Ord. 2000M-180 2019-10-22 Ordinance No. 2000M-180 An Ordinance of the City Council of the City of Pearland, Texas, amending Ordinance No. 2000M, the zoning map of the City of Pearland, Texas, for the purpose of changing the classification of certain property, Lot 3 in Block 1 being 7.443 acres of a subdivision of 11.759 acres located in the H.T. B. R.R. Co. Survey, Abstract No. 546 in the City of Pearland, Brazoria County, Texas. (South of 7110 Magnolia Road) Zone Change Application No. ZONE 18-00022, a request by Alan Mueller, applicant, on behalf of Marilyn Bullard, owner; for approval of amendments to the regulations of the Midtown at Magnolia Planned Development regarding the townhome development tract; on approximately 7.443 acres of land; providing for an amendment of the zoning district map; containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. WHEREAS, Alan Mueller, applicant, on behalf of Marilyn Bullard, owner; are requesting approval of an amendment to the regulations of the Midtown at Magnolia Planned Development regarding the townhome development tract; on approximately 7.443 acres of land on the following described property; said property being legally described in the legal description attached hereto and made a part hereof for all purposes as Exhibit "A," and more graphically depicted in the vicinity map attached hereto and made a part hereof for all purposes as Exhibit "B"; and WHEREAS, on the 28th day of January 2019, a Joint Public Hearing was held before the Planning and Zoning Commission and the City Council of the City of Pearland, Texas, notice being given by publication in the official newspaper of the City, the affidavit of publication being attached hereto and made a part hereof for all purposes as Exhibit "C," said call and notice being in strict conformity with provisions of Section 1.2.2.2 of Ordinance No. 2000T; and WHEREAS, on the 29th day of January 2019, the Planning and Zoning Commission submitted its report and recommendation to the City Council regarding the proposed amendment to the regulations of the Midtown at Magnolia Planned Development regarding the townhome development tract on approximately 7.443 acres of land, said recommendation attached hereto and made a part hereof for all purposes as Exhibit "D"; and WHEREAS, upon receipt of the report from the Planning and Zoning Commission, City Council considered this application and the recommendation of the Planning and Zoning Commission at regular meetings on the 11th day of February 2019 and the 25th day of February 2019; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and having been fully advised in the premises, finds that in the case of the application of Alan Mueller, applicant, on behalf of Marilyn Bullard, owner; for approval of amendment to the regulations of the Midtown at Magnolia Planned Development regarding the townhome development tract; on approximately 7.443 acres of land; presented which, in the judgment of the City Council, would justify the approval of said application; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section I. The following described property located within the corporate City Limits of the City of Pearland, Texas, and presently being located within the Planned Development zoning district, is hereby granted approval of amendments to the text within the Midtown at Magnolia Planned Development regarding development of the townhouse tract, and the Midtown at Magnolia PD amendment #2 attached hereto and made a part hereof for all purposes as Exhibit "E", in accordance with all conditions and Page 2 of 8 Ord. No. 2000M-180 requirements of the current Unified Development Code and the following conditions approved by the City Council and incorporated for all purposes, such property being more particularly described as: Legal Description: Lot 3 in Block 1 being 7.443 acres of a subdivision of 11.759 acres located in the H.T. B. R.R. Co. Survey, Abstract No. 546 in the City of Pearland, Brazoria County, Texas. General Location: South of 7110 Magnolia Road, Pearland TX. Section II. The City Council of the City of Pearland finds and determines that the recitations in the preamble hereof are true and that all necessary prerequisites of law have been accomplished and that no valid protest of the proposed change has been made. The City Council further finds and determines that there has been compliance with the mandates of law in the posting and presentation of this matter to the Planning and Zoning Commission for consideration and decision. Section III. The City Council of the City of Pearland finds and determines that the amendment adopted herein promotes the health, safety, and general welfare of the public and is a proper valid exercise of the City's police powers. Section IV. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section V. All rights and remedies, which have accrued in the favor of the City under this Ordinance and its amendments thereto, shall be and are preserved for the benefit of the City. No. 2000M-180 Exhibit E Midtown at Magnolia Amendment #2 As to Tract 3 - Townhomes OIN.4101114 app, December 11, 2018 Midtown at Magnolia Amendment #2 As to Tract 3 - Townhomes A Introduction This amendment pertains only to the Townhome Tract 3 (now platted as Lot 3, Block 1, Midtown at Magnolia). Unless specifically described in this amendment,all conditions of the original PD as amended remain in effect. The original PD, approved in 2016, was amended on October 22, 2018. This Amendment#2 is intended to correct an error to accommodate 24-foot wide interior lots instead of the 25-foot wide lot minimum stated in Amendment#1 and provides alternate setbacks to accommodate Centerpoint utility easement requirements. 1. Description of the Property From the original PD,Tract 1 has been developed as a CVS pharmacy;Tracts 2 and 3 remain vacant and undeveloped. Subsequent to approval of the PD,the property has been platted into 3 lots consistent with the original PD. 2. Description of Proposed Development The proposed development of Lot 3 consists of 44 individual townhome lots. 3. Description of the Area The land subject to this amendment consists of Lot 3, Block 1, Midtown at Magnolia plat, containing 7.443 acres. 4. Purpose The purpose of this amendment is to modify the minimum lot width from 25 feet to 24 feet to accommodate the internal lot width requirements of the builder. Additionally, the rear setback on lots 1 and 3 is modified to six feet to accommodate front underground Centerpoint utility easements. This arrangement will allow the required 14-foot Centerpoint easement to be located behind the ten-foot water/sewer easement to effectively create a 24-foot front setback. All lots that will have a six-foot rear yard setback back up to open space. 5. Comprehensive Plan Conformance This amendment is consistent with the Comprehensive Plan. 6. Applicability The applicability analysis form the original PD remains valid and unchanged. 1 B Zoning and Land Use 1. Existing Zoning The property is currently zoned under the Midtown at Magnolia PD approved by Ordinance 2000M-142 on February 8, 2016 and amended by Ordinance 2000M-175 on October 22, 2018. 2.
