A Resolution of the City Council of the City of Pearland, Texas, authorizing a
Pearland Economic Development Corporation expenditure of $121,850.00 for
design services associated with the Halik Street Reconstruction Project.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain expenditures of $121,850.00, for design services associated with
the Halik Road Reconstruction Project, is hereby authorized and approved.

SUPPLEMENTAL SCOPE OF SERVICES
ARTICLE I
BASIC SERVICES: Freese and Nichols, Inc. (FNI) shall render the following professional services to
Pearland Economic Development Corporation (PEDC) in connection with the development of the Project
described as: Halik Road — Roadway, Drainage, & Utility Improvements — Design & Construction
Phases. Project limits for the roadway will be from SH 35 to east of BNSF Railroad ROW. Scope for the
roadway improvements design will include roadway, drainage, and water line Final Design, Bid, and
Construction phases. Scope of work will be in accordance with Exhibit "A" — City of Pearland's
Transportation Scope of Services for Halik Road Design. This Supplemental Scope of Services defines and
detailed the scope of work further.
A. DESIGN PHASE SERVICES
1. Prepare for and attend a kick-off meeting with PEDC staff to establish specific scope and
requirements for the Project and gather additional existing information.
2. Provide overall project management, scoping, contract administration, invoicing, quality
control/quality assurance reviews, and monthly one-page reports.
3. Based on 30% plans included in the Preliminary Engineering Report dated January 2017, prepare
final design and plan/profile sheets for the road and associated drainage on 11 "x 17" sheets with
1" =40' (H) and 1" =4' (V) scales.
4. Based on 30% plans included in the Preliminary Engineering Report dated January 2017, prepare
final design and plans and plan/profile sheets for the storm box sewer between Rice Drier and
Halik Road on 11"x17" sheets with 1" =40' (H) and 1" =4' (V) scales.
5. Design a new 8" water line with new fire hydrants and valves to replace existing line.
6. Coordinate with PEDC, franchise utility companies and others in finalizing location of existing
utilities in construction plans. FNI will conduct utility conflict studies based on available data
and create a conflict list to coordinate with PEDC and utility companies to relocate.
7. Prepare misc. plans: cover sheet, index sheet, general notes, quantity summary sheets, typical
sections, control sheets, project layout sheets, point data sheets, for the Project.
8. Design and prepare plans for pavement marking and signage for the Project.
9. Prepare traffic control plans and details for the Project.
10. Review and assemble and incorporate City's standard details into construction plans.
11. Design and prepare plans and details for storm water pollution prevention.
12. Prepare bid quantities and engineer's opinion of probable construction cost and updates.
13. Assemble City's standard technical specifications and contract document and bid proposal.
14. Prepare and submit three (3) copies of 11 "x 17" of 60% -complete plans and a pdf copy for PEDC
review and comments. Attend meeting to review comments. Develop plans & details further to
90% level.
15. Prepare and submit three (3) copies of 11 "x 17" of 90% -complete plans and Technical
Specifications and Bid Proposal and a pdf copy of each for PEDC review and comments. Attend
meeting to review comments. Develop plans & details further to 100% level.
16. Conduct coordination with TxDOT on the Permit for tie-in to SH 35.
17. Finalize plans and Project Manual based on PEDC's final comments and submit three (3) copies
of final documents along with pdf copies to PEDC.
18. Attend periodic progress meetings through Design Phase.
D. BID AND AWARD PHASE (As -Needed Basis):
Upon authorization from the PEDC, FNI will proceed with the performance of services in this phase
as indicated in Exhibit A, "Transportation Scope of Services for Rice Drier Road Design Phase."
E. CONSTRUCTION PHASE (As -Needed Basis):
Upon completion of the bid phase services, FNI will proceed with the performance of construction
phase services as described Exhibit A, "Transportation Scope of Services for Rice Drier Road Design
Phase." FNI will endeavor to protect PEDC in providing these services however, it is understood that
FNI does not guarantee the Contractor's performance, nor is FNI responsible for supervision of the
Contractor's operation and employees. FNI shall not be responsible for the means, methods,
techniques, sequences or procedures of construction selected by the Contractor, or any safety
precautions and programs relating in any way to the condition of the premises, the work of the
Contractor or any Subcontractor. FNI shall not be responsible for the acts or omissions of any person
(except its own employees or agents) at the Project site or otherwise performing any of the work of
the Project.
B. SPECIAL SERVICES
Upon authorization from the PEDC, FNI provide the following Additional Services:
1. Conduct additional topographical field survey to update the current available mapping for the
purpose of design. Additionally, prepare description & exhibit documents for one (1) proposed
15' easement between Rice Drier and Halik for the PEDC to acquire. (Subconsultant proposal
attached)
2. Reimbursable project expenses such as printing, deliveries, mileage, outside printing ofplans and
for the Project and TDLR Registration and ADA Compliance Reviews.
ARTICLE II
ADDITIONAL SERVICES: Services that are not specifically listed in above Supplemental Scope of
Services or Attachments shall be considered as Additional Services to be performed by FNI, if authorized by
PEDC and will be paid for as stated in the Compensation Attachment, Item D.2.

ARTICLE III
TIME OF COMPLETION: Upon authorization by the PEDC, FNI shall proceed with performance of
professional services defined as Design Phase Services, to submit final design package within 120 calendar
days after date of authorization.
If FNI's services are delayed through no fault of FNI, FNI shall be entitled to adjust contract schedule
consistent with the number of days of delay. These delays may include but are not limited to delays in PEDC
or regulatory reviews, delays on the flow of information to be provided to FNI, governmental approvals, etc.
ARTICLE IV
RESPONSIBILITIES OF PEDC: PEDC shall perform the following in a timely manner so as not to delay
the services of FNI:
A. Designate a person to act as PEDC's representative with respect to the services to be rendered. Such
person shall have contract authority to transmit instructions, receive information, interpret and define
PEDC's policies and decisions with respect to FNI's services for the Project.
B. Provide all criteria and full information as to PEDC's requirements for the Project, including design
objectives and constraints, space, capacity and performance requirements, flexibility and
expandability, and any budgetary limitations; and furnish copies of all design and construction
standards which PEDC will require to be included in the drawings and specifications.
C. Assist FNI by placing at FNI's disposal all available information pertinent to the Project including
previous reports and any other data relative to design or construction of the Project.
D. Arrange for access to and make all provisions for FNI to enter upon public and private property as
required for FNI to perform services.
E. Give prompt written notice to FNI whenever PEDC observes or otherwise becomes aware of any
development that affects the scope or timing of FNI's services, or any defect or nonconformance of
the work of any Contractor.
ARTICLE V

If FNI sees the Scope of Services changing so that additional services are needed, FNI will notify PEDC for
PEDC'S approval before proceeding.
C. COMPENSATION TERMS
1. "Sub -Consultant Expense" is defined as the expense that is incurred by FNI in employment of others
in outside firms for services in the nature of geotechnical borings, testing, surveying, and similar
services that are not included in the Basic Services or design services not performed by FNI.
2. "Direct Non -Labor Expense" is defined as that expense for any assignment incurred by FNI for
supplies, transportation and equipment, travel, communications, subsistence and lodging away from
home and similar incidentals in connection with that assignment.
D. BASIC SERVICES:
1. Upon authorization from the PEDC, FNI shall proceed with the services outlined in each phase of
the Project. For the purposes of preparing monthly statements, FNI shall submit to the PEDC
payment requests in proportion to that part of the service which has been accomplished as evidenced
by monthly statements. Final payment shall be due upon the completion of defined services.
2. If other Additional Services are required and authorized by the PEDC, FNI shall be compensated as
follows:

OTHER DIRECT EXPENSES:
Other direct expenses are reimbursed at actual cost times a multiplier of 1.10. They include outside reproduction
expense, communication expense, travel, transportation and subsistence away from the FNI office. Miscellaneous
expenses directly related to the work, including costs of laboratory analysis, test, and other work are be done by
independent persons other than staff members, these services will be billed at a cost times a multiple. For Resident
Representative services performed by non-FNI employees and CAD services performed In-house by employees
where FNI provides workspace and equipment to perform such services, these services will be billed times a
multiplier of 2.0. This markup approximates the cost to FNI if an FNI employee was performing the same
services.
These rates will be adjusted annually in February.

RE: Halik Road Topographic Survey Update
Mr, Bavarian,
This letter is our proposal to provide surveying and mapping services in connection with updating
the Topographic Survey previously prepared along Halik Road in the City of Pearland, Brazoria
County, Texas. Based on our discussions The Wilson Survey Group (WSG) proposes the
following:
Project Area: Along the Halik Road right-of-way from S.H. 35 (North Main) to the railroad right-
of-way. Along the 15 -foot Sanitary Sewer Easement located between Halik and Rice Dryer Roads.
Project Scope of Work:
1. Recover or re-establish the vertical control points previously established along the Project
Area.
2. Recover or re-establish the horizontal control points previously established along the
Project Area.
3. Verify the location of visible improvements within the Project Areas, including but not
limited to paving, manholes, valves, fire hydrants, traffic signal poles and boxes, signs.
fences, culverts, driveways, drainage structures, power poles, etc.
4. Process the information and prepare a 2D continuous survey drawing showing all of the
information gathered in the field surveys in an Autodesk Civil 3D 2019 .dwg file.
5. The .dwg file and survey point file will be provided to Freese -Nichols.
6. Based on information to be furnished by Freese -Nichols WSG will prepare a metes and
bounds description and an exhibit map of a proposed easement adjacent to the existing
Sanitary Sewer Easement between Halik and Rice Dryer Roads.
7. Provide pdf files and four (4) hardcopies of the signed and sealed metes and bounds
description and exhibit map.
The cost to provide the outlined services will $3,500.00 including all labor, materials and
expenses. The final data can be provided within fifteen (15) business days following the issuance
of a fully executed Change Order or a new Subcontractor's Agreement.

engineering services to the OWNER in connection with the construction of the
Project.
1. Final Design Phase Services
a. Prepare final plans details specifications and cost estimate in
accordance with City of Pearland's Design Criteria Manual (DCM)
i. prepare detailed construction drawings, specifications and
construction bid packages for the proposed Project
ii. attend monthly progress/update meetings at the City
iii. including roadway geometrics, pavement, drainage,
sidewalks, street lighting, pavement markings, traffic signals,
utilities, landscaping, 8" water line, and other design
elements as necessary
iv. provide work sequencing plans — coordinated with other
work and other local projects
