M. IN THE CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS The Hearings were called to order with the following present: Mayor Pro Tem William Wolff Councilmember James Bost Councilmember David Smith Councilmember Richard Tetens Councilmember D. Mayor Pro Tem Wolff advised that Application No. 16, Request of Charles Emmerich, Agent for National Asset Bank (a bank in liquidation), Owner, was withdrawn by letter to Mayor and City Council, dated April 16, 1990 from Charles R. Emmerich. 2. APPLICATION NO. 17, REQUEST OF CITY OF PEARLAND, AGENT, FOR AN AMENDMENT TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF SAID CITY, FROM CLASSIFICATION GB, GEI4MM BUSINESS TO OP, OFFICE AND PROFESSIONAL ON THE FOLLOWING DESCRIBED PROPERTY, TO -WIT: Lots 29, 30, 31 and 32, Block 8, Pearland Townsite. (2234, 2236, 2238 and 2240 N. Galveston) SPEAKING FOR THE PROPOSED REQUEST: 1. City Manager Jim DeShazer informed that back in 1980, Alta Carbone, representing her mother, went through the zone change process and upon approval, the zoning of the property was changed from General Business to Office and Profes- sional. When the revisions to the Zoning Ordinance went into effect in 1986 and the maps were reprinted, that property was inadvertently zoned General Business. The City Staff, Mr. DeShazer advised, initiated this change to correct the error on the zoning map. 2. Mr. Calvin Jones, 2237 N. Park. Mr. Jones stated that he had a tentative agreement with the owner to purchase the property. His intentions were to build a duplex on this property. 141 SPEAKING AGAINST THE PROPOSED REQUEST 1. Mary Ontiveros, 2233 N. Park. Ms. Ontiveros expressed her concern about what will be built on this property. 2. Emma Rodriguez, 2243 N. Park. Ms. Rodriquez stated she has lived in the area for over 30 years and does not want to see any business come into it. QUESTION AND ANSWER PERIOD In discussions between Council, Planning & Zoning members and City Staff, it was pointed out that as long as two zones are compatible, it does not constitute spot zoning. Mr. Jones was informed that under an Office and Professional zoning a request for a Specific Use permit would be required to build a duplex on the property. It was also mentioned that under General Business zoning a duplex would not be allowed. COMPLETE TAPE OF HEARING IS ON FILE IN THE OFFICE OF THE CITY SECRETARY The Hearing was adjourned at 7:58 P. M. 3. APPLICATION NO. 18, REQUEST OF THE CITY OF PEARLAND, AGENT, FOR AN AMENDMENT TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF SAID CITY, FROM CLASSIFICATION GB, COAL BUSINESS TO C, COMMERCIAL ON THE FOLLOWING DESCRIBED PROPERTY, TO -WIT: 1. Everything lying within Airport Subdivision, Section 1, that is currently zoned General Business, to be changed to Commercial (Lots 15 & 16 - 2700 Block of S. Main). 2. Everything lying within Lot A, Pearland Pavilion, that is currently zoned General Business, to be changed to Commercial (2700 Block of S. Main). 3. Everything lying within Airport Subdivision, Section 2, that is currently zoned General Business, to be changed to Commercial (3800 Block of Walnut). SPEAKING FOR THE PROPOSED REQUEST 1. Building Official Ernie Buenrostro informed that the zoning in this area is predominately commercial and the Development Committee was requested to investigate the possibility of rezoning the few lots that were still zoned General Business. Everyone affected were notified by certified mail and no one expressed any objections; therefore, City Staff initiated this zone change, Mr. Buenrostro stated. SPEAKING AGAINST THE PROPOSED REQUEST No one present spoke against this proposed request.
