City Councilman Richard Tetens and P &Z Commissioner Ruby Sandars were absent ZONING APPLICATION NO. 1115 I. CALL TO ORDER The Joint Public Hearing was called to order at 6:36 p.m. II. PURPOSE OF HEARING Request for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Commercial District (C), on the following described property, to wit: Zone Change Application No. 1115 Legal Description: 2.467 acres, out of the H.T. & B.R.R. Company Survey, Abstract 243, Tract 48A and 48A2, Brazoria County, Texas (8027 Broadway Street, at Zapalac Road) Page 1 of 6 Owner: William and Katherine Favor 3933 Meadowlark Way Pearland, Texas 77584 Agent: No agent The purpose of the hearing was read into the record by Planning and Zoning Chairman Todd Iocco. III. APPLICATION INFORMATION AND CASE SUMMARY A. STAFF REPORT Executive Director of Community Services Tobin Maples gave a detailed staff report. Mr. Maples stated the property is at the northeast corner of Broadway and Zapalac. He added the owner is looking to sell the property as a Commercial property. He pointed out that the Comprehensive Plan calls for General Business District, and from staff s point of view, the request is consistent with the surrounding properties. Mr. Maples also pointed out that if outside storage is an option, the owner would have to apply for a Specific Use Permit. He stated that 17 Public Comment Forms were sent out to the surrounding property owners; only one was sent back to the City in support of the request. B. APPLICANT PRESENTATION Will Favor, 3933 Meadowlark Way, Pearland, TX 77584, stated that he was very impressed with staff s report. He said he knows more about his property then he ever has. He stated he is trying to sell the property as "Commercial" in order to keep his options open. He said at this time he has no plans for the property. IV. APPLICATION INFORMATION AND CASE SUMMARY Executive Director of Community Services Tobin Maples gave a staff report for both Zone Change Application Nos. 1117 & 1118. He stated that staff does recommend approval because the predominant use of the land is single family dwelling. He added that one Public Comment Form has been received in support of Zone Change Application No. 1117. B. APPLICANT PRESENTATION NONE IV. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST NONE V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Council Member Marcott pointed out that the "Suburban Development" land to the east on FM 518 should be zoned "Commercial". He stated that is O'Days Hardware. Mr. Marcott then stated that no notification was sent to the O'days. Planner I Theresa Grahmann pointed out that on the last page it shows the owners who received the notifications and the O'days are on that list. Planning and Zoning Commissioner Ray Bacon commented that the lot across the street could eventually bring in a business and if they zone this as residential then the business would have to comply with the masonry fence requirements. Company Survey, Abstract 304, Brazoria County, Texas (County Road 403 (Hughes Ranch Road), east of CR 94) Owner: Lisa and David Tran 10522 Sagepark Houston, Texas 77089 Agent: Paksima Group 203 Aurora Street Houston, Texas 77008 The purpose of the hearing was read into the record by Planning and Zoning Chairman Todd Iocco. III. APPLICATION INFORMATION AND CASE SUMMARY A. STAFF REPORT Executive Director of Community Services Tobin Maples gave a detailed staff report. He stated the Comprehensive Plan calls for Medium Density (R-3, R-4). He added the owner's intent is to subdivide the land into 3 or 4 lots. Mr. Maples stated that all lots will have to front on a public thoroughfare and a Traffic Impact Analysis may be Page 5 of 6 required.
