A Resolution of The City Council of the City of Pearland, Texas, requesting
Governor Greg Abbott to temporarily waive and/or suspend certain rules that
limit Economic Development Corporations ("EDC"), created under the
authority of Chapter 501 of the Local Government Code ("Code"), from utilizing
EDC tax revenue be used as a form of financial disaster relief to support local
businesses impacted by the novel coronavirus (COVID-19).
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That on March 13, 2020, Governor Greg Abbott declared a State of Disaster
for the State of Texas associated with the imminent threat and public health emergency resulting
from the spread of COVID-19.
Section 2. That on March 18, 2020, Mayor Tom Reid signed a Declaration of Disaster
to allow support efforts of Local Health Authorities designed to mitigate the imminent threat and
public health emergency resulting from the spread of COVID-19.
Section 3. That COVID-19 poses a substantial threat to viability of local businesses, and
the ability to provide local disaster relief assistance using EDC tax revenue will help fulfill the
legislative purpose of the Code.
Section 4. That EDC's are authorized by the Code to support the existence,
development, and expansion businesses to support the economic growth of the State and
encourage employment.
Section 5. That the Code currently contains limitations that prevent the use of EDC tax
revenue from being used as a form of financial relief aid to support local businesses that are
impacted by the novel coronavirus (COVID-19).
Section 5. That the City Council of the City of Pearland hereby request that Governor
Greg Abbott temporarily waive and/or suspend certain rules that limit EDC's from utilizing EDC tax
revenue as a form of financial disaster relief to support local businesses impacted by the novel
coronavirus (COVID-19).
