A Resolution of the City Council of the City of Pearland,Texas,authorizing the
resale of property in accordance with Section 34.05 (a), (c) and (d) of the
Property Tax Code.
Whereas, on the 25th day of November, 2019, at the regularly scheduled meeting of the City
Council of the City of Pearland, a motion was made and seconded for the City of Pearland to resell
property described on Exhibit "A" attached hereto, which was acquired through tax foreclosure
proceedings. The City of Pearland requests that the Constable of Harris County conduct such sale
in accordance with Section 34.05 (a), (c) and (d), Property Tax Code, and that such sale be held at
the earliest available date in accordance with the laws of the State of Texas; and further that the City
of Pearland notify the Constable that it would not object to a sale price of such properties as outlined
on the attached Exhibit A; and
Whereas,discussion amongst the City Council was then conducted,and upon completion of
the same the Mayor of the City of Pearland called a vote on the motion, and the same was passed
by majority.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That the City of Pearland offer for resale, in accordance with Section 34.05
(a), (c) and (d), Property Tax Code, the property described on Exhibit"A" and that the Constable is
hereby requested to conduct such sale in accordance with such statutes at the earliest possible date
and further, that a minimum acceptable sale price for such property is outlined in Exhibit"A".

Re: Property Tax Resale
This item was previously brought to Council on August 29, 2019, and approved by
Resolution R2019-215 (see attached Thursday packet of 8/29/).
The city contracts with Perdue, Brandon, Fielder, Collins & Mott, LLP, (Perdue) for the collection
of delinquent tax accounts.
In 2015, Perdue filed a tax suit against Nancy C. Robinson and her son, Robert L. Robinson, Jr.,
to collect delinquent taxes owed on 2103 Kildare Dr., Pearland, Texas which is legally described
as Lot 10, Block 4, Green Tee Terrace, Section 3, located in Harris County, Texas. Ms. Robinson
previously maintained an over 65 homestead exemption which was removed upon her death.
Taxes were delinquent to the city for the 2002-2004 and 2006 - 2017 tax years when this case
went to trial in September 2018.
Since that time, Perdue has received an offer to purchase the property for the full amount of
delinquent taxes and associated costs.
As noted above, the case went to trial and the judgment was signed on September 17, 2018.
Perdue posted the property for tax sale for March 5, 2019. At the time of the sale, the property
taxes and court costs totaled $170,979.27. The property had an adjudged value of$255,526 with
a 2019 appraised value of$270,103. In addition, the 2018 taxes went delinquent after the date of
judgment and total an additional $10,598.17. There were no bidders at the sale. As a matter of
law, the property was "struck off' to the city, for itself and as trustee of all the other taxing units,
and the deed was recorded in the County Clerk's office on March 22, 2019. Subsequently, Perdue
sent a notice to vacate to the property address. Perdue requested a writ of possession, gained
possession, changed the locks, assessed the condition, cut down a dead tree and hired a
company to remove the contents of the house. In addition, the city had its mowing contractor mow
the backyard and remove trash.
Since the city has acquired title in its capacity as trustee, Perdue has been contacted by at least
one person wanting to buy the property. On August 14, 2019 an offer to purchase the property for
$185,494.04 was received from David Gutierrez, a resident of Green Tee. His offer was to pay
100% of the taxes and costs owed thru the 2018 tax year. The sale of the property wast have
been subject to any remaining rights of redemption by the prior owner and assumption by

owner of the prorated 2019 taxes. That offer was approved by Council via Resolution R2019-
215. Subsequently, that buyer failed to complete the purchase of the property and there is now
another buyer offering to pay 100% of what is owed. As a contingency, we are asking Council to
approve conducting a public resale of the property in the event the new buyer fails to follow
through on the purchase of the property.
On November 5, 2019, an offer to purchase the property for $185,820.67 was received from JGL
Property Management LLC, whose owner is a resident of Green Tee. His offer will pay 100% of
the taxes and costs owed thru the 2018 tax year. The sale of the property was to have been
subject to any remaining rights of redemption by the prior owner and assumption by the new
owner of the prorated 2019 taxes. A copy of the Trust Resale Offer, bid analysis and resale deed
are attached.
It is the recommendation of staff and our delinquent tax collection law firm to accept the offer, and
bg• wll.be bringing this item forth on the November 25th Council meeting. Upon receipt of the
purchase price we will process and disburse the sale proceeds and record the deed conveying
title to the property.
Mike Darlow, our assigned representative from Perdue, will be available to discuss this issue in
more detail at the Council Meeting on November 25'.
