Council Member Klaus Seeger was absent. P & Z Commissioner Don Sederdahl was absent. I. CALL TO ORDER The Joint Public Hearing was called to order at 6:38p.m. H. PURPOSE OF HEARING Request for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Heavy Industrial District (M-2), on the following described property, to wit: Zone Change Application No. 1073 Legal Description: 11.64 acres, being a portion of Lot 178, Zychlinski Subdivision, Section 28, H.T.& B.R.R. Company Survey, Abstract 551, Brazoria County, Texas (4501 Dixie Farm Road) Owner: Jesse G. M. STAFF REPORT Executive Director of Community Services Tobin Maples gave a brief description of surrounding property, which is located in the southwest corner of Hwy. 35 and Dixie Farm Rd. Mr. Maples stated as of date there has been no letters in support or opposition of the request. Mr. Maples stated there is an existing metal building that has been occupied with out zoning approval. He stated he had some concerns with the uses of the drums outside of the facility. Mr. Maples stated that based off our Code Enforcement Officer's inspection, there appeared to be chemical's stored in them. He stated staff recommends approval of M-2 Heavy Industrial Zoning which is consistent with our long range plan, however based on the on site inspection we recommend tabling of this application until they legally occupy the property and the structure. He also stated if chemical blending or chemical storage is part of the proposed use, then they would need to revise their application for a specific use permit; which has not been advertised for. Mr. Maples stated that State Hwy. 35 and Dixie Farm are both considered major thoroughfares, adjacent to several industrial uses, however with chemical blending or chemical storage being proposed staff would probably rethink recommendation for approval based on the close proximity to schools and residential areas. Mr. Maples stated we have not had time to analyze that element, because it was just brought to our attention and was not disclosed on the zoning application. IV. APPLICANT PRESENTATION Jessie Zamarron, 4501 Dixie Farm Rd., stated this is not an operating business. Mr. Zamarron stated there have been problems, which have been brought to the cities attention. Lynn Corsey, 1`001 Tall Pine, stated he was told he would need a Specific Use permit to comply with all rules and regulations. He stated his business takes products that belong to other company's and they package the product. He stated they range from two ounce bottles to gallon size, and from there they resale to retail company's. He stated in most cases they receive the product ready to fill and place in packages. We sometimes have to blend, and the process is always done properly and safely. Mr. Corsey stated we mix water based products such as soaps, spot remover, safe acid products. He stated he has Page 2 of 17 142 C prepared a letter written to elay some fears regarding the blending of chemicals. V. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST Steve Robinson, 2601 Sleepy Hollow, stated he would like to protest the tabling. Mr. Robinson stated the applicant gave fair notice, and anything that should delay the zoning would not be fare. He stated any objections should have been brought up earlier. Mr. Robinson stated if Mr. Zamarron should have to move this operation it would be unfair to future employees and the owners. Rudolph Rezeneck, President MR Service & Supply stated he has no objection to proposed zoning as long as safety is implemented. VI. COUNCHJPLANNING COMMISSION/STAFF/APPLICANT DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Council Member Larry Marcott asked has this building been vacant for the last six months or more. Mr. Zamarron replied yes. Mr. Marcott stated you must apply for zoning and be approved before you can open a business. He commented the recommendation from Mr. Maples to table this zone change is in order. Tobin Maples stated that if you look in your packets at the application, under current use of land, it states "Industrial Use". He stated that what we advertise is what we are given on the application. He stated that if we had known chemical blending was part of this business we would have requested a Specific Use Permit. P & Z Commissioner Sheryl Greiner asked if there was only one tenant. Mr. Zamarron replied yes. Mr. Zamarron stated that once we are zoned we plan to establish more property and build another building. P & Z Commissioner Ruby Sandars asked if all of this plans to be on one site. Mr. Zamarron replied yes and there is approximately 11.64 acres. Commissioner Sheryl Greiner asked what is the rational for "M2" zoning verses "M1" zoning. Mr. Zamarron replied he planned on obtaining the maximum usage he could have, and did not realize there were supplements. Mr. Marcott stated he has moved in and has not been authorized. PURPOSE OF HEARING Request for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Commercial District (C), on the following described property, to wit: Zone Change Application No. 1074 Legal Description: 0.590 acres, Lot 5, Block 12, West Lea Subdivision, Abstract 546, H.T. & B.R.R. Company Survey (Manvel Road (FM 1128) north of Bailey Road) Owner: Erasmo Medina 4614 Arnold Pearland, Texas 77584 Agent: Thomas Hayes 2245 N. STAFF REPORT Executive Director of Community Services Tobin Maples showed slides and gave a brief description of the surrounding properties. He stated the existing property is to the east side of Manvel Rd and north of Bailey Rd. The Comprehensive Plan shows low density Residential, therefore the requested zoning is not consistent with the master plan. Mr. Maples stated that to date we have received well over fifty letters in opposition. He stated if there are more than 20% in opposition, it would require a super majority vote. Page 4 of 17 142 E B. APPLICANT PRESENTATION Erasmo Medina, 4614 Arnold, owner, stated he plans to put a used car lot at the proposed property. IV. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST Glen Jones, 3933 Manvel Rd, stated he has recently built a new home next door to this particular property. Mr. Jones stated he has spent a considerable amount of money and does not want to see the value of his home and property decrease. He also stated there are deed restrictions for West Lea subdivision. Darrin Coker, City Attorney, stated the City has the right to zone property in subdivisions that have deed restrictions, but it is up to the Home Owners Association to enforce their deed restrictions. Bill Boley, 3714 Wingtail, stated he is against the zone change. Mr. Boley stated he has lived in West Lea since 1984, and moved there because it had deed restrictions. He stated we already have traffic problems, and this would cause more. Martha Sumack, 3649 Wingtail Way, stated that on the plat of West Lea Subdivision Sections 1, 2, and 3, it previously had a commercial reserve, in 1979 the developer changed it to a residential reserve. Ken Coluth, 3934 Skylark Way, stated we own the lot south of this property, and we sold the lot to the north, which is in the process of building a home. Mr. Coluth stated we are both against the zoning, everything in the area is zoned Rl, there is no commercial property from Mary's Creek down to F.M. 1128. Daryl Bear, 4005 Manvel Rd stated he has three lots which back up to this particular lot. Mr. Bear stated he is afraid this business would cause a wreck on this particular street and we do not need this problem. Selia Hernandez, 4002 Skylark, stated he would like to see a safer environment. Mr. Hernandex stated this property has always had high weeds, sanitation, and rodent problems. He stated if this property is zoned commercial, the next thing we know we will have bars or a liquor store coming in. Page 5 of 17 142 F Jeffery Childers, 3942 Skylark Way, stated he lives their because it is a residential area, we do not need this hodge podge. Charles Ingram, 3850 Meadowlark Way, stated that FM 1128 and CR101 are going to be very busy, we do not need anymore traffic. Jim Baglen, 4002 Wingtail Way, stated that he agrees with all the comments. Thomas Haze, Attorney for Erazmo Medina, stated he was approached by an individual to change the zoning of his property. Mr. Haze stated he respects everything that he has heard, however the basis of our nation is freedom. If we are not free to use our own property, then are so called rights are window dressing. Mr. Haze stated he is asking the government to allow Mr. Medina to do what he wishes with his own property. V. Mr. Maples stated that staff has�net with the developer, and a parking lot would be acceptable under Commercial zoning. Mr. Maples stated staff is recommending approval. B. APPLICANT PRESENTATION Jay Javadi, representative for Donja, stated he will be using the land for more public parking. IV. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST None V. COUNCIL/PLANNING COMMISSION/STAFF/APPLICANT DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Mayor, Tom Reid stated the location of the parking lot would be available for the public to use for the library and other facilities. Council Member Charles Viktorin stated he could not remember there being R-4 zoning. Executive Director of Community Services Tobin Maples stated everything south is R-4. Darrin Coker City Attorney stated the developer purchased the land from the City through the public bid process and the property can only be used for parking. P & Z Commissioner Ruby Sandars stated the library is in R-4 property. Mr. Maples stated that public facilities are allowed in R-4 zoning. Page 7 of 17 142 H VI. Mr. Maples stated this property is owned by the City of Pearland, but utilized by the Pearland Neighborhood Center. COUNCIL/PLANNING COMMISSION/STAFF/APPLICANT DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Mayor Tom Reid stated, that with the upcoming season, this is for the storage of Christmas gifts and food for needy families. He stated he thought this was a great contribution to our Community. City Council Member Larry Marcott stated is this a one time deal. Mr. Maples replied he believes it is seasonal. Mr. Marcott stated that he would like to see that in the specific use permit that it is seasonal if they are going to proceed on this basis, so they would not have to come back each year. VI. Mr. Maples stated the property is located in the southwest corner of Shadow Creek Parkway and Hwy. 288. He stated staff is recommending approval consistent with uses in PUD and other zoning cases we have approved. B. APPLICANT PRESENTATION Gary Cook, 2947 Broadway, stated when they aquired this property it was in MUD 5, not in the city limits. Mr. Cook stated we have had to deannex this property from MUD 5 and be reannexed by the City. He stated we are in escrow with the user for a total of 48 acres, which we plan to use for hospital and medical offices. IV. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST None V. COUNCIL/PLANNING COMMISSION/STAFF/APPLICANT DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Richard Tetans Council Member asked how he is going to access this particular property. Gary Cook replied Shadow Creek Parkway is parallel with property line, access will be south of the property. Mr. Cook added the medical center will abutt a pipeline, which will be relocated. Mr. Cook also stated we will be bringing in the TIA after the holidays to address these issues. Council Member Charles Viktorin asked if this is part of the "Office Professional', near the northwest corner of Hwy. 288 and 518. Gary Cook stated this is something completely different. P & Z Commissioner Sheryl Greiner stated the application is blank, is the proposed property is truly for Professional Services. Gary Cook stated it is medical and medical Page 10 of 17 142 K office buildings. Mrs. Greiner stated medical emergency center, Gary Cook replied the people who intend on aquiring the site plan to build a hospital and medical office buildings. He added in order to build a two family duplex the city requires them to have a specific use permit. The comprehensive plan recommends Village District, which there is not a village district zoning category in our zoning ordinance. Staff is --' recommending approval. B. APPLICANT PRESENTATION None IV. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST Brenda Griggs, 2105 N. Grand Blvd, stated their property has been in their family since 1894, she added we are concerned about parking and burglary. Ms. Griggs stated there had been no flooding until a few years ago. Ms. Griggs stated if the specific use zoning is approved, she would like be assured it would not flood her property. She stated Alita Hawkins who was unable to attend is in opposition. Alma Nolan, 2106 N. Galveston, stated she was concerned about the proposed drainage and sewer lines. Wanda Nichols, 3603 E. Orange, stated she stated agrees with them, they do not need anymore building over there. Kenneth Carter, 3607 E. Orange, asked if they are going to have a two family dwelling. Mr. Carter stated it is not worded right on the application. Mayor Tom Reid stated he did not believe it invalidates what we are doing. City Attorney Darrin Coker stated we will verify that information before proceeding. Carlos Saenz, 5921 Saywer, representative for Tommy Dawson, stated the proposal is to build two duplexes, 1200 square feet per unit. Mr. Saenz stated we will build in compliance with the City of Pearland's building and drainage requirements. V. COUNCIL/PLANNING COMMISSION/STAFF/APPLICANT DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Council Member Richard Tetans, asked what is the specific use for, as we have nothing that is "specific" about this. Mr. Tetans stated he cannot act on a specific use if he does not have enough information. He added the entire area surrounding the property is zoned Suburban Development. Mr. Maples stated staff is recommending approval based off the consistency of Comprehensive Plan and surrounding areas. B. APPLICANT PRESENTATION Page 13 of 17 142 N Thanh Dac Nguyen, Houston, Texas, stated they intend to build a home. We do not have a lot of experience on how to buy land. IV. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST None V. COUNCIL/PLANNING COMMISSION/STAFF/APPLICANT DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Mayor Tom Reid stated could we possibly meet with this applicant and explain this a little more thorough. Mr. Maples stated this is staff's best attempt to explain to the applicants they did not meet the requirements for R -E zoning, therefore the next best is R-1 zoning. Mr. Maples stated once they receive there zoning, we can walk them through the construction process. Council Member Larry Marcott stated from what he heard there is a pipeline easement between the two lots and he wants to know if he can build over them. Mr. Maples replied if there is a pipeline easement then no, they could not build over that. VI. ADJOURNMENT The Joint Public Hearing adjourned at 8:20 p.m. SPECIFIC USE APPLICATION NO 119 I. Mr. Maples stated the property is located on Max Rd, with an existing business. He added that the applicant is requesting the specific use permit in order to build the accessory use associated with the residential use on the property. Mr. Maples stated it has an existing business. B. APPLICANT PRESENTATION Jan Sutter, 1833 Max Rd, stated we are trying to build a place to store our tractors and lawnmowers. IV. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST BillBottles, 3714 Wingtail, stated I do not live near the Sutters, however I know them personally, and I feel they do need this. V. COUNCIL/PLANNING COMMISSION/STAFF/APPLICANT DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Council Member Richard Tetans stated he would like to see the size of the building and where it would be built on the property. Council Member Larry Marcott, asked if there would be a concrete floor and a metal building. Ms. Sutter replied yes there would be a concrete floor and a metal building. Executive Director of Community Services Tobin Maples stated that on a specific use permit they are only allowed 30% for accessory usage and this percentage is based off the square footage of the living area. A. STAFF REPORT Executive Director of Community Services Tobin Maples gave a brief description of the property. Mr. Maples stated the applicant has to rezone property in order to build a garage. Mr. Maples added they have to establish zoning before they can build the garage. He also stated to date there has been noone in support or opposition. COUNCIL/PLANNING COMMISSION/STAFF/APPLICANT DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Council Member Larry Marcott stated they have a public comment form from Mr. Burrell stating they are constructing a building. Mr. Maples stated yes, we were notified there was a structure being built without a permit and he was issued a stop work citation and requested to apply for zoning before any further construction. Mr. Marcott also stated there is another comment form that indicates he is body repairman, and that they expect him to run a business.
