2003-01-27 CITY COUNCIL PUBLIC HEARING MEETING MINUTES22;3 MINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON JANUARY 27, 2003, AT 7:00 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Mayor Pro -Tem Councilmember Councilmember Councilmember Councilmember City Manager City Attorney City Secretary Tom Reid Woody Owens Richard Tetens Charles Viktorin Larry Marcott Klaus Seeger Bill Eisen Darrin Coker Young Lorfing Others in attendance: Deputy City Manager Alan Mueller; Executive Director of Community Services Tobin Maples, City Engineer John Hargrove, Public Affairs Liaison Lynn Munford, Public Works Director Jerry Burns. PURPOSE OF HEARING — UNUSED 'EDICATED RIGHT-OF-WAY EASEMENT LOCATED BETWEEN LOTS 161, 162, 163, AND 164 AS DESCRIBED IN THE H.T.&B.R.R. COMPANY SURVEY, ABSTRACT 551 AND 303, BRAZORIA COUNTY, TEXAS. STAFF REVIEW OF PROPOSED SERVICE PLAN Deputy City Manager, Alan Mueller, addressed Council and gave a brief explanation for the Public Hearing. Mr. Mueller stated there is a 70 foot. right-of-way easement that has been abandoned and it should revert to the property owner. The location of the area is Highway 35 and Industrial Drive, between two tracts of property zoned for multi -family. In closing, Mr. Mueller stated the applicant, R. West Development, is currently seeking to develop the property. CITIZEN COMMENTS Aaron McGuire, 6203 West Broadway, addressed Council and stated he is with R. West Development Company and they are wanting to get the right-of-way abandoned in order to combine the two multi -family tracks into one complete track. He stated one-story garden style apartments would be placed on the property. Page 1 of 2 -1 /27/2003 2 2, 4 COUNCIUSTAFF DISCUSSION Councilmember Marcott asked did the City own the property. City Attorney, Darrin Coker, stated the City does not own the property, but there is a dedicated right-of-way between the two tracks. Brief discussion ensued among Council and Staff regarding any possible uses and the initial intention of the property by the City. Brief discussion ensued among Council, Staff, and Aaron McGuire concerning future uses by R. West Development of the property. Mr. McGuire stated the remaining property would be used for Emergency Services access. He stated there would be a main entrance to the property towards Highway 35. Council and Staff stated the Drainage District should be included in the process before any further action is taken. Further discussion ensued among Council and Staff regarding the right-of-way easement.
