I. CALL TO ORDER
The Joint Public Hearing was called to order at 6:51 p.m.
II. PURPOSE OF HEARING
Proposed amendments to the Land Use and Urban Development Ordinance (509-
G), Section 16.4.2., Outdoor Activities and Uses; Section 22.6., Building Facades;
and Table III, Schedule of Uses
Executive Director of Community Services Tobin Maples gave a brief explanation for the
following proposed amendments:
1. Section 16.4.2, Outdoor Activities and Uses

Mr. Maples explained that the proposed amendment for this section would require
City Council approval of a Specific Use Permit, which would eliminate the
allowance for outside storage in "Commercial" zoning.
2. Section 22.6, Building Facades:
Mr. Maples explained that the first proposed amendment for this section is to
change the occupant regulations to allow the occupant of a structure to change
without complying with the fagade regulations as long as the nonconforming use
of the structure has not been abandoned. Mr. Maples explained that the second
proposed amendment is to add a paragraph (Paragraph "E"), which would allow
for the use of insulated rock coated metal panel as long as the structure is in
"Commercial" zoning and not along a thoroughfare.
3. Table III, Schedule of Uses:
Mr. Maples explained —
that the proposed amendment for this section would require City Council approval
of a Specific Use Permit for any nonresidential use that would like to utilize
residentially zoned property for incidental off-street parking uses.
III. PERSONS WISHING TO SPEAK
Jan Briggs, Rojean Realty, stated that she has a potential buyer who would like to
purchase this property on Roy Road, address 2533 Roy and 2537 Roy. She explained
that they were in negotiations to get it zoned "Commercial" with outside storage
involved, and they were informed that there was a hold put on any outside storage. Mrs.
Briggs asked what the City's interests are and how long will this hold last.
IV. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION
Mr. Tobin Maples, Manager of Administrative Support
Mike Chance, Executive Director of PEDC, stated that he had a few items to address. He
stated that first of all, the outdoor storage amendment is going to really effect real estates
sales and when you put it into a "Specific Use" permit only it puts an "unknown" factor
on the property. He went on to explain that business growth could be hurt. He stated that
"Commercial" zoning is a pretty heavy zoning and they have more and more big box
operations headed their way. Mr. Chance briefly explained that secondly, the proposed
amendment regarding the fa;;ade ordinance could really help out business growth.
Council Member Tetens explained that the whole reasoning for starting the moratorium
was to prevent having so much "Commercial" area next to "Residential" area. Mr.
Tetens stated that they adding the "Specific Use" requirement to help monitor the
allowance for outside storage next to residential area.

Mayor Reid asked if there was a way to require a "Specific Use Permit" only for areas
that are adjacent to Residential lots.
Executive Director of Community Services Tobin Maples pointed out that you could say
whatever you want in the ordinance and reminded them that the Schedule of Uses would
also have to be addressed.
Council Member Marcott asked if this hearing should be tabled.
Council Member Tetens stated that this moratorium was not created to hold people up.
Deputy City Manager Alan Mueller pointed out that the same theory should apply for
"M-1" and "M-2" zoning also, and that ordinance would also need to be changed.
Mike Chance, Executive Director of PEDC, brought up Texas Honing, which backs up to
residential, and City Attorney Darrin Coker explained that the new ordinance would only
affect any new development.
P&Z Commissioner Selemon asked what was wrong with leaving the outside storage
only allowable in a "Specific Use" Permit.
City Attorney Damn Coker pointed out that the only disadvantage is that the City is
taking away from the "established criteria" and will have to make a decision on a case-
by-case basis. He stated that the City does need to come up with a way to prevent any
possible arbitrary.
Mr. Mueller suggested adding, "...is prohibited to adjacent residential except by Specific
Use Permit."
City Attorney Darrin Coker pointed out that a separate Joint Public Hearing would have
to be held for any changes regarding the outside storage under "M-1" or "M-2" due to the
fact that only "Commercial" was advertised.
Council Member Owens stated that he feels that they should work with the masonry
requirements a little bit further.
V. ADJOURNMENT

PROPOSED AMENDMENT TO THE THOROUGHFARE PLAN
I. CALL TO ORDER
The Joint Public Hearing was called to order at 7:36 p.m.

II. PURPOSE OF HEARING
Proposed amendments to the Thoroughfare Plan (Figure 7.2), County Road 94,
Kirby Road, Hughes Ranch Road, Cliff Stone, Stratford, Unnamed Minor
Collectors (East of Veterans, West of railroad, South of Magnolia and North of
County Road 101), and Unnamed Minor Collector (North of FM 518 between
Pearland Parkway and Country Club — behind Lowe's), of the City of Pearland
Comprehensive Plan Ordinance
Executive Director of Administrative Support Tobin Maples gave a brief explanation of
the following amendments:
1. County Road 94:
Mr. Maples explained that Figure 7.2 (Thoroughfare Plan) has been revised to
indicate an 80' right-of-way width for the remaining portion in between the 500'
north intersection at FM 518/CR 94 and the 500' south intersection at CR
94/Hughes Ranch Road.
2. Kirby Road:
Mr. Maples explained that this amendment is to reclassify the section of Kirby
that lies between CR 92 and CR 59 from a Major Thoroughfare, which consists of
a 120' right-of-way to a Secondary Thoroughfare, which consists of 100' right-of-
way. He explained that this amendment is requested to make this particular
section of Kirby Rd consistent with the existing sections of Kirby, as well as the
future sections of Kirby Dr.
3. Hughes Ranch/Cliff Stone:
Mr. Maples explained that the first amendment is to realign the eastern extension
of Hughes Ranch Road, which is located between Stone and Max, to the north.
He explained the second amendment is to reclassify Hughes Ranch Road between
Stone and Cullen from a major collector that consists of an 80' right-of-way to a
minor collector with a 60' right-of-way to provide consistency with the amended
eastern half of Hughes Ranch Road.
4. Stratford:
Mr. Maples explained that this amendment is to extend Stratford east to the
Pearland Parkway in order to provide another point of access to the adjoining land
and to help relieve congestion for FM 518.
5. Unnamed Minor Collector — behind Lowe's.

Mr. Maples explained that this amendment is providing a new Minor Collector
between Country Club Dr and Pearland Parkway per the recommendation of the
City of Pearland Traffic Consultant.
6. Unnamed Minor Collector in the Veterans Area
Mr. Maples explained that this amendment is to eliminate the network of Major
Collectors that were originally recommended with the basis that the area would
develop as Industrial. He explained that the roads would not be necessary for
residential uses.
III. PERSONS WISHING TO SPEAK
Richard Smikle, 7030 Cliffstone Road, Pearland, TX 77581 asked what is the likely
effect for traffic on his road with this amendment.
John Gehring, 1241 Stone Road, Pearland, TX 77581 stated that Hughes Ranch Road
already has a really dangerous curve turning onto Cliffstone Road and if any road is
eliminated they need to work on widening the road.
Juanita Sutherland, 2458 Country Club Dr, Pearland, TX 77581, stated that she owns
property on Stone Road and Cliffstone Road was named after her father. She asked that
the road name not be changed and she pointed out that there are 17 homes with Cliffstone
addresses.
IV. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION
Mr. Tobin Maples, Manager of Administrative Support
Deputy City Manager Alan Mueller explained that regarding the Cliffstone Road issue,
he referred to the rectangular boundary around the 40 -acres, and pointed out that if they
leave the road the way it is then the park area would have four sides around it. He stated
that either way the road goes is fine.
Council Member Seeger asked if this study was done by a consultant company that looks
at the whole city or just these particular areas, and Mr. Mueller explained that a company
by the name of TDAI, the city's traffic engineer drew up the reports.
Mayor Reid stated that the Stratford Road amendment was a good recommendation.
Council Member Owens asked what is to gain by extending Stratford and he pointed out
that you would only be off of FM 518 for about a 100 yards and Mr. Mueller responded
that the road would get them to FM 518 at a signalized intersection.

Discussion ensued among staff and City Council about whether or not there is adequate
space behind LOWE'S for a collector street and Mr. Mueller verified that staff does have
a detailed plan that shows there is enough space.
Council Member Owens stated that he has a problem with the first, second, and third
amendment and pointed out that they are downsizing the roads and one major problem
they have right now is that the roads aren't wide enough. He stated that he does not want
to "skinny down" the roads just to have the taxpayers have to pay to re -widen the roads.

PROPOSED AMENDMENTS TO THE LAND USE PLAN (VETERANS AREA)
I. CALL TO ORDER
The Joint Public Hearing was called to order at 8:04 p.m.
II. PURPOSE OF HEARING
Proposed amendments to the Land Use Plan (Figure 5.1), Veterans Road area (East
of Veterans, West of railroad, South of Magnolia and North of County Road 101), of
the City of Pearland Comprehensive Plan Ordinance
Executive Director of Community Services Tobin Maples briefly explained that the
character of the area is slowly changing. He stated that last year property was changed
from M-1 to R-2, three other requests for "R-2" have been brought forward, and there is a
new school. He stated that staff is recommending approval.
III. PERSONS WISHING TO SPEAK
Mark Dumoig, CR 128, Angleton, TX, stated that he is in the real estate industry and it is
very obvious that the character is changing. He stated that the City does need to take into
consideration that the whole area needs to be "R-2".
Bobby Thompson, 3301 Dixie Farm Rd, Pearland, TX stated that it has been his
observation that there is very little interest from an industrial standpoint on any of the
properties he has listed. He stated that this request does make since and he thinks it is a
good idea.
IV. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION

Mayor Reid stated that he did vote in favor of the R-2 zoning, therefore he helped start
the "snowball' effect that has happened in the area. Mr. Reid also pointed out that the
Foreign Trade Zone would have to be replaced.
Mike Chance, Executive Director of PEDC, stated that he has sat through all the meetings
and he has given up on the land being Industrial with the exception of one piece of land,
which is the Coppinger tract, which is deep along the railroad.
Deputy City Manager Mueller asked how deep, and Mr. Bobby Thompson replied
approximately 33 acres.
Council Member Tetens stated that piece would require access from Magnolia. Mr.
Tetens stated that he thinks it is a poor plan to residential along the railroad.
Council Member Seeger stated that he supports the request.
Discussion ensued regarding having Industrial zoning near a residential area.
Mr. Chance stated that over the last three years they have pulled back on more then one
prospect and while the community is growing he is learning what they want.
Discussion ensued between Mike Chance and City Council regarding the need for other
Industrial areas in the city.
City Attorney Darrin Coker pointed out that this is not a zoning application and if the
recommendation from Planning & Zoning is for denial, City Council does not need a
super -majority vote for approval.
