2002-02-11 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTESMINUTES OF A JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON FEBRUARY 11, 2002, IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS I. P&Z Vice -Chairman Donald Glenn was absent. SPECIFIC USE APPLICATION NO. 100 I. CALL TO ORDER The Joint Public Hearing was called to order at 6:34 p.m. II. PURPOSE OF HEARING Request for an amendment to the Land Use and Urban Development Ordinance of said City from classification Commercial District (C) to Commercial District - Specific Use (C(S)) for storage and mini -warehouse, on the following described property, to wit: Specific Use Application No. 100 Legal Description: 4.69 acres, being Lot 7A, the South % of Lot 7, Allison Richey Gulf Coast Home Co. Subdivision of Suburban Gardens, Section 19, H. T. & B. R.R. Co. survey, A-243, as recorded in Vol. 1099, pg 669, deed records of Brazoria Co., TX (2109 Cullen Boulevard) Owner: Classic Storage Station, Inc. Page 1 of 6 — 02/11/02 8909 Hughes Ranch Road Pearland, TX 77584 P&Z Chairman Charles Viktorin read the purpose of the hearing into record. Executive Director of Community Services Tobin Maples gave a brief PowerPoint presentation giving the location of the proposed zone changes by showing slides of the property and he gave a brief description of the surrounding properties. Mr. Maples explained that the Specific Use is for mini -warehouses. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Karen Craig, 2602 Sleepy Hollow, Pearland, TX 77581 thanked City Council for allowing them to bring this request forward. She explained that there business at a full status and they need to move forward. Mrs. Craig stated that open storage is not an issue and the warehouses will be climate controlled. Pat Pounds, 8518 Hawk Rd, Pearland, TX stated that she has no objection to the request and she is also speaking on behalf of Mr. Pounds, and Mr. and Mrs. Green who are also in favor of the request. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Emma Vaughn, 2005 Cullen Blvd, Pearland, TX stated that she probably should have spoken in support of the request, however she would like to cover some objections. She stated that first of all she wants to clarify that they have agreed to cover storage, secondly she clarified that they currently have six big -yellow trucks in which 2 of them are on Cullen for advertising purposes, and last she wanted to make sure that the city ordinance regarding building lines and masonry would be observed. Mrs. Vaughn pleaded that there be no care sales on the lot. She stated that she is also speaking for Mr. Vaughn, and her daughter and son-in-law and she wishes the Craig's all the success in the world. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Council Member Seeger asked if the wording of the Specific Use Permit should read "inside storage only" and he verified that there would not be any outside storage. City Attorney Darrin Coker stated that the outside storage would have to be prohibited in the Specific Use Permit Executive Director of Community Development Tobin Maples pointed out that the owner doesn't actually need a "Specific Use Permit" auto sales is allowed today in the "Commercial" zoning that currently exists. Mr. Maples also pointed out that the owner is requesting a specific use permit for mini -warehouses and that is the single issue right now. Council Member Owens asked if there is going to be any outside storage and Karen Craig of Classic Storage replied that there will be no outside storage. Page 2 of 6 — 02/11/02 VI. PURPOSE OF HEARING Request for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Single Family Dwelling District (R-1) on the following described property, to wit: Zone Change Application No. 1021 Legal Description: .76 acres of land situated in a 10 acre tract of land in the South V2 of the Northeast V4 of the Southeast % of the G.C. Smith Survey, Section 16, A-546, Brazoria Co., TX (6033 Sharondale) Owner: Hector L. & Elvia M. Guerrero 3413 Glastonbury Drive Pearland, TX 77581 Zone Change Application No. 1022 Legal Description: Lot 11, out of Lot 20, Allison Richey Gulf Coast Homes Subdivision, Section 9, H. T. & B. R.R. Co. survey, A-234, Brazoria Co., TX (7205 Cliff Stone Road) Owner: Kevin T. Morton 7205 W. Cliff Stone Road Pearland, TX 77581 P&Z Chairman Charles Viktorin read the purpose of the hearing into record. Executive Director of Community Services Tobin Maples gave a brief PowerPoint presentation giving the location of the proposed zone changes by showing slides of the property and he gave a brief description of the surrounding properties. Mr. Maples explained that the first application is for a development of a single family home and the second application listed is approximately two acres that is being zoned for Single Family Dwelling R-1 in order to bring in future residential uses. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Council Member Marcott stated that both of these applications are for R-1 and there are some applications around these for R-1 on the City Council agenda for this evening, and he asked if there is anyway to actually zone them all at once. City Attorney Darrin Coker stated that they could take a city initiative to zone them. Council Member Seeger agreed that it would be a good idea, however he realizes that there would have to be a lot more effort put into it from the city's staff. City Attorney Darrin Coker explained that they have to use caution when zoning as a group and he referred to "down -zoning" properties. VI. ADJOURNMENT The Joint Public Hearing adjourned at 7:00 p.m. ZONING APPLICATION NOS. 1019 & 1023 I. CALL TO ORDER The Joint Public Hearing was called to order at 7:01 p.m. II. PURPOSE OF HEARING Request for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Estate Lot Single Family Dwelling District (R -E) on the following described property, to wit: Zone Change Application No. 1019 Legal Description: 2.2488 acres, out of and being part of a 60.13 acre tract, Allison Richey, Allison Richey Gulf Coast Home Co.'s Suburban Gardens, H. T. & B. R.R. Co. survey, Section 10, A-505, Brazoria Co., TX (Brookside Road) Owner: Tong & Truc Quan Bach Vo 314 N. Box 1734 Pearland, TX 77588 P&Z Chairman Charles Viktorin read the purpose of the hearing into record. Executive Director of Community Services Tobin Maples gave a brief PowerPoint presentation giving the location of the proposed zone changes by showing slides of the property and he gave a brief description of the surrounding properties. Mr. Maples stated that staff is recommending approval of both requests. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Walter Pasciak, 7705 Broadway, Pearland, TX 77584 stated that the notifications are still going to the wrong addresses. He stated that he has checked with the Voter Registration Office and with the Tax office about the address situation and he thinks the problem is with City Hall. He also stated that he can't even get a large enough cage to capture a large dog and has been on a list of Animal Control's for some time now. Mr. Pasciak stated that the slides shown are all wrong and he asked when the pictures were taken why there wasn't one taken of the trailer that exists next door. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST NONE V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Mn Tobin Maples, Executive Director of Community Services Council Member Marcott stated that he would like it to be noted that these are the types of zoning City Council likes to see. Mayor Reid commented that this zoning classification and R-1 are the crowned jewels for the City. Council Member Marcott asked when the zone change signs were going to be put out and Executive Director of Community Services Tobin Maples stated that they are out right now and he stated that the signs are 36" X 40" and they are white with blue writing. Mr. Maples also explained that staff is required by law to notify the residents listed from the Brazoria County Appraisal District's tax rolls. Page 5 of 6 — 02/11/02 VI.
