2001-11-19 CITY COUNCIL PUBLIC HEARING MEETING MINUTES - 6:30PMMINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, TO BE HELD ON NOVEMBER 19, 2001, AT 6:30 P.M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. PURPOSE OF HEARING - DISANNEXATION OF A TRACT OF LAND CONTAINING r— 10.1418 ACRES OF LAND BEING LOT 9 OF THE ALLISON-RICHEY GULF COAST HOME COMPANY SUBDIVISION OF THE H.T. & B.R.R. COMPANY SURVEY NO. 85, ABSTRACT NO. 304 BRAZORIA COUNTY, TEXAS. Mr. Darrin Coker, City Attorney. STAFF REVIEW City Manager, Bill Eisen, stated this is a request for disannexation of a 10 -acre tract of land which is part of the Super Wal-Mart site located near State Highway 288. This 10 -acre tract is a portion of the overall tract. This 10 acres is located near the rear of the tract and the owner is asking for disannexation so as not to end up building partly inside city limits and partly outside city limits. This property is located within Municipal Utility District No. 6. Council and the MUD No. 6 Board of Directors previously approved a contract whereby City sales tax can be levied in Municipal Utility District No. 6 regardless of whether this particular piece of property is located fully in, partially in or completely outside city limits. CITIZEN COMMENTS George Weatherall, 14119 River Forest, addressed Council and stated he represents the development that will be adjacent to the Wal-Mart. There is a need to disannex this property because it straddles the boundary between the City of Pearland and Municipal Utility District No. 6. In order to get utilities to this property it must either be completely in Page 1 of 2 - 11/19/2001 Pearland or completely in MUD No. 6. For this reason, the owners are requesting disannexation. He stated that individuals with Wal-Mart, who are involved with the design of the store, have met with Silverlake officials and invited comments from them regarding the appearance of this store. He further stated this will not be a run-of-the-mill Wal-Mart Supercenter and will look a little nicer than the typical Super Wal-Mart. He is specifically involved with the balance of the property on the west side of County Road 94, which is adjacent, and has agreed to not only abide by the development guidelines of Silverlake, with some modifications, but to also become members of the Home Owners Association so there is some consistency when headed east on FM 518 between the two properties. These were conditions that Municipal Utility District No. 6 and the City of Pearland asked to be imposed for this disannexation. COUNCIL/STAFF DISCUSSION City Attorney, Darrin Coker, stated once the property is disannexed, Municipal Utility District No. 6 will petition the City for consent to the annexation into MUD No. 6. Everything south of this property is already annexed into MUD No. 6. Mayor Pro -Tem Marcott asked if Wal-Mart pulled out and decided not to come would the City have just given up 10 acres. City Manager, Bill Eisen, stated the City would probably end up with less sales tax generated if Wal-Mart chose not to come. On the property tax side, it is hard to tell what the City would be giving up since it is not known what portion of the building would be in the city limits.
