THE PURPOSE OF CHANGING THE CLASSIFICATION OF CERTAIN REAL
PROPERTY LOCATION BEING APPROXIMATELY 5.96 ACRES, WILLETTS
SUBDIVISION, ABSTRACT 70, W.D.C. HALL SURVEY, LOT 2, 2C, 2D, 2C1,
2D1, AND 2E, CITY OF PEARLAND, BRAZORIA COUNTY, TEXAS
(GENERALLY LOCATED ON THE NORTH SIDE OF FM 518 (BROADWAY
STREET), AND EAST OF HAMM ROAD) (APPLICATION NO. 1200 &
SPECIFIC USE PERMIT APPLICATION NO. 138) FROM CLASSIFICATION
COMMERCIAL DISTRICT (C) TO GENERAL BUSINESS DISTRICT —
SPECIFIC USE PERMIT (GB(S)), A SPECIFIC USE PERMIT FOR STORAGE
AND MINI -WAREHOUSE, AT THE REQUEST OF ROBERT MCCONNELL AND
GJR INVESTMENT MANAGEMENT, INC., APPLICANT FOR TEXAS NO. 4,
LTD., OWNER, PROVIDING FOR AN AMENDMENT OF THE LAND USE
DISTRICT MAP; CONTAINING A SAVINGS CLAUSE, A SEVERABILITY
CLAUSE, AN EFFECTIVE DATE AND OTHER PROVISIONS RELATED TO
THE SUBJECT.
WHEREAS, Robert McConnell and GJR Investment Management, Inc.,
applicant for Texas No. 4, Ltd., owner, filed on October 14, 2004, an application for
amendment pursuant to Section 28 of Ordinance No. 509, the Land Use and Urban
Development Ordinance of the City, for approval of a change in the land use as
provided for in said Section 28, said property being legally described in the original
applications for amendment attached hereto and made a part hereof for all purposes as
Exhibit "A" (the "Property"), a copy of which legal description is attached as Exhibit "B";
WHEREAS, the Property is currently improved with 9 storage buildings used as
a storage and mini -warehouse with the remaining area devoted to open storage and is
a grandfathered nonconforming use under the current zoning, but is substandard as
detailed in the Memo dated January 7, 2005 attached as Exhibit "C", which outlines the
Business Occupancy Inspection of the Property and the results of that inspection; and
WHEREAS, the owner has proposed to sell the Property to an experienced
storage and mini -warehouse owner/operator, who proposed to remove the open

storage and instead construct 5 new storage buildings and remodel the interior of
existing Building "I" in addition to a portion of Building "C", and otherwise upgrade the
Property, as shown on the Site Plan dated Feb 23, 2005 prepared by Osborn & Vane
Architects attached as Exhibit "D"; and
WHEREAS, on the 15th day of November, 2004, a Joint Public Hearing was held
before the Planning and Zoning Commission and the City Council of the City of
Pearland, Texas, notice being given by publication in the official newspaper of the City,
the affidavit of publication being attached thereto and made a part hereof for all
purposes, as Exhibit "C", said call and notice being in strict conformity with provisions of
Section 28.3 and 28.4 of Ordinance No. 509; and
WHEREAS, on the 2nd day of December, 2004, the Planning and Zoning
Commission of the City submitted its report and recommendation to the City Council
regarding the proposed amendment application by Robert McConnell and GJR
Investment Management, Inc., applicant for Texas No. 4, Ltd., owner, whereby the
Commission recommended approval of the change of classification for the Property
from its existing classification of Commercial District (C) to General Business District —
Specific Use Permit (GB(S)), for storage and mini -warehouse; and
WHEREAS, upon receipt of the report from the Planning and Zoning
Commission, the City Council considered this application and the recommendation of
the Planning and Zoning Commission at a regular meeting on December 13, 2004; and
WHEREAS, the City Council having fully heard the testimony and argument of all
interested parties, and having been fully advised in the premises, finds that in the case
of the application of Robert McConnell and GJR Investment Management, Inc.,
applicant for Texas No. 4, Ltd., owner, presented which, in the judgment of the City
Council, would justify the approval of said application; now, therefore,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
I.
The following described property located within the corporate City limits of the
City of Pearland, Texas, and presently classified as Commercial District (C) is hereby
zoned to General Business District — Specific Use Permit (GB(S)), a Specific Use
Permit for storage and mini -warehouse, subject to compliance with the following
conditions:
1) The applicant/owner, or a successor owner of the Property, shall bring the
existing structures into compliance with the requirements for existing buildings
identified on Exhibit "D" and Exhibit "E", attached hereto and made a part hereof
by reference. All new structures must be constructed in accordance with
applicable City codes and ordinances and the "Masonry Facade Treatment",
"Landscaping" and "Fire Sprinkler Systems" paragraphs of Exhibit "D" and as
shown on Exhibit "E"; and
2) The applicant/owner, or successor owner, shall construct masonry, ornamental
metal, and chain -link fencing in accordance with the Fencing Requirements as
shown on Exhibit "E"; and
3) No certificate of occupancy, whether temporary or permanent, shall be issued
for a new building until compliance with all the terms of this ordinance as it
applies to a particular new building has been demonstrated. ;
and such property being more particularly described as:

Broadway, Pearland, Texas and being located on the North Side of FM 518 (Broadway
Street), and East of Hamm Road)
II.
The City Council of the City of Pearland finds and determines that the recitations
in the preamble hereof are true and that all necessary prerequisites of law have been
accomplished and that no valid protest of the proposed change has been made. The
City Council further finds and determines that there has been compliance with the
mandates of law in the posting and presentation of this matter to the Planning and
Zoning Commission and to the City Council for consideration and decision.
III.
The City Council of the City of Pearland finds and determines that the
amendment adopted herein promotes the health, safety, and general welfare of the
public and is a proper valid exercise of the City's police powers.
IV.
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance
is for any reason held invalid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct, and independent provision and such
holding shall not affect the validity of the remaining portions thereof.
V.
All rights and remedies, which have accrued in the favor of the City under this
Ordinance and its amendments thereto, shall be and are preserved for the benefit of
the City.

VI.
The City Secretary is hereby directed to cause to be prepared an amendment to
the official Land Use District Map of the City, pursuant to the provisions of Section 2 of
Ordinance No. 509 and consistent with the approval herein granted for the
reclassification of the herein above described property.
VII.
This Ordinance shall become effective after its passage and approval on second
and final reading.

Honorable Mayor and Council Members:
At their regular meeting of November 15, 2004 the Planning and Zoning Commission considered
the request for a zone classification change from Commercial District (C) to General Business
District (GB) — Specific Use Permit (GB)(S) for storage and mini -warehouse on the following
property:
Legal Description: 3,144). acres, Willetts Subdivision, Abstract 70, W.D.C. Hall
Survey, Lot 2, 2C, 2D, 2C1, 2D1 and 2E, City of Pearland, Brazoria County,
Texas (generally located on the north side of FM 518 (Broadway Street) and east
of Hamm Road).
Commissioner Greiner made a motion to approve and Commissioner Dumont seconded. After
discussion regarding compliance with city codes, outside storage and the appearance of the
facility, the Commission voted 4-2 to amend the motion to include certain conditions.
Commissioner West and Commissioner Ransom voted against the amended motion.
The final motion was to approve, with the following stipulations:
1. The applicant/owner comply with all city codes and ordinances applicable, and that no
Certificate of Occupancy shall be issued, whether temporary or permanent, until the
entire property is brought into compliance with all city codes and ordinances.

2. The applicant/owner construct an 8-foot high, 100% opaque masonry fence where the

As requested by Mr. Christopher Bynum (GJR Management Holdings), the City performed
required inspections (1/7/05) for Business Occupancy at 1919 Broadway (Self -Storage) to
establish compliance issues prior to business occupancy "as is" and/or "as modified with
additions." The following is a summary of the inspections result:
Buy Building and Move in "As is" without rezoning the property: Existing property and
structures will require the following corrections:
ADA Accessibility
■ Striped parking spaces
■ Handicap parking paces
• Handicap ramp into building
• Handicap signs
• Public}estrooms should be ADA accessible, i.e., wheelchair, rails, etc.

3) Remodeling of existing building that is greater than 50% of the value of the
building
This is not a permit.
The City's checklist represents the City's best estimate of required improvements based
on the information provided by the applicant. Additional improvements may be required
once the applicant submits final plans and a pre -development meeting is held to make a
final determination of required improvements.

IV.
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance
is for any reason held invalid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct, and independent provision and such
holding shall not affect the validity of the remaining portions thereof.
V.
All rights and remedies, which have accrued in the favor of the City under this
Ordinance and its amendments thereto, shall be and are preserved for the benefit of
the City.

At their regular meeting of November 15, 2004 the Planning and Zoning Commission considered
the request for a zone classification change from Commercial District (C) to General Business
District (GB) — Specific Use Permit (GB)(S) for storage and mini -warehouse on the following
property:
Legal Description: 2.00 acres, Willetts Subdivision, Abstract 70, W.D.C. Hall
Survey, Lot 2, 2C, 2D, 2C1, 2D1 and 2E, City of Pearland, Brazoria County,
Texas (generally located on the north side of FM 518 (Broadway Street) and east
of Hamm Road).
Commissioner Greiner made a motion to approve and Commissioner Dumont seconded. After
discussion regarding compliance with city codes, outside storage and the appearance of the
facility, the Commission voted 4-2 to amend the motion to include certain conditions.
Commissioner West and Commissioner Ransom voted against the amended motion.
The original motion to approve, with the following amendments from the amended motion, was
approved 6-0:
1. The applicant/owner comply with all city codes and ordinances applicable, and that no
Certificate of Occupancy shall be issued, whether temporary or permanent, until the
entire property is brought into compliance with all city codes and ordinances.

CONFORMANCE TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE: The
applicant is requesting a GB zoning district. The subject property meets the size
requirements of the GB district.
The applicant will be responsible for complying with all other space limitations of the GB
zoning district, such as yard setback requirements and lot coverage.
Further, the GB zone does not permit outdoor storage or display. The applicant will be
required to remove all vehicles and outside storage. A 6 foot high opaque masonry
screening fence will be required due to the adjacent residential zoning district. The existing
facility does not meet the building facade, landscaping regulations, and other ordinance
requirements.
CONFORMANCE TO THE COMPREHENSIVE PLAN: The Comprehensive Plan (2004
update adopted on July 26, 2004) recommends "Retail, Office, and Service Uses" for the
subject property and for the surrounding properties on Broadway Street. The
Comprehensive Plan further indicates that the appropriate zoning districts and guidelines
for Retail, Office, and Service Uses are the Office and Professional District.(OP), the.
Neighborhood Service District (NS), and the General Business District (GB). Therefore,
the proposed zone change to GB conforms to the Comprehensive Plan.

CONFORMANCE TO THE THOROUGHFARE PLAN: The subject property has frontage
on Broadway Street (FM 518), a major thoroughfare with an ultimate right-of-way of 120
feet. No other roadways affect the subject property.
It has not yet been determined if the subject property will be required to be platted in
accordance with the Subdivision Ordinance. If platting is required, then a dedication of
right-of-way may be required along FM 518 (Broadway Street). A traffic impact analysis
(TIA) would also be required at the time of platting or issuance of a building permit.
IMPACT ON EXISTING AND FUTURE DEVELOPMENT: The subject property and any
expansion of the facility may have impacts on the surrounding properties. The subject
property currently contains storage buildings, as well as the storage of vehicles, boats,
campers, and recreational vehicles. A wooden fence currently exists between the subject
property and the single family residences to the north.
If the proposed specific use permit is approved, and the facility expanded, Staff would
recommend that the applicant bring the entire facility into compliance with the Land Use
and Urban Development Ordinance, including building facade requirements, landscaping
requirements, screening requirements, as well as other ordinances. ,
The attached preliminary site plan and elevation drawings are submitted for informational
purposes only and are conceptual in nature, and have not yet been reviewed for
compliance with all applicable ordinances. A complete review will be conducted with the
applicant applies for a building permit.
PUBLIC COMMENTS: Public notice/comment forms were mailed to property owners
within 200 feet of the subject property under consideration. A legal notice of public hearing
was published in the local newspaper, and a Zoning Sign was placed on the subject
property.
STAFF RECOMMENDATION: Staff recommends approval of the zone change for
General Business District (GB), with a Specific Use Permit; as proposed by the applicant,
for the following reasons:
1. The proposed zone change to General Business District with a Specific Use Permit
conforms to the Comprehensive Plan designation of Retail, Office, and Service
Uses.
2. The proposed zone change would be consistent with the existing General Business
Zone Change Application No. 1200 and SUP 138

3. The subject property is currently developed with a non -conforming storage and mini -

4. The Specific Use Permit could be approved with a condition that the applicant bring
the existing facility into compliance with all City codes and ordinances, including
outdoor storage, fencing, landscaping, parking, building facades, and all other
applicable ordinances.
5. All outdoor storage, junk vehicles, etc, be cleared before a building permit for
expansion is approved, unless otherwise stated in the Specific .Use Permit
ordinance. A certificate of occupancy would be granted when the entire property is
brought up to compliance with all codes.

EXECUTIVE SUMMARY
The above referenced ordinance was previously tabled by the City Council to allow staff to
work with the applicant to clarify the facade requirements associated with the improvements planned
for the property. If you recall, the P&Z approved the zoning request contingent upon the property
being improved in compliance with City ordinances and regulations. In addition, the P&Z required,
as a condition of approval, the construction of an 8-foot high masonry wall to be constructed along
the boundary of the property that abuts residential properties. Since that time, staff has met with
representatives of the applicant in an effort to develop a list, although not exhaustive, of the
improvements that must be made in order to comply with the City's regulations (see Exhibit "D").
Similarly, a layout of the property that identifies the fencing and facade requirements has been
incorporated (see Exhibit "E") to further clarify those requirements.

SUMMARY: The applicant is requesting a change in zoning on the subject property from
Commercial District to General Business District, with a Specific Use Permit for storage
and mini -warehouse. The subject property is currently developed with a mini -storage
facility that does not have an existing specific use permit, as it was constructed in the
Commercial District when a mini-storagefacility was a permitted use in the Commercial
District. Since then, the ordinance has been changed to require all mini -storage facilities to
have an approved Specific Use Permit in certain zoning districts.
The applicant is requesting the zone change and specific use permit in order to bring the
subject property into compliance with the Land Use Ordinance, and to allow for expansion
of the facility.

CONFORMANCE TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE: The
applicant is requesting a GB zoning district. The subject property meets the size
requirements of the GB district.
The applicant will be responsible for complying with all other space limitations of the GB
zoning district, such as yard setback requirements and lot coverage.
Further, the GB zone does not permit outdoor storage or display. The applicant will be
required to remove all vehicles and outside storage. A 6 foot high opaque masonry
screening fence will be required due to the adjacent residential zoning district. The existing
facility does not meet the building facade, landscaping regulations, and other ordinance
requirements.
CONFORMANCE TO THE COMPREHENSIVE PLAN: The Comprehensive Plan (2004
update adopted on July 26, 2004) recommends "Retail, Office, and Service Uses" for the
subject property and for the surrounding properties on Broadway Street. The
Comprehensive Plan further indicates that the appropriate zoning districts and guidelines
for Retail, Office, and Service Uses are the Office and Professional District (OP), the.
Neighborhood Service District (NS), and the General Business District (GB). Therefore,
the proposed zone change to GB conforms to the Comprehensive Plan.

CONFORMANCE TO THE THOROUGHFARE PLAN: The subject property has frontage
on Broadway Street (FM 518), a major thoroughfare with an ultimate right-of-way of 120 ,
feet. No other roadways affect the subject property.
It has not yet been determined if the subject property will be required to be platted in
accordance with the Subdivision Ordinance. If platting is required, then a dedication of
right-of-way may be required along FM 518 (Broadway Street). A traffic impact analysis
(TIA) would also be required at the time of platting or issuance of a building permit.
IMPACT ON EXISTING AND FUTURE DEVELOPMENT: The subject property and any
expansion of the facility may have impacts on the surrounding properties. The subject
property currently contains storage buildings, as well as the storage of vehicles, boats,
campers, and recreational vehicles. A wooden fence currently exists between the subject
property and the single family residences to the north.
If the proposed specific use permit is approved, and the facility expanded, Staff would
recommend that the applicant bring the entire facility into compliance with the Land Use
and Urban Development Ordinance, including building fagade requirements, landscaping
requirements, screening requirements, as well as other ordinances.
The attached preliminary site plan and elevation drawings are submitted for informational
purposes only and are conceptual in nature, and have not yet been reviewed for
compliance with all applicable ordinances. A complete review will be conducted with the
applicant applies for a building permit.
PUBLIC COMMENTS: Public notice/comment forms were mailed to property owners
within 200 feet of the subject property under consideration. A legal notice of public hearing
was published in the local newspaper, and a Zoning Sign was placed on the subject
property.
STAFF RECOMMENDATION: Staff recommends approval of the zone change for
General Business District (GB), with a Specific Use'Permit; as proposed by the applicant,
for the following reasons:
1. The proposed zone change to General Business District with a Specific Use Permit
conforms to the Comprehensive Plan designation of Retail, Office, and Service-
Uses.
2. The proposed zone change would be consistent with the existing General Business ..

Districts and land uses along Broadway Street.
3. The subject property is currently developed with a non -conforming storage and mini-
warehouse facility, and the proposed zone change and specific use permit would
bring the use into compliance with the Land Use Ordinance.
4. The Specific Use Permit could be approved with a condition that the applicant bring
the existing facility into compliance with all City codes and ordinances, including
outdoor storage, fencing, landscaping, parking, building facades, and all other
applicable ordinances.
5. All outdoor storage, junk vehicles, etc, be cleared before a building permit for
expansion is approved, unless otherwise stated in the Specific Use Permit
ordinance. A certificate of occupancy would be granted when the entire property is
brought up to compliance with all codes.
