2002-10-22 CITY COUNCIL PUBLIC HEARING MEETING MINUTES - 6:30PMMINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON OCTOBER 22, 2002, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Tom Reid Councilmember Richard Tetens Councilmember Charles Viktorin Councilmember Larry Marcott Councilmember Klaus Seeger City Manager Bill Eisen City Attorney Darrin Coker City Secretary Young Lorfing Absent: Mayor Pro -Tem Woody Owens. Others in attendance: Deputy City Manager Alan Mueller. PURPOSE OF HEARING - PROPOSED ANNEXATION To consider the proposed annexation of approximately 520 acres, consisting of all of Brazoria County Municipal Utility District No. 1 and the adjacent portions of County Road 91 and County Road 89, Brazoria County, Texas. STAFF REVIEW OF PROPOSED SERVICE PLAN Deputy City Manager, Alan Mueller, addressed Council and gave a brief description on the location of the proposed property to be annexed. He further reported this is the first of two public hearings. The second public hearing will be held on October 29, 2002. This annexation is proposed in conjunction with a Strategic Partnership Agreement. Two separate public hearings regarding the Strategic Partnership Agreement will take place, the first on October 23, 2002 and the second on November 4, 2002. Under the terms of State law regarding annexation and the Strategic Partnership Agreements the effective date of the annexation will be December 31, 2006. Mr. Mueller further stated the provision of the Strategic Partnership Agreement creates a date for annexation and it is beneficial to the Municipal Utility District and residents. The operation of the Municipal Utility District will remain the same with an additional charge of $ 4.38 per month collected on the utility bill. This charge will be used to offset the City's costs in providing Fire and EMS Services to the Municipal Utility District. The agreement does provide other services if requested by the Municipal Utility District Board. A liaison committee Page 1 of 3 - 10/22/2002 071 will be appointed by the Municipal Utility District Board to accommodate transition issues. He stated during the transition the utility fees will be consistent with the City and the City will be allowed to collect Sales Tax on any taxable items within the Municipal Utility District. Mr. Mueller further stated any remaining funds in the Municipal Utility District accounts during the time of annexation will be spent within the boundaries of the Municipal Utility District. He noted that the Home Owners Association will not be affected by the annexation or the Strategic Partnership Agreement. He also noted that the term, Standard Policy and Procedures, means anything applicable by the City to a particular service. Under State Law there are two. portions of the Service Plan, first section is an Early Action Program and the second section is a Capitol Improvement Program. Both of the services are effective immediately upon the date of annexation. Mr. Mueller stated that in regards to the operation maintenance of water and waste facilities, the City will take the place of the Municipal Utility District. He stated the City will be responsible for all City services and gave a brief overview of the service plan. CITIZEN COMMENTS Robert Murray, 2503 Plantation Court, addressed Council and stated his concerns and questions regarding the annexation. He stated that he would like some consideration in regards to the citizens that will be affected by the proposed annexation. Chris Murray, 2503 Plantation Court, addressed Council and stated his concerns are the parks and swimming pools. He questioned whether or not there would be any fees for the parks and swimming pools. Mr. Murray also expressed his concerns regarding the Brazoria County Sheriffs Department. COUNCIL/STAFF DISCUSSION Deputy City Manager, Alan Mueller, stated the parks and swimming pools belong to the Home Owners Association and will not be affected by the proposed annexation. Councilmember Viktorin stated the tax rates will increase once the Municipal Utility District No.1 is annexed into the City, however, the citizens will gain representation by the City. Mr. Viktorin further stated Council is willing to take on the hard issues for the citizens.
