MINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY, OF
PEARLAND, TEXAS, HELD ON OCTOBER 29, 2002, AT 6:30 P.M., IN THE COUNCIL
CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS.
The meeting was called to order with the following present:

PURPOSE OF HEARING - PROPOSED ANNEXATION
To consider the proposed annexation of approximately 520 acres, consisting of all
of Brazoria County Municipal Utility District No. 1 and the adjacent portions of County
Road 91 and County Road 89, Brazoria County, Texas.
STAFF REVIEW OF PROPOSED SERVICE PLAN
City Manager, Bill Eisen, addressed Council and gave a brief summarization of the
overall discussions regarding the annexation process of Municipal Utility District No. 1.
Deputy City Manager, Alan Mueller, addressed Council and reported this is the second
of two public hearings. The first public hearing was held on October 22, 2002. This
annexation is proposed in conjunction with a Strategic Partnership Agreement. There
are two separate public hearings regarding the Strategic Partnership Agreement. The
first was held on October 23, 2002 and the second will be held on November 4, 2002.
Under the terms of State law regarding annexation and the Strategic Partnership
Agreement the effective date of the annexation will be December 31, 2006. Mr. Mueller
further stated the provision of the Strategic Partnership Agreement creates a date for
annexation. The operation of the Municipal Utility District will remain the same with an
additional charge of $4.38 per month collected on the utility bill. This charge will be used
to offset the City's costs in providing Fire and EMS Services to the Municipal Utility

District. A liaison committee will be available by the Municipal Utility District Board to
accommodate transition issues. He stated during the transition the utility fees will be
consistent with the City and the City will be allowed to collect sales tax on any taxable
items within the Municipal Utility District. Mr. Mueller further stated any remaining funds
in the Municipal. Utility District accounts during the time of annexation would be spent
within the boundaries of the Municipal Utility District. He noted that the Home Owners
Association would not be affected by the annexation or the Strategic Partnership
Agreement. Mr. Mueller stated that the Service Plan has an effective date of December
31, 2006. Mr. Mueller also noted the Service Plan provides a level of services for the
Municipal Utility District. The City may provide those services directly or may contract
other parties to provide those services. He noted that the term Standard Policy and
Procedures means that an application or fee for services may apply. He stated that
State Law does require two portions of the Service Plan, first section is an Early Action
Program and the second section is a Capitol Improvement Program. The services are
effective immediately upon the date of annexation. These services provide Police, Fire,
and EMS services. Solid waste collections will transition to collection under the City's
contract in accordance with State Law. Mr. Mueller stated that in regards to the
operation maintenance of water and waste facilities, the City would take the place of the
Municipal Utility District including any joint facilities. He stated the City would be
responsible for any maintenance and operation of any public streets including a Street
Lighting Bill. Mr. Mueller further stated there are no parks or swimming pools operated
by the Municipal Utility District. The pools will belong to the Home Owners Association.
He also stated the Police Department would be expanded in order to serve the area. Mr.
Mueller further reviewed the City services and gave a brief overview of the service plan.
CITIZEN COMMENTS
Scott Luster, Municipal Utility District No. 1, addressed Council and requested the ratio of
Law Enforcement Officers to Citizens in Municipal Utility District No. 1 and how many
officers would be added to the Police Department.
City Manager, Bill Eisen, responded and stated the current ratio of officers to citizens is
1.6 officers for every thousand residents and approximately eight officers would be
needed for Municipal Utility District No. 1.
Ron Anderson, 7730 Bailey Road, addressed Council and questioned how to stop the
annexation of Municipal Utility District No. 1.
City Manager, Bill Eisen, responded and stated attending the public hearings and
addressing Council is an opportunity to present a point of view.

Deputy City Manager, Alan Mueller, stated that the area Mr. Anderson currently resides
is not being annexed by the City of Pearland. He gave a brief description of the border
off Bailey Road and where the annexation point will end.
A brief discussion of the area ensued among Council and citizens.
Robin Anderson, 7730 Bailey Road, addressed Council and questioned are there any
future plans for annexation North of Bailey Road. She stated her concerns are the traffic
problems in that area.
A brief discussion of the road construction plans ensued among Council and citizens.
Loice Cottingham, Municipal Utility District No. 1 Director and resident, addressed
Council and stated her concerns regarding the expansion of the Volunteer Fire
Department.
City Manager, Bill Eisen, addressed Ms. Cottingham's concerns and stated there will be
some interim steps in the process of expanding the Fire Department.
A brief discussion of the Fire Department and EMS services ensued among Council and
Citizens..
COUNCIUSTAFF DISCUSSION
A discussion ensued among Council regarding the proposed annexation.
