2002-10-22 CITY COUNCIL PUBLIC HEARING MEETING MINUTES - 7:30PMMINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON OCTOBER 22, 2002, AT 7:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Tom Reid Councilmember Richard Tetens Councilmember Charles Viktorin Councilmember Larry Marcott Councilmember Klaus Seeger City Manager Bill Eisen City Attorney Darrin Coker City Secretary Young Lorfing Absent: Mayor Pro -Tem Woody Owens. Others in attendance: Deputy City Manager Alan Mueller; Police Chief, J.C. Doyle. PURPOSE OF HEARING - PROPOSED ANNEXATION To consider the proposed annexation of approximately 396 acres, consisting of all ,-� of Brazoria County Municipal Utility District No. 5 and the adjacent portions of County Road 403 and FM 865, Brazoria County, Texas. STAFF REVIEW OF PROPOSED SERVICE PLAN Deputy City Manager, Alan Muller, addressed Council and gave a brief description on the location of the proposed property to be annexed. He further reported this is the first of two public hearings. The second public hearing will be held on October 29, 2002. This annexation is proposed in conjunction with a Strategic Partnership Agreement. Two separate public hearings regarding the Strategic Partnership Agreement will take place, the first on October 23, 2002 and the second on November 5, 2002. Under the terms of State law regarding annexation and the Strategic Partnership Agreement the effective date of the annexation will be December 31, 2005. Mr. Mueller further stated the provision of the Strategic Partnership Agreement creates a date for annexation and it is beneficial to the Municipal Utility District and residents. The operation of the Municipal Utility District will remain the same with an additional charge of $4.38 per month collected on the utility bill. This charge will be used to offset the City's costs in providing Fire and EMS Services to the Municipal Utility District. The agreement does provide other services if requested by the Municipal Utility District Board. A liaison committee Page 1 of 3 - 10/22/2002 078 will be appointed by the Municipal Utility District Board to accommodate transition issues. He stated during the transition the utility fees will be consistent with the City and the City will be allowed to collect Sales Tax on any taxable items within the Municipal Utility District. Mr. Mueller further stated any remaining funds in the Municipal Utility District accounts during the time of annexation would be spent within the boundaries of the Municipal Utility District. He noted that the Home Owners Association would not be affected by the annexation or the Strategic Partnership Agreement. Mr. Mueller also noted there is a Service Plan for Municipal Utility District No. 5. There are two portions of the Service Plan, first section is an Early Action Program and the second section is a Capitol Improvement Program. Both of the services are effective immediately upon the date of annexation. These services provide Fire and EMS service. Mr. Mueller stated that in regards to the operation maintenance of water and waste facilities, the City would take the place of the Municipal Utility District including any joint facilities. He stated the City would be responsible for the hike and bike trail, and parks located in the Municipal Utility District. The pools will belong to the Home Owners Association. Mr. Mueller further reviewed the City services and gave a brief overview of the service plan. CITIZEN COMMENTS Richard Atchison, South Down Municipal Utility District No. 5, addressed Council and stated he applied for water and sewage with the City and he was not able to receive the services. He asked for an explanation regarding the payoff of Municipal Utility District No. 5. Patti Gray, South Down Municipal Utility District No. 5, addressed Council and expressed her concerns regarding the City's water utility billing service. Elaine Ybarra Coronet, South Down Municipal Utility District No. 5, addressed Council and expressed her concerns regarding taxes on Municipal Utility District No. 5. Helen Michael, President of Crystal Lake Property Owners Association, addressed Council and stated her questions and concerns regarding the operation and maintenance of the streets located at her residence. COUNCIUSTAFF DISCUSSION City Manager, Bill Eisen, stated that payoff for the Municipal Utility District No. 5 will be City services and gave a brief overview of the services. Mr. Eisen noted that there have been slight problems with the City's water utility billing services that have occurred in the past and those problems were addressed. Mr. Eisen gave Linda Grobmeier as a contact for any future problems. Mr. Eisen addressed the concern of the Municipal Utility District Page 2 of 3 - 10/22/2002 tax and City taxes. He stated the Municipal Utility District's tax would be discontinued once the annexation is complete and City taxes would be substituted. Mr. Eisen further stated that any privately owned streets will continue to be maintained by the Home Owners ;Association will not be affected by the annexation. Council briefly discussed the benefits of the proposed annexation in regards to the homeowners in Municipal Utility District No. 5.
