2002-10-29 CITY COUNCIL PUBLIC HEARING MEETING MINUTES - 7:30PM113 MINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON OCTOBER 29, 2002, AT 7:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Tom Reid Mayor Pro -Tem Woody Owens Councilmember Richard Tetens Councilmember Larry Marcott Councilmember Klaus Seeger City Manager Bill Eisen City Attorney Darrin Coker City Secretary Young Lorfing Absent: Councilmember Viktorin. Others in attendance: Deputy City Manager Alan Mueller; Police Chief, J.C. Doyle. PURPOSE OF HEARING PROPOSED ANNEXATION To consider the proposed annexation of approximately 582 acres, consisting of all of Brazoria County Municipal Utility District No. 5 and the adjacent portions of County Road 403 and FM 865, Brazoria County, Texas. STAFF REVIEW OF PROPOSED SERVICE PLAN City Manager, Bill Eisen, addressed Council and gave a brief overview of the annexation process of Municipal Utility District No. 5. Deputy City Manager, Alan Mueller, addressed Council and reported this is the second of two public hearings. This annexation is proposed in conjunction with a Strategic Partnership Agreement. There are two separate public hearings regarding the Strategic Partnership Agreement. The first was held on October 23, 2002 and the second will be held on November 5, 2002. Under the terms of State law regarding annexation and the Strategic Partnership Agreement the effective date of the annexation will be December 31, 2005. Mr. Mueller further stated the provision of the Strategic Partnership Agreement creates a date for annexation. The operation of the Municipal Utility District will remain the same with an additional charge of $4.38 per month collected on the utility bill. This charge will be used to offset the City's costs in providing Fire and EMS Services to the Municipal Utility District. A liaison committee will be available by the Page 1 of 4 -10/29/2002 Municipal Utility District Board to accommodate transition issues. He stated during the transition the utility fees will be consistent with the City and the City will be allowed to collect sales tax on any taxable items within the Municipal Utility District. Mr. Mueller further stated any remaining funds in the Municipal Utility District accounts during the time of annexation would be spent within the boundaries of the Municipal Utility District. He noted that the Home Owners Association would not be affected by the annexation or the Strategic Partnership Agreement. Mr. Mueller stated that the Service Plan has an effective date of December 31, 2005, and also noted the Service Plan provides a level of services for the Municipal Utility District. The City may provide those services directly or may contract other parties to provide those services. He noted that the term Standard Policy and Procedures means that an application or fee for services may apply. He stated that State Law requires two portions of the Service Plan, first section is the Early Action Program and the second section is a Capital Improvement Program. The services are effective immediately upon the date of annexation. These services provide Police, Fire, and EMS services. Solid waste collections will transition to collection under the City's contract in accordance with State Law. Mr. Mueller stated that in regards to the operation maintenance of water and waste facilities, the City would take the place of the Municipal Utility District including any joint facilities. He stated the City would be responsible for any maintenance and operation of any public streets including a Street Lighting Bill. Mr. Mueller further stated there are no parks or swimming pools operated by the Municipal Utility District. The pools will belong to the Home Owners Association. Mr. Mueller stated the drainage facilities within the district would be maintained by the City. Additional services to the residents would include library and health services. The Capital Improvement Program has not foreseen a need for any additional facilities. He also stated the Police Department would be expanded in order to serve the area. Mr. --- Mueller further reviewed the City services and gave a brief overview of the service plan. CITIZEN COMMENTS Jennifer Lang, Helmsly Drive — South Down, addressed Council and stated she has lived there since July of 1983, and stated she opposes the annexation. Ms. Lang further stated she feels as if she would not benefit from the annexation. She stated the current emergency services received by the district are working very well. Vicki Neal, 2915 Norwich, addressed Council and stated she has been a resident since 1984. Ms. Neal stated housing costs for the City of Pearland have increased and they are still increasing. She stated she is currently a single parent mom who had to look for apartment housing due to a divorce. Ms. Neal stated costs of housing should be addressed in the City due to increasing single parent homes. She stated she currently lives in South Down because of housing costs in Pearland. In closing she stated she opposes the annexation. Page 2 of 4 - 10/29/2002 Steve Friedman, 1134 Woodbridge Avenue, addressed Council and stated his comments regarding trash pick-up. Mr. Friedman expressed his concerns regarding the widening of County Road 403. Phil Hardway, 1435 Crystal Lake, addressed Council and stated a drainage system exist in Crystal Lake. Mr.- Hardway asked after the annexation would his neighbor be able to keep her pet pigs. He further asked for the scheduled fee for water. Deputy City Manager, Alan Mueller, stated the combined sewer and water bill would be approximately $22. COUNCIL/STAFF DISCUSSION Council and Staff gave a brief overview of the drainage for the South Corrigan Subdivision. Brief discussion ensued among Council and Staff regarding housing programs for the City of Pearland. Council addressed concerns regarding drainage and flooding issues. City Attorney, Darrin Coker, stated swine are prohibited in the City unless used for educational purposes and stated after the annexation the person owning the pet pigs or any animal prohibited in the City would need to register the animals as none conforming use and therefore are proved as pre-existing pets. Council briefly discussed the City taxes, fees, and water system.
