that Municipal Utility District No. 4 would have proper police coverage and patrols in Municipal Utility District No. 4. City Manager, Bill Eisen, gave a brief overview of future water needs and the plans for the conversion to use more surface water and to pump less ground well water. The floor opened up for a question and answer session regarding the Strategic Partnership Agreement, Sales and Use Tax Agreement, and the proposed annexation. COUNCIUSTAFF DISCUSSION Mayor Reid gave a brief presentation regarding the action the City of Pearland has already taken and plan to take in the future regarding the water supply for the City. The Council and Board members thanked the residents for their attendance at the Public Hearing. In closing Mr. Eisen stated the next Public Hearing regarding the Strategic Partnership and Sales and Use Tax Agreement is scheduled for Tuesday, March 11, 2003 at .6:30 p.m. at City Hall. Also a Public Hearing regarding the Municipal Utility District Annexation will be conducted on March 11, 2003 at 6:30 p.m. ADJOURNMENT Meeting was adjourned at 7:45 p.m. Minutes approved as submitted and/or corrected this 14th day of A r' ZD., 2003.
