R2020-56 A Resolution of The City Council of the City of Pearland, Texas, indefinitely extending the Mayor's March 18, 2020 Declaration of Disaster associated with the imminent threat and public health emergency resulting from the spread of the novel coronavirus (COVID-19). BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That on March 18, 2020, as authorized by Chapter 418 of the Texas Government Code (the "Code"), the Mayor executed a Declaration of Disaster (attached hereto as Exhibit "A") associated with the imminent threat and public health emergency resulting from the spread of COVID-19. Section 2. That pursuant to the Code, the Declaration shall continue for a period of not more than seven days from the date of the declaration unless continued or renewed by the City Council of Pearland. Section 3. That the City Council, recognizing the ongoing public health threat of COVID- 19, hereby indefinitely extends the Mayor's Declaration of Disaster until the Declaration is suspended by the Mayor or the City Council. COKER CITY ATTORNEY PROCLAMATION DECLARING DISASTER WHEREAS, the Mayor of the City of Pearland recognizes the imminent threat and health emergency created by the spread of illness linked to the novel coronavirus (COVID-19); and WHEREAS, the Mayor of Pearland has determined that extraordinary measures must be taken to contain COVID-19 and prevent its spread throughout Pearland, including the quarantine of individuals, groups of individuals, and property and, additionally, including compelling individuals, groups of individuals, or property to undergo additional health measures that prevent or control the spread of COVID- 19 and alleviate the suffering of people and to protect or rehabilitate property. NOW, THEREFORE, BE IT PROCLAIMED BY THE MAYOR OF PEARLAND: That a local state of disaster is hereby declared for the City of Pearland pursuant to §418.108(a) of the Texas Government Code. 2. Pursuant to §418.108(b) of the Government Code, the state of disaster for public health emergency shall continue for a period of not more than seven days from the date of this declaration unless continued or renewed by the City Council of Pearland. 3. Pursuant to §418.108(c) of the Government Code, this declaration of a local state of disaster shall be given prompt and general publicity and shall be filed promptly with the City Secretary. 4. Pursuant to §418.108(d) of the Government Code, this declaration of a local state of disaster activates the city emergency management plan. 5. Any individual, group of individuals, or property subject to a Local Health Authority Order restricting the movement of that individual or group of individuals or restricting movement to, from, or within that property, shall limit ingress and egress and take such measures as specified by the Local Health Authority or Order of the Mayor. 6.
