Ord. 1416 2019-08-26 ORDINANCE NO. 1416-2019 An ordinance of the city council of the City of Pearland, Texas, amending Chapter 9, Electricity, of the City of Pearland Code of Ordinances, as it may have been, from time to time, amended; having a savings clause, a severability clause, and a repealer clause; and providing for codification and an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That Chapter 9, Electricity, of the City of Pearland Code of Ordinances, is hereby amended and adopted to read as follows: "ARTICLE I. Electrical Code Sec. 9-1. Adopted. The 2017 edition of the NFPA 70 National Electrical Code, as published by the National Fire Protection Association is hereby adopted by reference and made part of this chapter. A true and correct copy of this code shall be on file in the office of the city secretary. Sec. 9-2. Conflicts. In the event of any conflict between the provisions of the code adopted by this article and the provisions of this Code of Ordinances, state law or city ordinances, rules or regulations, the provisions of this Code of Ordinances, state law or city ordinances, rules or regulations shall prevail and be controlling. Sec. 9-3. - Penalty for violation. Any person, firm or corporation who shall violate or fail to comply with the requirements or provisions of any section or subdivision of the electrical code adopted by this article shall be deemed guilty of a misdemeanor and shall, upon conviction by a court of competent jurisdiction, be fined not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) for each offense, and each and every day that such violation continues shall constitute a separate offense. ORDINANCE NO. 1416-2019 Sec. 9-4 --- 9-10. Reserved. ARTICLE II. Permits Sec. 9-11. Required Permits for electrical work shall be regulated as required per Section 105 of the International Building Code adopted in Section 7.13 of this Code of Ordinances. Sec. 9.12---9.15. Reserved." Section 2. Savings. All rights and remedies which have accrued in favor of the City under this Ordinance and amendments thereto shall be and are preserved for the benefit of the City. Section 3. Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid, unconstitutional or otherwise unenforceable by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 4. Repealer. All ordinances and parts of ordinances in conflict herewith are hereby repealed but only to the extent of such conflict. Section 5. Codification. It is the intent of the City Council of the City of Pearland, Texas, that the provisions of this Ordinance shall be codified in the City's Code of Ordinances as provided hereinabove. Section 6. Effective Date. The City Secretary shall cause this Ordinance, or its caption and penalty, to be published in the official newspaper of the City of Pearland, upon passage of such Ordinance.
