A Resolution of the City Council of the City of Pearland,Texas,authorizing the
City Manager or his designee to enter into a contract with Freese and
Nichols, in the amount of$1,298,809.00, for final design services associated
with Surface Water Plant Package No. 1.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain contract by and between the City of Pearland and Freese and
Nichols, a copy of which is attached hereto as Exhibit"A"and made a part hereof for all purposes,is
hereby authorized and approved.
Section 2. That the City Manager or his designee is hereby authorized to execute and
the City Secretary to attest a contract with Freese and Nichols for final design services associated
with Surface Water Plant Package No. 1.

CONTRACT FOR PROFESSIONAL SERVICES
THIS CONTRACT is entered into upon final execution by and between the City of Pearland
("CITY") and Freese and Nichols ("CONSULTANT").
The CITY engages the CONSULTANT to perform professional services for a project known and
described as Surface Water Plant("PROJECT"). (Project#WA1605)
SECTION I-SERVICES OF THE CONSULTANT
The CONSULTANT shall perforin the following professional services to CITY standards and in
accordance with the degree of care and skill that a professional in Texas would exercise under the
same or similar circumstances:
A. The CONSULTANT shall perform engineering services. See Exhibit A, attached,
for a detailed SCOPE OF WORK and PROJECT schedule.The PROJECT schedule
shall be submitted in digital and hard copy form in the Microsoft Project for
Windows format.
B. The CONSULTANT shall prepare and submit a detailed opinion of estimated cost
of the PROJECT.
C. The CONSULTANT acknowledges that the CITY (through its employee
handbook)considers the following to be misconduct that is grounds for termination
of a CITY employee: Any fraud, forgery, misappropriation of funds, receiving
payment for services not performed or for hours not worked, mishandling or
untruthful reporting of money transactions, destruction of assets, embezzlement,
accepting materials of value from vendors, or consultants, and/or collecting
reimbursement of expenses made for the benefit of the CITY. The CONSULTANT
agrees that it will not, directly or indirectly; encourage a CITY employee to engage
in such misconduct.
D. The CONSULTANT shall submit all final construction documents in both hard
copy and electronic format. Plans shall be AutoCAD compatible and all other
documents shall be Microsoft Office compatible. The software version used shall
be compatible to current CITY standards. Other support documents, for example,
structural calculations, drainage reports and geotechnical reports, shall be
submitted in hard copy only. All Record Drawings electronic files shall be
submitted to the CITY in TIF format.
E. The CONSULTANT recognizes that all drawings, special provisions, field survey
notes,reports,estimates and any and all other documents or work product generated
by the CONSULTANT under the CONTRACT shall be delivered to the CITY upon
request, shall become subject to the Open Records Laws of this State.
F. The CONSULTANT shall procure and maintain for the duration of this Agreement,
insurance against claims for injuries to persons, damages to property, or any errors

and omissions relating to the performance of any work by the CONSULTANT,its
agents, employees or subcontractors under this Agreement, as follows:
(1) Workers' Compensation as required by law.
(2) Professional Liability Insurance in an amount not less than $1,000,000 in
the aggregate.
(3) Comprehensive General Liability and Property Damage Insurance with
minimum limits of S1,000,000 for injury or death of any one person,
$1,000,000 for each occurrence, and $1,000,000 for each occurrence of
damage to or destruction of property.
(4) Comprehensive Automobile and Truck Liability Insurance covering owned,
hired, and non-owned vehicles, with minimum limits of $1,000,000 for
injury or death of any one person, $1,000,000 for each occurrence, and
$1,000,000 for property damage.
The CONSULTANT shall include the CITY as an additional insured under the
policies, with the exception of the Professional Liability Insurance and Workers'
Compensation. The CONSULTANT shall agree to waive its Right to Subrogation.
Certificates of Insurance and endorsements shall be furnished to the CITY before
work commences. Each insurance policy shall be endorsed to state that coverage
shall not be suspended, voided, canceled, and/or reduced in coverage or in limits
("Change in Coverage") except with prior written consent of the CITY and only
after the CITY has been provided with written notice of such Change in Coverage,
such notice to be sent to the CITY either by hand delivery to the City Manager or
by certified mail, return receipt requested, and received by the City no fewer than
thirty (30) days prior to the effective date of such Change in Coverage. Prior to
commencing services under this CONTRACT,CONSULTANT shall furnish CITY
with Certificates of Insurance, or formal endorsements as required by this
CONTRACT, issued by CONSULTANT'S insurer(s), as evidence that policies
providing the required coverage, conditions, and limits required by this
CONTRACT are in full force and effect.
G. The CONSULTANT shall indemnify and hold the CITY, its officers, agents, and
employees, harmless from any claim, loss, damage, suit, and liability of every kind
for which CONSULTANT is legally liable, including all expenses of litigation,
court costs, and attorney's fees, for injury to or death of any person, for damage to
any property, or errors in design, any of which are caused by the negligent act or
omission of the CONSULTANT,his officers,employees,agents, or subcontractors
under this CONTRACT.
H. All parties intend that the CONSULTANT, in performing services pursuant to this
CONTRACT, shall act as an independent contractor and shall have control of its
own work and the manner in which it is performed. The CONSULTANT is not to
be considered an agent or employee of the CITY.

SECTION II -PERIOD OF SERVICE
This CONTRACT will be binding upon execution and end December 31, 2023.
SECTION III -CONSULTANT'S COMPENSATION
A. The total compensation for the services performed shall not exceed the total noted
in Section B.
B. The CITY shall pay the CONSULTANT in installments based upon monthly
progress reports and detailed invoices submitted by the CONSULTANT based
upon the following:
1. Basic Services (Lump Sum) $803,191.00
2. Additional Services shall require independent and specific authorization
and shall be billed as (Not to Exceed): $495,618.00
3. Bid Phase Services (Hourly Not to Exceed)
4. Construction Phase Services (Hourly Not to Exceed)
5. Reimbursable Expenses (Not to Exceed)
6. Total: $1,298,809.00
C. The CITY shall make payments to the CONSULTANT within thirty(30)days after
receipt and approval of a detailed invoice. Invoices shall be submitted on a monthly
basis.
D. CONSULTANT shall invoice for work performed during the preceding thirty day
period("Billing Period"). The Billing Period shall run from the 266 day to the 25111
day of each consecutive month. Invoices shall be submitted to CITY not more
frequently than once every 30 days. CONSULTANT shall be responsible for
timely submittal of all invoices and CONSULTANT shall not be entitled to
payment for invoices in arrears. All invoices shall reflect most recent single Billing
Period only and represent the true,correct and accurate account of work performed
during the Billing Period.
E. For an agreed contract amount identified as "Lump Sum", Not to Exceed" and
"Reimbursable"the CONSULTANT shall not exceed the fixed contractual amount
without written authorization in the form of a Contract Amendment.
CONSULTANT shall provide 45 days prior notice to the CITY in the event contract
fees may exceed the fixed contract amount. CONSULTANT shall be responsible
for ensuring that such authorization is complete and executed by all parties
performing any work or submitting any invoices for work that exceeds the fixed
contract amount under any expense category.

F. Allowable Reimbursable Expenses
CONSULTANT shall identify and include in the proposal any anticipated
Reimbursable Expenses, and shall itemize Reimbursable Expenses by work
category. Reimbursable Expenses shall be invoiced AT COST without subsequent
markup by the CONSULTANT. All invoices containing a request for
Reimbursable Expenses shall include copies of the original expense receipts
itemized per the allowable category. Allowable Reimbursable Expenses include:
• Hard copy reproductions, copies and/or binding costs
• Postage
• Mileage, for travel from Consultant's local office (within a 25 mile radius)
to meetings at the City or job-site. Mileage shall be charged at the current
IRS rates.
• Travel expenses, mileage from local office to State or federal regulatory
agency office beyond 100 miles.
• Lodging expenses, for destinations beyond 100 miles from the Consultant's
local office AND when business hours exceed eight hours within one
business day OR requires more than one eight hour day.
F.2. Disallowed Expenses
Disallowed Expenses include travel expenses for professional expertise traveling
into the greater Houston area from Consultant offices outside of the greater Houston
area.
SECTION IV-THE CITY'S RESPONSIBILITIES
A. The CITY shall designate a project manager during the term of this CONTRACT.
The project manager has the authority to administer this CONTRACT and shall
monitor compliance with all terms and conditions stated herein. All requests for
information from or a decision by the CITY on any aspect of the work shall be
directed to the project manager.
B. The CITY shall review submittals by the CONSULTANT and provide prompt
response to questions and rendering of decisions pertaining thereto, to minimize
delay in the progress of the CONSULTANTS work. The CITY will keep the
CONSULTANT advised concerning the progress of the CITY'S review of the
work. The CONSULTANT agrees that the CITY'S inspection,review, acceptance
or approval of CONSULTANTS work shall not relieve CONSULTANT'S
responsibility for errors or omissions of the CONSULTANT or its sub-
consultant(s) or in any way affect the CONSULTANT'S status as an independent
contractor of the CITY.

SECTION V -TERMINATION
A. The CITY, at its sole discretion, may terminate this CONTRACT for any reason --
with or without cause--by delivering written notice to CONSULTANT personally
or by certified mail at 11200 Broadway St., Suite 2332, Pearland, TX 77584.
Immediately after receiving such written notice, the CONSULTANT shall
discontinue providing the services under this CONTRACT.
B. If this CONTRACT is terminated, CONSULTANT shall deliver to the CITY all
drawings, special provisions, field survey notes, reports, estimates and any and all
other documents or work product generated by the CONSULTANT under the
CONTRACT, entirely or partially completed, together with all unused materials
supplied by the CITY on or before the 15th day following termination of the
CONTRACT.
C. In the event of such termination, the CONSULTANT shall be paid for services
performed prior to receipt of the written notice of termination. The CITY shall
make final payment within sixty(60) days after the CONSULTANT has delivered
to the CITY a detailed invoice for services rendered and the documents or work
product generated by the CONSULTANT under the CONTRACT.
D. If the remuneration scheduled under this contract is based upon a fixed fee or
definitely ascertainable sum,the portion of such sum payable shall be proportionate
to the percentage of services completed by the CONSULTANT based upon the
scope of work.
E. In the event this CONTRACT is terminated, the CITY shall have the option of
completing the work, or entering into a CONTRACT with another party for the
completion of the work.
F. If the CITY terminates this CONTRACT for cause and/or if the CONSULTANT
breaches any provision of this CONTRACT, then the CITY shall have all rights
and remedies in law and/or equity against CONSULTANT. Venue for any action
or dispute arising out of or relating to this CONTRACT shall be in Brazoria County,
Texas. The laws of the State of Texas shall govern the terms of this CONTRACT.
The prevailing party in the action shall be entitled to recover its actual damages
with interest, attorney's fees, costs and expenses incurred in connection with the
dispute and/or action. CONSULTANT and CITY desire an expeditious means to
resolve any disputes that may arise between under this CONTRACT. To
accomplish this,the parties agree to mediation as follows: If a dispute arises out of
or relates to this CONTRACT, or the breach thereof, and if the dispute cannot be
settled through negotiation, then the parties agree first to try in good faith, and
before pursuing any legal remedies, to settle the dispute by mediation of a third
party who will be selected by agreement of the parties.

SECTION VI–ENTIRE AGREEMENT
This CONTRACT represents the entire agreement between the CITY and the CONSULTANT and
supersedes all prior negotiations, representations, or contracts, either written or oral. This
CONTRACT may be amended only by written instrument signed by both parties.
SECTION VII–COVENANT AGAINST CONTINGENT FEES
The CONSULTANT affirms that he has not employed or retained any company or person,other
than a bona fide employee working for the CONSULTANT to solicit or secure this CONTRACT,
and that he has not paid or agreed to pay any company or person,other than a bona fide employee,
any fee, commission, percentage brokerage fee, gift, or any other consideration,contingent upon
or resulting from the award or making of the CONTRACT. For breach or violation of this clause,
the CITY may terminate this CONTRACT without liability,and in its discretion,may deduct from
the CONTRACT price or consideration, or otherwise recover, the full amount of such fee,
commission,percentage brokerage fee,gift,or contingent fee that has been paid.
SECTION VIII-SUCCESSORS AND ASSIGNS
This CONTRACT shall not be assignable except upon the written consent of the parties hereto.

INTRODUCTION AND ASSUMPTIONS
The Consultant shall provide the following professional engineering services to
the City of Pearland (City) in connection with the design of the Raw Water Pump
Station (RWPS) (Project). The following scope of work provides for the
development of documents for the construction of the RWPS including American
Canal control structure, raw water intake, intake screening, and storm water
detention. The scope of work has been developed based on the following
assumptions:
1) The RWPS will be located within the limits of the Tract 2 property owned by
the City and will generally reflect the assumptions noted below.
2) There will be a screened Raw Water Intake (RWI) structure located on the
Gulf Coast Water Authority's (GCWA)American Canal. The raw water
screening concept will be designed to comply with all regulatory standards
including USAGE design standards. The RWI and RWPS may be designed
and constructed as a single structure.
3) If and / or when it is constructed, the proposed future PSB will be located
south of Mustang Bayou.
4) A RWPS with an initial capacity of 11 MGD (10 MGD firm production
capacity) that can be expanded to a maximum capacity of 22 MGD± (20
MGD firm production capacity)will be located outdoors in the northwest
corner of the Surface Water Treatment Plant (SWTP) site on Tract 2. The
RWPS will convey flow from the American Canal directly to the SWTP. The
pump type, individual pump size, and configuration may be revised from that
shown in the Preliminary Engineering Report (PER) based on the findings of
the 15% Design, as discussed below under additional services.
Discharge piping and discharge conditions from the pump station will be
coordinated and routed to a designated connection location upstream of the
Rapid Mix Basins (designed by others). It is assumed that standby
generator for the electrical building and chemical storage will be provided by
others; FNI will provide generator sizing and will connect generator(by

others) to the Automatic Transfer Switch installed by FNI in the electrical
building.
5) The proposed stormwater detention basin will be located south of Mustang
Bayou and east of the drainage swale that currently drains the properties
south of Tract 2. The detention basin will discharge directly into Mustang
Bayou. The stormwater detention basin will be configured to mitigate the
following areas:
a) Properties south of Tract 2 that currently discharge into Mustang
Bayou through the existing swale that bisects Tract 2
b) The discharge of additional stormwater runoff associated with the
construction of the RWPS and SWTP (upon full build-out). The
Package 2 consultant will be responsible for providing FNI with the
appropriate hydrologic and hydraulic analysis/results associated
with the proposed SWTP.
c) H&H analysis, detention, or other forms of mitigation related to the
PSB will be provided as part of a future scope of work at the
direction of the City.
6) The GCWA American Canal is identified as non-jurisdictional (per USACE's
determination as expressed in their 3 February 1976 memorandum), or
unregulated, under Section 404 of the Clean Water Act, and activities or
construction within the GCWA American Canal would not require permits
from USACE. However, if this is not the case, it is our opinion that the
future construction of the intake would fall within the terms and conditions of
a Nationwide Permit (NWP; e.g., or IP would not be required). Should
USACE authorization be required, it is FNI's opinion that this portion of the
project can be designed to meet the terms and conditions of Nationwide
Permit (NWP) 12, Utility Lines, or other NWPs without requiring the
submittal of a pre-construction notification (PCN) to the USACE.

Per information provided the City and Raba-Kistner, the proposed detention
pond may impact a water feature (a historic meander of Mustang Bayou)
that is likely to be considered a jurisdictional water of the U. S. by the
USACE, and therefore, a PCN or individual permit (IP) could be required. If
there is less than 0.5 acres of impact to the meander and other jurisdictional
water features on the site, project could potentially be authorized by NWP
43 with a PCN. If impacts exceed 0.5 acres, an IP would be required. The
USACE makes the final determination as to whether a water body is
jurisdictional. Additionally, if a Section 404 NWP PCN or IP is required, FNI
assumes that any required mitigation will be through the purchase of
mitigation credits from an approved mitigation bank and that a detailed
mitigation plan will not be required. FNI will not be responsible for the
purchase of any required mitigation credits.
Concurrent with NWP general condition 20, Historic Properties:
Coordination with the Texas Historical Commission was performed by
others (Raba-Kistner) and no survey was required. FNI assumes no
additional coordination will be necessary.
7) The American Canal controls structure will be designed to have a minimal
impact to the hydraulic grade line when the canal is flowing at full capacity.
Computer modeling of upstream conditions is not required as part of this
scope of work.
8) The storm water detention design and environmental permitting is based
upon having offline detention and does not include inline detention.
9) The construction drawings will be prepared using 2019 AutoCAD (2) and
2019 AutoCAD Civil 3D (for the detention basin only); files will be
compatible with other design packages designed by others. Design
Consultant will work with others to standardize similar discipline standards,
general notes, detail sheets, legends, abbreviations, etc. Same for
specifications, contract documents, piping schedules, valve schedules,
equipment schedules, and any other joint standards developed for this

project. The CAD standards shall be determined prior to the start of the
project.
10) FNI understands the City will deliver the project through a Construction
Manager At Risk (CMAR) for Packages 1, 2, and 3, and that components of
the project construction may be expedited through development of early
work packages (including earthwork and the stormwater detention basin for
Package 1). Should this be required, FNI will be given notice to deliver
within the current schedule, however if an accelerated schedule is required
FNI will identify impact of such schedule acceleration and negotiate
additional effort associated with schedule changes necessary to timely
complete design efforts for the respective early work areas. The proposed
level of effort is based upon FNI developing one set of contract documents.
CMAR will be responsible for the assembly and procurement of all early bid
packages.
The project requirements, goals and objectives, along with the design basis
and criteria will be developed and documented in a Basis of Design Report
(BODR). This is a living document and will be updated approximately five to
six times over the life of the project. Major design decisions will be
considered frozen at various milestones during design. Should FNI be
directed to reconsider and revise such decisions at the direction of the
Owner due to CMAR cost saving recommendations, then this effort will be
covered out of an additional Owner directed services task and covered
under the CMAR coordination allowance.
11) Bidding and construction phase services will be provided at the City's
direction as part of a future task order.
BASIC SERVICES
The Consultant shall provide the following professional engineering services to
the City in connection with the construction of the proposed Project.
TASK I — PROJECT MANAGEMENT

FNI will provide Project Management including:
1. Plan and participate in a kick-off meeting with the City to confirm the project
requirements, goals and objectives, lines of communication, and schedule;
2. Plan and participate in up to eight (8) project monthly status meetings during
the engineering design phase to facilitate project coordination, timeliness,
budget compliance, and schedule;
3. Special Coordination Meetings— Participate in up to a total of four (4)
meetings with stakeholders such as USACE, GCWA, BDD4, Ardurra and
City to understand constraints, concerns, and goals of each of the
stakeholders.
4. Plan and participate in up to two (2) on-site meetings to facilitate site
coordination issues with sub-consultants, construction access
considerations, and data retrieval. Prepare meeting summaries (meeting
minutes) and site visit memorandums (with photos) and distribute to project
team;
5. Design Workshops - Participate in three (3) half day project design
workshops. The first workshop will be attended by all primary consultants to
discuss project procurement strategies, identify interfaces and coordination
issues between Packages 1, 2, and 3, and confirm roles and
responsibilities. The second and third design workshops will be to identify
and address technical design issues, constraints and concerns.
6. Develop, maintain, and update a Project design schedule using Microsoft
Project®. Schedule shall include critical activity start and/or completion
milestones, including monthly progress meetings, 15%, early work package,
60%, 90%, and final design review dates, and deliverable submittal dates.
7. Sub-Contract and manage subconsultant services for:

to finalizing for Construction.
b. Deliverables: Five sets of final documents and Electronic .PDF files.
Electronic copies of equipment data sheets for major equipment
and CAD files will be provided for CMAR use.
ADDITIONAL SERVICES
FNI will provide Additional Services as requested including:
1. CMAR Coordination
a. Three (3) compilation and review meetings will be used to
standardize CAD standards, common details, and specifications.
b. When directed by the Owner and as allowed up to the allowance
provided, Plan and participate in additional meetings with the
CMAR during the engineering design phase; Perform additional
value engineering evaluations and /or design efforts initiated by the
CMAR; Provide clarifications and respond to CMAR questions in
support of the CMAR's preparation of Early Work Packages, which
could include earthwork associated with constructing the
Stormwater Detention Basin, and construction of the concrete sub-
structure for the RWPS.

c. Develop hydraulic design, grading and drainage plan, and site
layout for the stormwater detention basin, including design of
roadways, fencing and gate details.
d. Evaluate the cost benefits of a combined RWI and RWPS located
on the banks of the American Canal within the boundary of the
SWTP site. Evaluation will include consideration of submersible
versus vertical turbine pumps for performance efficiency and life
cycle cost for the current RWPS configuration.
2. Environmental/Permitting
a. Review environmental permitting studies conducted by others (i.e.
Raba-Kistner) and perform one (1) site visit to generally confirm
existing conditions.
i. Create a base map in GIS using data collected by third party
and available from the City including wetland delineation
data to create environmental base layers.
ii. FNI will also review databases and third-party data to
determine potential federal threatened and endangered
species potentially present on the site, if any.
iii. Conduct a site visit to make observations to verify existing
conditions as compared to those documented by third
parties. The presence and general locations of waters of the
U.S., including wetlands, potential federally listed
threatened/endangered species habitat will be generally
observed within the proposed ROW.
b. Document the efforts of this task in a letter to the City. Specific
discussion points will include: documenting the site visit findings,
recommendations to the design team, and our opinion as to
whether or not the project has been designed to meet the terms
and conditions of NWP 12, NWP 43, or other applicable NWP. The

letter would also review the findings of federally threatened
endangered species included in the Raba Kistner report.
c. FM additionally recommends a meeting with the USACE to
determine the jurisdictional status of any small surface water
features found on-site and assess the USACE's concerns, if any,
regarding the project. The USACE may require the submittal of an
Approved Jurisdictional Determination (AJD) request to assess the
jurisdictional status of the water feature(s). Preparation of an AJD
would be an additional service.
d. Prepare a PCN for nationwide or regional general Section 404
permit coverage, or alternatively an Individual Permit application.
Both will involve the filling out and submitting ENG FORM 4345
with appropriate drawings and attachments to the USAGE. The IP
application will include an alternatives analysis and responses to
public and agency comments.
3. Additional Environmental/Permitting Services
Given that the degree to which the following services will be required is
unknown, the costs for the following additional environmental services
have not been included within this proposal.
At the request of the City, FNI can perform additional environmental
services of the site that may include the following:
Preparation and submittal of a TPWD Marl, Sand, Gravel, Shell or
Mudshell Permit.
a. Presence/absence surveys, informal Section 7 Consultation with the
U.S. Fish and Wildlife Service (USFWS) or acquisition of an Incidental
Take Permit.
b. Application for General Land Office easements.
c. Phase I Environmental Site Assessment for any property acquired in
fee.
d. Preparation of an AJD.

4. Conduct a topographic survey (see Attachment A-2).
5. Geotechnical Exploration, Analyses, and Design (see Attachment A-3).
a. Perform geotechnical exploration including six (6) soil borings to
depths ranging from 30 to 80 feet as described below and in
Attachment A-3:
i. Raw Water Intake: one (1) 30-foot boring
H. Pump Station: one (1) 80-foot and one (1) 40-foot borings
Hi. Electrical Building: one (1) 30-foot boring
iv. Detention Basin: two (2) 40-foot borings
b. Install one (1) piezometer (80-foot depth) adjacent to selected
boring location and provide install protection for piezometer with
four(4) steel poles (approximately 3 feet high) with steel casing at
the surface. Perform one (1) slug test in the piezometer.
c. Perform laboratory testing, engineering analyses and design tasks
as follows:
i. Analysis of subsurface soil and groundwater conditions
indicated by the field and laboratory work, including liquid
and plastic limit, moisture content, sieve analysis,
unconfined compressive strength, unconsolidated undrained
triaxial compression, specific gravity, consolidated undrained
(CU) triaxial tests, and permeability tests.
ii. Development of design soil profiles and parameters
iii. Allowable bearing pressure and settlement analyses for
shallow foundations
iv. Axial and lateral analyses of deep foundations
v. Lateral earth pressure analyses for below-grade structures
vi. Earthwork recommendations for the detention basin

vii. Foundation and site preparation recommendations for the
Raw Water Intake, RWPS, Electrical Building, and Piping
viii. Settlement table development for different construction
options for each facility element.
ix. Construction considerations for the Raw Water Intake,
RWPS, Electrical Building, and Piping.
x. Pipe trench, dewatering, and embedment and backfill
recommendations.
xi. Corrosion considerations for buried metallic piping systems.
d. Document the efforts of this task in a TX PE signed and sealed
supplement to the original Geotechnical Engineering Report and
summarize the design recommendations in the BODR.
6. Hydrologic and Hydraulic Analyses
FNI will conduct an evaluation of the drainage conditions in the project
area and the surrounding vicinity of the project, with the objective of better
defining existing conditions and mitigate impacts from the project on
Mustang Bayou. Tasks to include:
a. The effective, or best available hydrologic and hydraulic models for
Mustang Bayou will be used as a starting point; The City will
provide the H&H models to be used for this project. 2018 LiDAR will
be downloaded and used for this project.
b. The hydrologic model will be updated to reflect current conditions,
with drainage areas subdivided as needed to provide an
appropriate baseline condition for the project. Rainfall depths
currently in the hydrologic model will be updated to reflect latest
information as agreed to by all parties involved.
c. The hydraulic model will be modified and updated using field survey
data and 2018 LiDAR to reflect current conditions. The

modifications start approximately 1,500 feet downstream of County
Road 48 (Airline Road) and extend upstream to FM 564. Additional
modifications include converting the model to unsteady-flow to
better account for storage in the system, and possibly two-
dimensional (2D) elements for select areas. This updated model
may be truncated to represent only the study area as outlined
above, and will be used to establish existing water surface
elevations across the project site.
d. Update the existing conditions hydrologic model to incorporate the
proposed RWPS and SWTP and create a proposed conditions
hydrologic model.
e. Update the existing conditions hydraulic model to incorporate the
proposed grading plan for the RWPS and SWTP, as well as the
updated flows from the hydrologic model. This model will represent
proposed conditions without mitigation.
f. Update the proposed conditions hydraulic model to evaluate an
alternative to mitigate impacts from the RWPS and SWTP. This
mitigation alternative will consist of additional storage within Tract
2, in the site immediately east of the ditch, and south of Mustang
Bayou. Evaluation of viability of inline detention will also be
completed. Impacts will be evaluated for the 10-yr and 100-year
events.
g. Prepare a technical memorandum documenting the drainage
results and impact on design, if any, signed and sealed by a TX PE.
Submit a draft version to the City of Pearland for review.
h. Upon review from the City, FNI will address comments and issue a
final memorandum signed and sealed by a TX PE to Brazoria
Drainage District#4 (BDD4) for their review. Attend up to 1 meeting
with BDD4 and address up to 1 round of comments.

i. Coordinate with design team and summarize the design
recommendations of this task in the BODR.
7. 15% Design
Develop a 15% design based on the revised, latest project concepts
including the results of the cost-benefit evaluation performed as part of
CMAR Coordination task 1.c. The following design aspects will be
updated accordingly:
a. Structural Design of:
i. American Canal control structure;
ii. Raw Water Intake;
iii. RWPS and wet well including plan views, sections,
elevations, and details of the pump station foundation and
wet well; and
iv. Ancillary structures and facilities
b. Process/ Mechanical Design of:
i. American Canal control structure (fixed weir);
ii. Raw Water Intake Screen and Cleaning System sized for 22
MGD±;
iii. Raw Water Pump Station including; pump-type selection
(vertical or submersible); pump curve selection; wet well
sizing and pump configuration for 22 MGD±; configuration of
gates/stop-logs; piping and valve configuration; and flow
meter design.
iv. Buried yard piping including differential settlement
requirements at structures.
c. Electrical, Instrumentation and Control design of electrical room
plans, site plans, one-line diagrams, process and instrumentation
diagrams (P&IDs), and SCADA architecture diagrams.
d. Architectural design of stand-alone electrical building including floor
plans, sections, elevations, details and schedules.

Dear Mr. McCaskie:
As per your request, we are pleased to present the revised cost proposal for drilling and
laboratory testing and preparation of data report for the referenced project.
The scope of this study is based on your e-mail on February I I, 2019 and June 6, 2019 and
our discussions on February 12,2019 and is given below:
• Upon receiving boring location plan; stake the borings in the field with GPS and obtain
underground utilities clearance of boring locations with one call;
• Drill and sample six (6) borings to depths ranging from 30 to 80 feet. The details of
boring program are given below:
• Raw Water Intake: one(1)30-foot boring
• Pump Station: one(1)80-foot and one(1)40-foot borings
• Electrical Building: one(I)30-foot boring
• Detention Basin: two (2)40-foot borings
The sampling will be continuous in the upper 20 feet and then at 5-foot intervals,
thereafter. Obtain sampling in 3-inch shelby tube in cohesive soils and 2-inch diameter
split spoon sampler in cohesionless soils and intermediate and non-cohesive soils.
• Obtain water level readings in the boreholes during drilling and upon boring completion;
• Install one (1) piezometer (80-foot depth) adjacent to selected boring location and
provide install protection for piezometer with four(4) steel poles (approximately 3 feet
high)with steel casing at the surface. Perform one(1)slug test in the piezometer.
• Suitable portion of each sample at each borehole location will be sealed, labeled and
packaged for transportation to Geotest laboratory.
• After taking water level measurements,backfill the borings (except piezometer) with the
cement bentonite grout and restore the site to pre-existing conditions.
• Perform the laboratory tests of assigned samples per ASTM procedures. The number
and type of tests are presented in Attachment No. 1.

We anticipate to start the work within one (1) week after receiving written authorization.
The field work can be completed in about one (1)week and the laboratory testing will be complete
in about four (4) weeks after completion of field work. The laboratory data letter report will be
submitted in about eight(8)weeks after receiving the written authorization.
The cost of drilling six (6) borings to depths ranging from 30 to 80 feet, installing one(1)
piezometer to 80 feet, conduct field slug test, perform laboratory testing on assigned samples, and
preparation of a laboratory data report will be a lump sum of$26,472.00. The cost breakdown is
given on Attachment No. I. This cost includes utilization of marsh buggy drilling and no clearance
for boring access. Please indicate your formal acceptance by issuing return authorization.
