R2005-133 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, EXPRESSING OPPOSITION TO THE CONSTRUCTION OF RAISED MEDIANS FOR THE STATE HIGHWAY 35 WIDENING PROJECT. WHEREAS, the Texas Department of Transportation ("TxDOT") is overseeing the construction of the State Highway 35 Widening Project, and WHEREAS, TxDOT plans to construct raised medians as part of the Project, and WHEREAS, business and property owners have expressed concerns that raised medians will create an inequitable situation for businesses along the State Highway 35 corridor who will be required to bear the burden of diminished access, and WHEREAS, the construction of medians reverses an earlier TXDOT decision to not include medians on the State Highway 35 Widening Project. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That Texas Department of Transportation (TXDOT) is urged to remove raised medians from the construction plans for the State Highway 35 Widening Project. COKER -- CITY ATTORNEY 2 Memo To: Mayor and City Council Members From: Alan Mueller Date: 3/7/05 Re: SH 35 Widening Project At a meeting on March 3, 2005, Larry Heckathorn, TxDOT Area Engineer, confirmed that TxDOT is considering raised medians for the SH 35 widening project in lieu of the previously planned continuous center turn lane between BW 8 and FM 518. This revised design is based on an evolving TxDOT practice to utilize raised medians when the average daily traffic exceeds 20,000 vehicles per day. This new practice is based on the results of several studies that have recently been conducted by TxDOT, including the FM 518 Mobility Plan. Mr. Heckathorn emphasized that a final decision would not be made until after some type of public involvement and notification process had been completed. A draft schematic of the median alternative has been prepared, but a public involvement plan and schedule has not been established. I have requested a copy of the schematic for the City's review. Following are some additional topics to keep in mind regarding this issue: 1. In approximately 1998, City Council directed staff to evaluate requesting TxDOT to install raised medians. a. City staff worked with the Chamber of Commerce to solicit opinions from SH 35 businesses. The overwhelming majority opposed raised medians. b. At that time, TxDOT also indicated thatraised medians would require four extra feet of ROW and that the additional ROW cost would be the City's responsibility. According to Mr. Heckathorn, the current median plan would require no additional ROW beyond which is planned for the continuous left turn lane. c. The City Council subsequently opted to cease consideration of the raised median alternative, primarily due to the cost and impact of the additional ROW. April 18, 2005 2. The Old Town Site study recommends raised medians for SH 35, so this revised plan would be consistent with the Old Town Site study. 3. The raised medians would provide an additional landscaping opportunity. 4. The previous business owner opinions were not based on a specific median plan, so current opinions may vary based on review of an actual plan. Additional information regarding the schematic drawing and the public involvement schedule will be forwarded to City Council as staff receives additional information from TxDOT. The projected medians will do nothing to increase traffic flow and will prove to be a major economic hardship to new and.existing businesses on Highway 35. It is time to move forward with the original expansion plan as drafted several years ago. To avoid a serious economic mistake, we should look no farther than FM 2351.in Friendswood where city officials, businesses and residents all agree that the medians are a major economic and traffic planning mistake.
