An Ordinance of the City Council of the City of Pearland, Texas, authorizing
the use of Texas C.A.R.E.S. Act funding, as part ort of the Pearland COVID-19
Community Impact Recovery Plan ("Pian"), to provide additional
compensation to certain employees involved in response and mitigation
efforts related to the COVID-19 public health emergency; containing a savings
clause, a severability clause; a repealer clause; and an emergency provision.
WHEREAS, the Texas C.A.R.E.S. Act creates limited opportunities for governmental
entities to provide additional compensation to certain employees involved in response and
mitigation efforts related to the COVID-19 public health emergency; and
WHEREAS, on June 22,2020, the City Council approved the Pian which authorizes
unbudgeted outlays for expenditures dedicated towards the continuity of operations, public
safety and emergency medical services provided during the public health emergency,
including assignment/hazard pay in the form of a one-time stipend; and
WHEREAS, in orderto determine employee qualifications forthe hazard pay stipend,
City employee positions have been evaluated based on their non -discretionary exposure to
risks, contributions to public safety and continuity of operations; and
WHEREAS, employment positions for civil service ("Classified") and non -civil service
(Non -Classified") employees have been assigned a Tier classification based on the risk
exposure of the employment position; now, therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1,. That the City Council hereby authorizes expenditures of Texas C.A.R.E.S.
Act funding, in the estimated amount of $575,000.00, as part ort of the Pearland COVID-19
Community Impact Recovery Plan ("Plan"), to provide additional compensation to certain
employees involved in response and mitigation efforts related to the COVID-19 public health
emergency as provided herein.

Section 2. City employee positions have been evaluated based on their non -
discretionary exposure to risks, contributions to public safety and continuity of operations
and assigned to a Tier Classification in accordance with Exhibit "A" attached hereto,
Section 3, That Non -Classified employees shall be paid a one-time stipend
payment based on the employment Tier Classification for their employment position and in
accordance with Exhibit "B" attached hereto.
Section 4. That Classified employees shall be paid a one-time stipend payment
based on the qualification and payment criteria specified in Exhibit "C" attached hereto.
Section S. Savings. All rights and remedies which have accrued in favor of the City
under this Chapter a nd amendments thereto sha II be and are preserved for the benefit of the
City.
Section 6. Severability. If any section, subsection, sentence, clause, phrase or
portion of this Ordinance is for any reason held invalid, unconstitutional or otherwise
unenforceable by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct, and independent provision and such holding shall not affectthe validity of
the remaining portions thereof.
Section 7. Repealer_ All ordinances and parts of ordinances in conflict herewith are
hereby repealed but only to the extent of such conflict.
Section 8, Declaration of Emergency. The Council finds and determines that vehicle
speed inures to the benefit of the traveling public and, therefore, bears directly upon the
health, safety and welfare of the citizenry; and that this ordinance shall be adopted as an
emergency measure, and that the rule requiring this ordinance to be read on two (2) separate
occasions be, and the same is hereby waived.
Section 9. Effective Date, The Ordinance shall then become immediately effective
after its passage on its first and only reading.

NON -CLASSIFIED EMPLOYEE RISK LEVEL TIER EVALUATION
Tier -1: Full-time with continuous utilization throughout response and recovery
regardless of facility status.
Tier -2: Part-time with continuous utilization throughout response and recovery
regardless of facility status.
Tier -3: Full-time with limited utilization due to facility closure for a portion of the
incident.
Tier -4: Part-time with limited utilization due to facility closure for a portion of the
incident,

EXHIBIT C
CLASSIFIED EMPLOYEE_ QUALIFICATION CRITERIA
Local Government Code Chapter 143 requires the passage of an ordinance to compensate
Civil Service employees within the Police Department. In addition, assignment pay can only
be earned for meeting the criteria contained in the ordinance and for work performed
following the passage of the ordinance. The qualifying criteria for Ordinance 1597 are as
follows:
• Classified employees must hold the position of Police
Cadet, Police Officer, Sergeant, or Lieutenant; and
• Classified employees must work regular duty
assignment between September 15, 2020 and October
31, 2020; and
Classified employees must work an assignment which
normally requires interaction with the public where
there may be a risk of exposure to COVID-19
Assinment Pay Stipend Amount
Classified employees that meet the qualifying criteria are categorized as Tier -1 employees
and shall receive the $900 stipend.
