A Resolution of the City Council of the City of Pearland,Texas,authorizing the
City Manager or his designee to enter into a contract with Alliance
Transportation Group, in the amount of $389,404.00, for design services
associated with the Pearland Parkway Traffic Circle Project.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain contract by and between the City of Pearland and Alliance
Transportation Group, a copy of which is attached hereto as Exhibit"A" and made a part hereof for
all purposes, is hereby authorized and approved.
Section 2. That the City Manager or his designee is hereby authorized to execute, and
the City Secretary to attest, a contract with Alliance Transportation Group for design services
associated with the Pearland Parkway Traffic Circle Project.

Exhibit A
CONTRACT FOR PROFESSIONAL SERVICES
THIS CONTRACT is entered into upon final execution by and between the City of Pearland
("CITY") and Alliance Transportation Group, Inc. (Alliance Texas Engineering Company)
("CONSULTANT").
The CITY engages the CONSULTANT to perform professional services for a project known and
described as Pearland Parkway Traffic Circle Modifications ("PROJECT"). (Project#TR1903)
SECTION I-SERVICES OF THE CONSULTANT
The CONSULTANT shall perform the following professional services to CITY standards and in
accordance with the degree of care and skill that a professional in Texas would exercise under the
same or similar circumstances:
A. The CONSULTANT shall perform engineering services. See Exhibit A, attached,
for a detailed SCOPE OF WORK and PROJECT schedule.The PROJECT schedule
shall be submitted in digital and hard copy form in the Microsoft Project for
Windows format.
B. The CONSULTANT shall prepare and submit a detailed opinion of estimated cost
of the PROJECT.
C. The CONSULTANT acknowledges that the CITY (through its employee
handbook)considers the following to be misconduct that is grounds for termination
of a CITY employee: Any fraud, forgery, misappropriation of funds, receiving
payment for services not performed or for hours not worked, mishandling or
untruthful reporting of money transactions, destruction of assets, embezzlement,
accepting materials of value from vendors, or consultants, and/or collecting
reimbursement of expenses made for the benefit of the CITY. The CONSULTANT
agrees that it will not, directly or indirectly; encourage a CITY employee to engage
in such misconduct.
D. The CONSULTANT shall submit all final construction documents in both hard
copy and electronic format. Plans shall be AutoCAD compatible and all other
documents shall be Microsoft Office compatible. The software version used shall
be compatible to current CITY standards. Other support documents, for example,
structural calculations, drainage reports and geotechnical reports, shall be
submitted in hard copy only. All Record Drawings electronic files shall be
submitted to the CITY in TIF format.
E. The CONSULTANT recognizes that all drawings, special provisions, field survey
notes,reports,estimates and any and all other documents or work product generated
by the CONSULTANT under the CONTRACT shall be delivered to the CITY upon
request, shall become subject to the Open Records Laws of this State.
F. The CONSULTANT shall procure and maintain for the duration of this Agreement,
insurance against claims for injuries to persons, damages to property, or any errors

and omissions relating to the performance of any work by the CONSULTANT, its
agents, employees or subcontractors under this Agreement, as follows:
(1) Workers' Compensation as required by law.
(2) Professional Liability Insurance in an amount not less than $1,000,000 in
the aggregate.
(3) Comprehensive General Liability and Property Damage Insurance with
minimum limits of $1,000,000 for injury or death of any one person,
$1,000,000 for each occurrence, and $1,000,000 for each occurrence of
damage to or destruction of property.
(4) Comprehensive Automobile and Truck Liability Insurance covering owned,
hired, and non-owned vehicles, with minimum limits of $1,000,000 for
injury or death of any one person, $1,000,000 for each occurrence, and
$1,000,000 for property damage.
The CONSULTANT shall include the CITY as an additional insured under the
policies, with the exception of the Professional Liability Insurance and Workers'
Compensation. The CONSULTANT shall agree to waive its Right to Subrogation.
Certificates of Insurance and endorsements shall be furnished to the CITY before
work commences. Each insurance policy shall be endorsed to state that coverage
shall not be suspended, voided, canceled, and/or reduced in coverage or in limits
("Change in Coverage") except with prior written consent of the CITY and only
after the CITY has been provided with written notice of such Change in Coverage,
such notice to be sent to the CITY either by hand delivery to the City Manager or
by certified mail, return receipt requested, and received by the City no fewer than
thirty (30) days prior to the effective date of such Change in Coverage. Prior to
commencing services under this CONTRACT,CONSULTANT shall furnish CITY
with Certificates of Insurance, or formal endorsements as required by this
CONTRACT, issued by CONSULTANT'S insurer(s), as evidence that policies
providing the required coverage, conditions, and limits required by this
CONTRACT are in full force and effect.
G. The CONSULTANT shall indemnify and hold the CITY, its officers, agents, and
employees,harmless from any claim, loss, damage, suit, and liability of every kind
for which CONSULTANT is legally liable, including all expenses of litigation,
court costs, and attorney's fees, for injury to or death of any person, for damage to
any property, or errors in design, any of which are caused by the negligent act or
omission of the CONSULTANT,his officers,employees,agents, or subcontractors
under this CONTRACT.
H. All parties intend that the CONSULTANT, in performing services pursuant to this
CONTRACT, shall act as an independent contractor and shall have control of its
own work and the manner in which it is performed. The CONSULTANT is not to
be considered an agent or employee of the CITY.

SECTION II-PERIOD OF SERVICE
This CONTRACT will be binding upon execution and end June 30, 2022.
SECTION III -CONSULTANT'S COMPENSATION
A. The total compensation for the services performed shall not exceed the total noted
in Section B.
B. The CITY shall pay the CONSULTANT in installments based upon monthly
progress reports and detailed invoices submitted by the CONSULTANT based
upon the following:
1. Basic Services (Lump Sum) $324,483.00
2. Additional Services shall require independent and specific authorization
and shall be billed as (Hourly Not to Exceed): $0.00
3. Bid Phase Services (Hourly Not to Exceed) $17,362.00
4. Construction Phase Services (Hourly Not to Exceed) $45,727.00
5. Reimbursable Expenses (Not to Exceed) $1,832.00
6. Total: $389,404.00
C. The CITY shall make payments to the CONSULTANT within thirty(30)days after
receipt and approval of a detailed invoice. Invoices shall be submitted on a monthly
basis.
D. CONSULTANT shall invoice for work performed during the preceding thirty day
period("Billing Period"). The Billing Period shall run from the 26th day to the 25th
day of each consecutive month. Invoices shall be submitted to CITY not more
frequently than once every 30 days. CONSULTANT shall be responsible for
timely submittal of all invoices and CONSULTANT shall not be entitled to
payment for invoices in arrears. All invoices shall reflect most recent single Billing
Period only and represent the true, correct and accurate account of work performed
during the Billing Period.
E. For an agreed contract amount identified as "Lump Sum", Not to Exceed" and
"Reimbursable"the CONSULTANT shall not exceed the fixed contractual amount
without written authorization in the form of a Contract Amendment.
CONSULTANT shall provide 45 days prior notice to the CITY in the event contract
fees may exceed the fixed contract amount. CONSULTANT shall be responsible
for ensuring that such authorization is complete and executed by all parties
performing any work or submitting any invoices for work that exceeds the fixed
contract amount under any expense category.

F. Allowable Reimbursable Expenses
CONSULTANT shall identify and include in the proposal any anticipated
Reimbursable Expenses, and shall itemize Reimbursable Expenses by work
category. Reimbursable Expenses shall be invoiced AT COST without subsequent
markup by the CONSULTANT. All invoices containing a request for
Reimbursable Expenses shall include copies of the original expense receipts
itemized per the allowable category. Allowable Reimbursable Expenses include:
• Hard copy reproductions, copies and/or binding costs
• Postage
• Mileage, for travel from Consultant's local office (within a 25 mile radius)
to meetings at the City or job-site. Mileage shall be charged at the current
IRS rates.
• Travel expenses, mileage from local office to State or federal regulatory
agency office beyond 100 miles.
• Lodging expenses, for destinations beyond 100 miles from the Consultant's
local office AND when business hours exceed eight hours within one
business day OR requires more than one eight hour day.
F.2. Disallowed Expenses
Disallowed Expenses include travel expenses for professional expertise traveling
into the greater Houston area from Consultant offices outside of the greater Houston
area.
SECTION IV-THE CITY'S RESPONSIBILITIES
A. The CITY shall designate a project manager during the term of this CONTRACT.
The project manager has the authority to administer this CONTRACT and shall
monitor compliance with all terms and conditions stated herein. All requests for
information from or a decision by the CITY on any aspect of the work shall be
directed to the project manager.
B. The CITY shall review submittals by the CONSULTANT and provide prompt
response to questions and rendering of decisions pertaining thereto, to minimize
delay in the progress of the CONSULTANT'S work. The CITY will keep the
CONSULTANT advised concerning the progress of the CITY'S review of the
work. The CONSULTANT agrees that the CITY'S inspection,review, acceptance
or approval of CONSULTANT'S work shall not relieve CONSULTANT'S
responsibility for errors or omissions of the CONSULTANT or its sub-
consultant(s) or in any way affect the CONSULTANT'S status as an independent
contractor of the CITY.

SECTION V-TERMINATION
A. The CITY, at its sole discretion, may terminate this CONTRACT for any reason--
with or without cause--by delivering written notice to CONSULTANT personally
or by certified mail at 11500 Metric Blvd., Bldg. Ml, Ste. 150, Austin, TX 78758.
Immediately after receiving such written notice, the CONSULTANT shall
discontinue providing the services under this CONTRACT.
B. If this CONTRACT is terminated, CONSULTANT shall deliver to the CITY all
drawings, special provisions, field survey notes, reports, estimates and any and all
other documents or work product generated by the CONSULTANT under the
CONTRACT, entirely or partially completed, together with all unused materials
supplied by the CITY on or before the 15thi day following termination of the
CONTRACT.
C. In the event of such termination, the CONSULTANT shall be paid for services
performed prior to receipt of the written notice of termination. The CITY shall
make final payment within sixty(60) days after the CONSULTANT has delivered
to the CITY a detailed invoice for services rendered and the documents or work
product generated by the CONSULTANT under the CONTRACT.
D. If the remuneration scheduled under this contract is based upon a fixed fee or
definitely ascertainable sum,the portion of such sum payable shall be proportionate
to the percentage of services completed by the CONSULTANT based upon the
scope of work.
E. In the event this CONTRACT is terminated, the CITY shall have the option of
completing the work, or entering into a CONTRACT with another party for the
completion of the work.
F. If the CITY terminates this CONTRACT for cause and/or if the CONSULTANT
breaches any provision of this CONTRACT, then the CITY shall have all rights
and remedies in law and/or equity against CONSULTANT. Venue for any action
or dispute arising out of or relating to this CONTRACT shall be in Brazoria County,
Texas. The laws of the State of Texas shall govern the terms of this CONTRACT.
The prevailing party in the action shall be entitled to recover its actual damages
• with interest, attorney's fees, costs and expenses incurred in connection with the
dispute and/or action. CONSULTANT and CITY desire an expeditious means to
resolve any disputes that may arise between under this CONTRACT. To
accomplish this, the parties agree to mediation as follows: If a dispute arises out of
or relates to this CONTRACT, or the breach thereof, and if the dispute cannot be
settled through negotiation, then the parties agree first to try in good faith, and
before pursuing any legal remedies, to settle the dispute by mediation of a third
party who will be selected by agreement of the parties.

SECTION VI—ENTIRE AGREEMENT
This CONTRACT represents the entire agreement between the CITY and the CONSULTANT and
supersedes all prior negotiations, representations, or contracts, either written or oral. This
CONTRACT may be amended only by written instrument signed by both parties.
SECTION VII—COVENANT AGAINST CONTINGENT FEES
The CONSULTANT affirms that he has not employed or retained any company or person, other
than a bona fide employee working for the CONSULTANT to solicit or secure this CONTRACT,
and that he has not paid or agreed to pay any company or person,other than a bona fide employee,
any fee, commission,percentage brokerage fee, gift, or any other consideration, contingent upon
or resulting from the award or making of the CONTRACT. For breach or violation of this clause,
the CITY may terminate this CONTRACT without liability,and in its discretion,may deduct from
the CONTRACT price or consideration, or otherwise recover, the full amount of such fee,
commission,percentage brokerage fee,gift, or contingent fee that has been paid.
SECTION VIII-SUCCESSORS AND ASSIGNS
This CONTRACT shall not be assignable except upon the written consent of the parties hereto.

SCOPE OF SERVICES
FOR
2019 Bond Projects

BASIC SERVICES: The Consultant shall render the following professional
engineering services to the OWNER in connection with the preparation of Plans,
Specifications and Construction Cost Estimate for Final Design of the proposed
Roundabout improvements at Pearland Parkway and McHard Road.
1) Traffic Engineering
a) Traffic data will be collected for the AM and PM peak hours. The data
collection will consist of peak hour Turning Movement Counts (TMCs) and
24-hour bi-directional traffic volumes.
b) Field observations shall be performed during the AM and PM peak hours
to observe queues and operational behavior.
c) Traffic projections to years 2021 and 2041 for the No-Build and Build
Conditions will be completed using the collected traffic data and a
compounding annual growth rate. Adjustment to the year 2021 and 2041
traffic counts will be made for the opening of the McHard Road extension.
This adjustment will be completed using information prepared for the
McHard Road extension project or information from H-GAC's Travel
Demand Model. No revisions to the Travel Demand Model will be made
as part of this project. No traffic forecasting for the McHard Road
extension will be completed as part of this project. Approval on the growth
rate to be used shall be obtained from the city prior to completing volume
projections and operational analysis.
d) The Engineer shall use VISSIM version 11 to model the conversion of the
existing traffic circle to a roundabout at the intersection of McHard Road
and Pearland Parkway. The calibration of the existing model shall use
FHWA methods and best practices. Measures of Effectiveness (MOEs) to
be used in calibration and analysis shall include volume throughput, delay
and queues. The following scenarios shall be completed and incorporated
into a report summarizing the results:

i) Deliverables:
(1) Traffic Engineering Operational Analysis Report
2) Topographical and Boundary Survey
a) Surveyor shall perform a topographic survey that meets The Manual of
Practice for Land Surveying in the State of Texas for a Category 6,
Condition 2 topographic survey. The horizontal datum will be based on
the Texas State Plane Coordinate System, Zone 4204, South Central
Zone with elevation tie to Pearland Monumentation. The extents of the
topographic survey will be:
i) Along Pearland Pkwy north of the roundabout for 2,250 feet.
ii) Along Pearland Pkwy south of the roundabout for 1,300 feet.
iii) Along McHard Road west of the roundabout for 1,000 feet.
b) Topographic survey will extend from ROW to ROW where proposed
roundabout improvements are shown and from the edge of closest travel
lane to the ROW where only sidewalk improvements are shown on the
attached exhibit.
c) Existing Right of Way will be located and shown meeting Category 1a,
Condition 2 standards of the Manual of Practice for Land Surveying in the
State of Texas. Natural and structural features that will be gathered in the
field are as follows:
i) Back of Curb and Gutter located along the concrete roadway
ii) Centerline of roadway
iii) Natural ground within the median and within the ROW of the roadways
at a maximum 50' grid
iv) Lane Lines and Pedestrian Crossings

v) All above ground features within the Right of Way (fire hydrants, power
and traffic poles, signal boxes, man holes, water valves, etc.)
vi) Traffic Signal Sensors within the roadway
vii) Sanitary and Storm Systems within the project corridor and one
junction (i.e. man hole or inlet) outside of project corridor
viii)All trees within the Right of Way within the project corridor MBCO will
perform a Level B SUE concerning all underground utilities in the
project corridor. MBCO will deliver a CAD file in 2016 .dwg format
containing a DTM surface model along with a CSV fill of all points.
i) Deliverables:
(1) Topographic sheets showing the topographic survey, roadway
Right of Way, and adjoining land owners on 22x34 sheets.
(2) Signed and sealed copy of the survey.
3) Geotechnical Engineering
a) The Engineer shall drill and sample four (4) 10-foot borings, perform
laboratory tests and prepare a geotechnical report including pavement
recommendations and subgrade preparation for the proposed roundabout.
b) The Engineer shall utilize Design Year (2041) project traffic volumes
obtained from the Traffic Engineering analysis in developing ESAL's for
the pavement design.
i) Deliverables:
(1) A Geotechnical Engineering Report, including field and laboratory
data and Portland Cement Concrete pavement recommendations.

4) Environmental Services: Engineer shall engage Environmental
consultant to conduct the following:
a) Preliminary Wetland and Waterbody Assessment:
In order to identify any potential wetlands or waterbodies on the subject
property, Environmental consultant will review the following available
records and databases:
i) Current and Historical aerial photographs
ii) Color infrared imagery
iii) Federal Emergency Management Agency (FEMA) 100-year
floodplain data
iv) Historical United States Geological Survey (USGS) topographic
maps
v) Natural Resources Conservation Service (NRCS) soils data
vi) United States Fish and Wildlife Service (USFWS) National
Wetlands Inventory (NWI) data
vii) USGS National Hydrography Dataset (NHD) watershed data
viii)Light Detection and Ranging (LiDAR) map
Environmental Consultant will summarize the relevant data with regard to
the presence of wetland and waterbodies on the subject property in a
letter report. A preliminary assessment will not determine the size of
wetlands present, or determine United States Army Corps of Engineers
(USACE)jurisdiction. The final jurisdictional determination for all aquatic
resources on the subject property can only be made by the USACE after a
formal delineation.
b) Jurisdictional Delineation and USACE Verification (Optional): If
Preliminary Wetland and Waterbody Assessment identifies any potential
wetlands or waterbodies on the subject property, Engineer shall engage
Environmental consultant to conduct Jurisdictional Delineation and
USACE Verification as additional services, with prior approval from City.

In order to determine if any potentially jurisdictional WOUS exist on the
Subject Property, Environmental consultant will delineate the boundaries
of all aquatic features and determine their potential jurisdictional status
through records and literature review, intensive field surveys, and
coordination with the USAGE and the Environmental Protection Agency
(EPA). Environmental consultant will identify and delineate the following
within the project site:
ix) All potential jurisdictional WOUS, including wetlands
x) All non-jurisdictional wetlands
xi) All non-jurisdictional watercourses
Delineation Fieldwork and Reporting
All wetlands will be delineated in accordance with the procedures mandated
in the USACE 1987 Wetland Delineation Manual (Manual) and November
2010 Regional Supplement to the Corps of Engineers Wetland Delineation
Manual: Atlantic and Gulf Coastal Plain (Version 2.0). The Ordinary High
Water Mark (OHWM) of all waterbodies will be delineated in accordance with
standard procedures set forth by the USAGE. The delineation will adhere to
industry standards utilized on similar projects in similar areas by
environmental professionals. All boundaries shall be surveyed with sub-meter
Global Positioning System (GPS) technologies that are consistent with the
methodologies generally accepted by the USAGE. Should the client require a
registered survey of the delineated areas to be performed by a licensed
surveyor, this survey must be contracted separately under an additional cost
proposal. Environmental consultant will compile a draft Jurisdictional
Delineation Report. The report will include a discussion of the natural
resources found on the subject property, including vegetation and soils, along
with the results of the field investigation for jurisdictional wetlands and waters.
The report will include:
i) Wetland/upland data sheets
ii) Site map indicating the size and location of wetlands based on GPS
measurements

iii) Approved Jurisdictional Determination (AJD) request forms or
Preliminary Jurisdictional Determination (PJD) request forms, as
determined by the client
iv) Minimum of 10 site photographs
v) Vicinity map
vi) FEMA 100-year floodplain map
vii) USGS topographic maps
viii)NRCS soils map
ix) Historical aerial photographs
x) Infrared imagery
xi) USFWS NWI map
xii) USGS NHD watershed map
xiii)LiDAR map
xiv) Table listing physical characteristics of all waterbodies, including
average water depth, length of feature, width and depth of OHWM,
width of high bank to high bank, substrate composition, and water flow
direction
Following client review, Environmental consultant will submit the report to the
USACE for verification and jurisdictional determination.
USACE Field Verification
The USACE and/or EPA will verify the boundaries of those areas delineated
that may be within their jurisdiction utilizing the draft Jurisdictional Delineation
Report.
This verification may be conducted from their offices (desk audit) or
performed in the field at the proposed project site. Environmental consultant
assumes that the verification will consist of a field inspection for this project.
Environmental consultant will accompany a USACE representative in the field

during the verification process. It is assumed that one USACE verification
meeting will be required that will last no longer than one nine-hour day.
Following the field verification, the USAGE will issue an AJD that will be valid
for 5 years.
i) Deliverables
(1) The draft report will be delivered electronically as a PDF for client
review. Environmental consultant will address one round of
comprehensive comments from both the client and the City of
Pearland. Environmental consultant will then issue a Final Report
electronically, and upon request, in hard copy.
ii) Assumptions
Environmental consultant makes the following assumptions regarding this
proposal:
(1) Environmental consultant will be provided shapefiles and/or KMZ
files of the Subject Property that are geo-referenced in a mutually
agreeable electronic format.
(2) Right-of-entry will be provided prior to fieldwork commencing (If
Task 2 is authorized)
(3) The preliminary wetland assessment does not include a site visit
(4) Environmental consultant will respond to one comprehensive round
of comments on draft reports from the client and the City of
Pearland.
Items not included within this proposal:
(1) Clean Water Act Permitting
(2) Threatened and Endangered Species Habitat Assessment
(3) Cultural Resources Assessment

5) Existing Conditions
a) Data Collection: The Engineer will be responsible for field review of the
project, inventory and cataloging of existing available data, review of
existing data, and collection of additional data as necessary that may
include the following:
i) Pearland Parkway Traffic Circle Modification Preliminary Engineering
Report
ii) Design data from record drawings of existing and proposed facilities
iii) Environmental data
iv) Federal Emergency Management Agency (FEMA) Flood Boundary
Maps and Flood Insurance Studies and Models
v) Topographical Survey Data
vi) ROW Boundary Survey Data
vii) Existing Utility Survey Data
(1) Obtained from both a topographic survey and from existing utility
map data
b) Develop Base Maps: The base maps to be used for the analysis and
proposed preliminary layout shall be developed by the Engineer from
existing construction, utility information and ROW plans as available. The
Engineer shall re-establish the existing centerline horizontal alignments for
roadways, identify existing ROW, property owners, and the approximate
location of utilities. Base maps shall also reflect results of earlier work
. assignments associated with the corridors performed by others.
c) Analyze and Confirm Existing Conditions: Using collected/provided
data and base maps, the Engineer shall develop an overall analysis of the
existing conditions in order to develop the preliminary design. The analysis
shall include but not be limited to the following:
i) Retracement of existing ROW
ii) Tree survey
iii) Confirm locations of existing overhead/underground utility facilities
iv) Horizontal alignment

vi) Pavement cross slopes and pavement type
vii) Intersection design and analysis
viii)Sight distance
ix) Roadside signing
x) Level of service
xi) Locations of critical constraints
xii) Inventory of existing driveways
xiii)Inventory of pedestrian facilities/infrastructure intended to remain in
place
xiv) Conduct field visits to assess existing structures
6) Monument Sign Design
a) Engineer shall determine optimal location for new monument sign, based
on sight-distance/line-of-sight requirements, and utility and space
constraints, to replace existing monument signs being demolished for
construction of the proposed roundabout. Said location shall be indicated
on roadway plan sheets.
b) Engineer shall coordinate with Landscape Architect for development of
design and development of plans and specifications for items:
i) Landscape Plan for restoration
ii) Hardscape Plan & Monument Signs (2 signs)
iii) Landscape Irrigation Plan
c) Engineer shall coordinate with structural engineer for development of
foundation designs for 2 monument signs.
7) Preliminary Design (30% Submittal):
a) Geometric Design: Engineer shall prepare an alignment and proposed
roadway preliminary layout to include projected traffic volumes, as
provided in the Traffic Analysis, and existing and proposed typical

sections. The Engineer shall reference the latest versions of the City of
Pearland and FHWA design guidelines and requirements.
b) Drainage: Prepare 30% Design layout of proposed drainage
improvements necessary to accommodate proposed roadway
improvements. Drainage improvements shall be based on the analysis
and preliminary design outlined in the Preliminary Engineering Report.
c) Utility Adjustments: Engineer shall identify potential conflicts between
proposed improvements and existing utilities, based on existing utility
information obtained from the City and obtained from the Topographic
Survey.
d) Typical Sections: The Engineer shall develop both existing and
proposed typical sections that depict the number and type of lanes,
median widths, curb offsets, cross slope, pedestrian and bicyclist facilities,
and ROW limits.
e) Conceptual Traffic Control Plan: The Engineer shall develop a
conceptual traffic control plan including traffic handling and construction
sequencing narrative, and traffic control typical sections. The conceptual
traffic control plan shall include probable limits/areas of construction and
number of travel lanes during each phase of construction.
f) 30% Design Conference: The Engineer shall prepare and submit 30%
Design Plans for review and approval, and shall attend a 30% Design
Review Meeting with the City.
i) Deliverables:
(1) 30% Plan Sheets (2-hardcopies, 1-PDF copy, and digital upload to
City of Pearland ProTrak system) for the following:
(a) Roadway
(b) Drainage
(c) Utilities
(d) Typical Sections

City's review and written approval. The Engineer shall provide written
responses to City's review comments. The PS&E items shall be revised
by the Engineer to reflect the City's comments, and shall make revisions
to all deliverables and resubmit for final approval when all comments are
addressed in ProTrak. Cost estimates are to be updated for every stage of
completion at a higher degree of detail as data is developed. PS&E
deliverable submittals shall include the following:

9) Bid Phase Services
The Engineer shall assist with solicitation and bidding activities to procure the
services of a construction contractor.
a) Bid Advertisement: Engineer to provide one final Issue for Bid (IFB)
Plans and Specifications Set Including Price Schedule, Bid Tabs and
Scope of Work in electronic format.
b) Pre-Bid Meeting: Engineer shall attend one Pre-Bid Conference.
c) Bid Phase RFI's and Bid Addenda: Engineer shall respond to bidders'
requests for information (RFI) within two (2) business days. Engineer shall
revise the 100% plans and specifications.to address changes made during
the bidding phase and submit addenda.

d) Bid Opening: No efforts required from Engineer for Bid Opening, as bids
are received and opened via City's e-bid system.
e) Bid Evaluation: Engineer shall assist in evaluation of bid offers, including
review of contractor's financial standing and references provided.
f) Bid Award: Engineer shall provide Bid Award recommendation to City,
including attend City Council meeting for award of construction contract.
g) Contract Documents: Produce and transmit 5 sets of plans & project
manuals to selected contractor.
10) Construction Phase Services
The Engineer shall assist with construction phase services.
a) Pre-Construction Meeting: Engineer shall attend one pre-construction
meeting. Engineer to provide meeting agenda.
b) Submittal Review: Engineer shall review and approve Construction
Contractor's Submittals, shop drawings, samples, mock-ups and test
reports.
c) RFI Responses: Engineer to respond to RFI's. Each RFI response will
be provided within 4 business days of receipt.
d) Pay Application Review and Approval: Engineer shall review monthly
pay applications from construction contractor and provide
recommendation for payment to City.
e) Process Change Orders: Review/approve & comment on request for
change orders, contractor proposals includipg coordination with
construction manager on proposals using the City's ProTrak system.
f) Project Closeout: Engineer shall
i) conduct "Punch list" walk-through.
ii) Issue both Certificate of Substantial Completion (signed/sealed from
Design Engineer) & Final Acceptance
iii) Issue Final Completion & Acceptance letter to City recommending
acceptance & release of final payment

g) Record Documents: Within 30 days provide to the City 1 full size
reproducible record drawings, an electronic file copy and an AutoCAD file
(.dwg) or compatible .dxf file.
11) Project Management:
Engineer shall perform the work and provide the listed deliverables in
accordance with the associated standards. Project management will involve
continuous project coordination and administration; preparation of monthly
progress reports, invoices and billings; meetings and coordination activities;
preparation of meeting minutes; and Quality Assurance/Quality Control
(QA/QC).
a) Project Kick-Off Meeting: Engineer shall attend a project kick-off
meeting with the City to discuss key team members and contacts, and
discuss scope and schedule requirements and constraints.
b) Project Management and QA/QC Plan
The Engineer shall develop a project management plan (PMP) to outline
project team organization, roles and responsibilities, project schedule,
coordination and communication procedures, document and graphics
formatting protocols, QA/QC plan, and other important operational information
pertaining to project team and City collaboration which will be tailored to the
needs of this project. The QA/QC plan will outline review processes for the
work to verify that the work is in accordance with City requirements as
identified under each task and that the work is completed in a timely and
efficient manner. The Engineer shall provide ongoing quality assurance and
quality control to verify completeness of product and compliance with the
procedures for deliverables.
i) Deliverables:
(1) Draft and Final Project Management Plan (electronic .PDF)
(2) Draft and Final QA/QC Plan (electronic .PDF)

c) Management of Work Activities
Engineer shall manage project activities and work to verify they are in
accordance with applicable statutes, regulations, guidelines and latest codes,
practices, criteria, specifications, policies, procedures, as identified under
each task as well as on schedule within project scope and budget.
d) Project Schedule
The Engineer shall prepare a detailed graphic Project Schedule, using
Microsoft Project, indicating tasks, critical dates, milestones, deliverables and
City review requirements. The Project Schedule will depict the order of the
various tasks, milestones, and deliverables as outlined in this scope.
i) Deliverables:
(1) Project Schedule (Microsoft Project), updated/submitted as needed
e) Invoice Preparation and Submittal
The Engineer shall prepare monthly invoices. The Engineer shall submit each
invoice in a format acceptable to the City. Each invoice shall also include a
summary of work that corresponds to work performed for that invoice period.
The City shall provide an invoice format template.
i) Deliverables:
(1) Monthly Invoices (electronic .PDF)
f) Subconsultant Management
The Engineer shall prepare subcontracts for subconsultants and direct,
monitor, and review subconsultant activities and work. The Engineer shall
review subconsultant invoices.
