CALL TO ORDER The Joint Public Hearing was called to order at 6:38 p.m. PURPOSE OF HEARING Request for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Commercial District (C), on the following described property, to wit: Zone Change Application No. 1120 Legal Description: 8.84 acres, Tract No. 17 of the H.T.& B.R.R. Company Survey, Abstract 309, Brazoria County, Texas (South Side of FM 518, and west of Cullen Boulevard) Page 1 of 8 Owner: Cheng -Huey Su, Trustee 102 Pebblebrook Court Sugar Land, Texas 77478-3935 Applicant: None P & Z Chairman Todd Iocco read the purpose of the hearing into the record. III. APPLICATION INFORMATION AND CASE SUMMARY A. STAFF REPORT Executive Director of Community Development Tobin Maples gave a brief description of the surrounding properties. Mr. Maples stated we have received one public comment form in support of the zone change. He stated the comprehensive plan recommends low density, and is not consistent, however this corner is developing business type uses, and would be consistent with the current development. Mr. Maples added staff is recommending denial, but we would recommend General Business or Office Professional. B. APPLICANT PRESENTATION Cheng Huey Su, trustee, 102 Pebblebrook Ct., Sugarland, Texas stated his concern is the major traffic on Hwy. 288 and Broadway, he stated the south side of this property is developed and on the north side Clinton Wong is also developing. IV. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST None V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Councilman Charles Viktorin asked is General Business consistent with the proposed use. Mr. Su replied he did not know what the difference was between Commercial and General Business. Executive Director of Community Development Tobin Maples stated we have met the applicant, and would be happy to meet with him again. Mayor Tom Reid stated the applicant could change to General Business and proceed on. Mr. Maples replied if the applicant is willing to change, the main difference in Commercial Page 2 of 8 and General Business is you cannot have outside storage in General Business, and everything you want to sell has to be inside the buildings. PURPOSE OF HEARING Request for an amendment to the Land Use and Urban Development Ordinance of said City to amend the existing Planned Unit Development (PUD), on the following described property, to wit: Zone Change Application No. 1121 Legal Description: 3.00 acres, Tract No. 36H2 of the H.T.& B.R.R. Company Survey, Abstract 219, Brazoria County, Texas (6301 Broadway Street) Owner: Jim Marsh 7919 Montglen Houston, Texas 77061 Applicant: Jimmy Vaughan 3023 Taylorcrest Pearland, Texas 77584 P & Z Chairman Todd Iocco read the purpose of the hearing into the record. III. APPLICATION INFORMATION AND CASE SUMMARY A. STAFF REPORT Executive Director of Community Development Tobin Maples gave a brief description of the surrounding property. Mr. Maples stated the applicant is trying to incorporate a —� phasing plan, and is trying to amend the existing Planned Unit Development. Mr. Maples added we gave the tenant a temporary certificate of occupancy to allow them to make improvements, and those improvements have not been made. We have received 1 public Page 3 of 8 comment form in opposition. Mr. Maples stated one of the elements of the amendment is the construction of a six -foot masonry fence. B. APPLICANT PRESENTATION Jimmy Vaughan, lessee, 6301 Broadway, stated they plan to construct a masonry wall were the wooden fence is currently. Mr. Vaughan stated they have future plans for a nursery and green house. He added that they intend to extend the masonry fence once they utilize the rest of the property. IV. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST Dan McMaster, 2614 Thelma, Pearland, asked where this proposed 353' of fence begins and ends. Mr. Vaughan replied it begins at the northeast of the property and ends at Broadway Street. Tom Reginski, 6220 Gardenia, Pearland, stated he is happy the applicant is making improvements but he is worried about the completion of the masonry fence, he added he would have to vote against the zone change. Arthur Kneeland, 2626 Thelma, Pearland, stated he is worried about drainage and where the masonry wall begins and ends. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Mayor Tom Reid read into the record one public comment form in opposition. Councilman Klaus Seeger stated the applicant needs to make sure the deadlines listed in the Planned Unit Development are attainable because we will enforce them. Executive Director of Community Development Tobin Maples stated they have had some code enforcement issues, and they will need to obtain a building permit for pier and beams, signed and sealed by an engineer, for the construction of the masonry fence. APPLICATION INFORMATION AND CASE SUMMARY A. STAFF REPORT Executive Director of Community Development Tobin Maples gave a brief description of the surrounding properties. Mr. Maples stated we received one public comment form, and staff is recommending approval because it is consistent with the surrounding uses. Mr. Maples added a traffic impact analysis would be required at the time of platting. Deputy City Manager Alan Mueller pointed out three items that are inconsistent in the PUD document. Page 5 of 8 B. APPLICANT PRESENTATION James Johnson, 900 Apollo Lane, Houston, stated this is a master plan community of 477 acres. Mr. Johnson stated the road issue came up in the Planning and Zoning meeting, and is sort of a dilemma, because someone else owns the property where the two streets would align. After speaking with Deputy City Manager Alan Mueller, there may be more alignment further to the east, and they can work with it that way. Mr. Johnson stated the PUD has an estimated 1,502 single-family homes, which complies with the comprehensive plan, there will be 73 acres of open space with constant level lakes. IV. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST Raymond Shield, 2342 CR 48, Pearland, stated his house has flooded, and Shadow Creek Ranch is not working with the drainage. Kay Houser, 2807 Honeysuckle, Pearland, stated she has been here 27 years and we welcome new subdivisions. However, there is only one road to get to SH 288 and that is County Road 92, and there are drainage and traffic issues. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Mayor Tom Reid stated we received five public comment forms. Councilman Larry Marcott expressed his concern on the alignment of the entrance road. Councilman Richard Tetens asked if the lakes were not detention lakes then where is the detention going to be. James Johnson replied the 12 -acre lake is a detention lake Chairman Todd Iocco stated his concern was with the road alignment. Deputy City Manager Alan Mueller stated the road on the thoroughfare plan entry meets the City's requirements. VI. To date we have not received any public comment forms in support or opposition. Mr. Maples stated staff recommends approval due to the consistency with our comprehensive plan. B. APPLICANT PRESENTATION Paul Ridgeway, 1833 Hillhouse, Pearland, stated he was annexed a few years ago, and is trying to put in a bathroom, and needs to be rezoned. IV.
