1 3 0 ►1 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON APRIL 28,1997,7:30 P.M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. INVOCATION AND PLEDGE OF ALLEGIANCE The invocation was give by Councilmember Richardson and the Pledge of Allegiance was led by Ben Kilty, of Boy Scout Troop 466 APPROVAL OF THE MINUTES Councilmember Wilkins made the motion, seconded by Councilmember Beckman to approve the minutes of the Joint Public Hearing held on March 31, 1997 at 6:00 p.m. Voting "Aye" Councilmembers Beckman and Wilkins. Voting "No" None Councilmembers Tetens and Richardson abstained. Councilmember Tetens made the motion, seconded by Councilmember Wilkins to approve the minutes of the Regular Council meeting held on March 31, 1997 at 7:30 p.m. Voting "Aye" Councilmembers Beckman, Wikins and Tetens. Voting "No" None. Page 1 of 12 - 4/28 Councilmember Richardson abstained. MAYOR'S ACTIVITY REPORT Mayor Reid reported that on April 15 he attended the HGAC Board of Director's Meeting, the PEDC Special Meeting, and the Pearland Historical Society Quarterly Meeting; on April 16 the Texas New Mexico Power Company Meeting, and the Brazoria County Cities Association Meeting; on April 17 the PEDC Broker's Day and the Gulf Coast Water Authority Monthly Board Meeting; on April 21 the PEDC Special Meeting; on April 22 Earth Day Presentation at Shady Crest Elementary, Earth Day Function at Jr. High School East, and the Chamber After Hours; on April 23 the Chamber Luncheon for Secretary's Day, and the Brazoria Drainage District #4 Public Hearing; on April 24 the Clear Lake Transportation Partnership Monthly Meeting; on April 25 the Clean Pearland Annual Meeting; and on April 26 the District IV PTA Annual Meeting. Mayor Reid congratulated PEDC Executive Director Glen Erwin and his staff for doing a great job. Councilmember Beckman reported that on April 16 she attended the Texas New Mexico Power Company Meeting and the Brazoria County Cities Association Meeting; on April 17 the Industrial Broker's Day; on April 19 the 1st Annual Hazardous Waste Collection; on April 21 the UIL Academics Awards at the High School; and on April 25 the Clean Pearland Awards Dinner. Councilmember Tetens reported that the household hazardous waste drive was very well organized. Councilmember Richardson stated that this will be his last meeting, and would like to wish Councilmember Elect Bill Berger the best of luck, as well as thank the Council, Staff and Citizens of this great community for the opportunity to have served on Council. Councilmember Wilkins thanked Wendy Standorf for her work as Interim City Secretary. CITY MANAGER'S REPORT City Manager Grohman reported that Kemlon would be holding their ground breaking ceremony on Wednesday, April 30; we are ready to being the second bridge on Centennial; the tie in at SH 35 should be done in about 30 days; we have a preliminary approval from the railroad on the over -pass; we have had a lot of rain and have missed any major damage; we are prepared for the hurricane season, we have completed our "Hurricane Poly" exercise and hurricane maps are available through the EMS; the weather has delayed the Southwest Environmental Center (SWEC) and David L. Smith projects; there were approximately 60 Industrial Brokers that Page 2 of 12 - 4/28 131 1 3 �I participated from the Houston area, which is a great turn out since there are not many Industrial Brokers; we have been dealing with the City of Houston on some water and wastewater issues that effect both cities; the new Park brochures are out; and Mr. Grohman wished Councilmember Richardson well. UNFINISHED BUSINESS: SECOND READING OF ORDINANCE NO. 786 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, REPEALING, IN ITS ENTIRELY, CITY OF PEARLAND ORDINANCE NO. 559, WHICH ESTABLISHED PROCEDURES FOR ABANDONING AND OTHERWISE ALTERING PUBLIC RIGHTS-OF-WAY, AS IT MAY HAVE BEEN, FROM TIME TO TIME, AMENDED, HAVING A SEVERABILITY CLAUSE, A REPEALER CLAUSE, A SAVINGS CLAUSE AND PROVIDING AN EFFECTIVE DATE. Councilmember Wilkins made the motion, seconded by Councilmember Tetens to approve Ordinance No. 786 on its second and final reading. Councilmember Richardson read into the record a written statement from Dan McMaster, 2614`i'helma, a copy of which is attached. Josephine Leggio, 4517 Merrie, Bellaire, addressed Council speaking for the proposed zone change, as there is a shopping center across FM 518 from the property. She also stated that the property would be used for her sons electrical business. Councilmember Wilkins read into the record a written statement from Tom and Melinda Rosinski, 6220 Gardenia, a copy of which is attached. Eugene Rader, 2626 O'Day Road, addressed Council, requesting that the zone change be denied, as there are many single family dwellings in this area. Councilmember Richardson read into the record a written statement from Michael Cotter, 2549 Lazy Bend, a copy of which is attached. ACCEPT THE RECOMMENDATION OF THE PLANNING & ZONING COMMISSION TO DENY APPLICATION NO. 113. Councilmember Beckman made the motion, seconded by Councilmember Tetens to accept the recommendation of the Planning and Zoning Commission to deny Application No. 113. Josephine Leggio, 4517 Merrie, Bellaire, addressed Council and withdrew her request. No action necessary by Council. Councilmember Beckman made the motion, seconded by Councilmember Wilkins to accept the recommendation of the Planning and Zoning Commission to deny Application No. 198. Voting "Aye" Councilmembers Beckman, Tetens, Richardson, and Wilkins. Voting "No" None. Motion passed 4 to 0. ADOPTION OF GOALS AND OBJECTIVES ESTABLISHED AT STRATEGIC PLANNING WORKSHOP ON JANUARY 10 & 11, 1997. Councilmember Richardson made the motion, seconded by Councilmember Beckman to adopt the goals and objectives established at the Strategic Planning Workshop on January 10 & 11, 1997. City Manager Grohman reminded Council that these were the goals that were identified at the workshop, and that several of the goals had already been accomplished. Voting "Aye" Councilmembers Beckman, Tetens, Richardson, and Wilkins. Voting "No" None. Motion passed 4 to 0. RESOLUTION NO. R97-24, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER TO APPLY FOR AND EXECUTE ALL AGREEMENTS ASSOCIATED WITH THE AUTOMOBILE THEFT PREVENTION AUTHORITY (ATPA) GRANT PROGRAM. Councilmember Wilkins made the motion, seconded by Councilmember Tetens to approve Resolution No. R97-24. Director of Grants and Public Affairs, Janet Berry informed Council that this grant request is in the amount of $131,368. This is a five year grant with no local match in years one and two and in years three, four and five a 20% local match is needed. We will re -apply each year. R97-25, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, CHANGING THE REGULAR MEETING DATES IN MAY, BECAUSE OF THE MEMORIAL DAY HOLIDAY. Councilmember Richardson made the motion, seconded by Councilmember Beckman to approve Resolution No. R97-25, so the second regular Council meeting in May will commence on May 19, 1997 at 7:30 p.m. Voting "Aye" Councilmembers Beckman, Tetens, Richardson, and Wilkins. FIRST AND ONLY READING OF ORDINANCE NO. 787, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, ESTABLISHING A NO - PASSING ZONE` PURSUANT TO SECTION 545.055 OF THE TRANSPORTATION CODE, UPON GREEN TEE DRIVE BETWEEN COUNTRY CLUB DRIVE AND GOLFCREST DRIVE, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF PEARLAND, AS SET OUT IN THIS ORDINANCE; PROVIDING A PENALTY FOR VIOLATION; CONTAINING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, AND A REPEALER CLAUSE; PROVIDING AN EFFECTIVE DATE, FOR PUBLICATION, AND FOR CODIFICATION; AND DECLARING AN EMERGENCY BECAUSE THE NEED TO ESTABLISH A NO -PASSING ZONE INURES TO THE BENEFIT OF THE TRAVELLING PUBLIC AND, THEREFORE, BEARS DIRECTLY UPON THE HEALTH, SAFETY AND WELFARE OF THE CITIZENRY. FIRST READING OF ORDINANCE NO. 788, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, ESTABLISHING A PROCEDURE FOR ABANDONING, ALTERING, CLOSING, AND VACATING STREETS, ALLEYS, AND OTHER PUBLIC RIGHTS-OF-WAY AND PORTIONS THEREOF WITHIN THE CITY OF PEARLAND; CONTAINING A SAVINGS CLAUSE AND A SEVERABILITY CLAUSE; Page 10 of 12 - 4/28 1 4 0 ')J PROVIDING FOR CODIFICATION AND AN EFFECTIVE DATE; AND CONTAINING OTHER PROVISIONS RELATED TO THE SUBJECT. Councilmember Beckman made the motion, seconded by Councilmember Tetens to approve Ordinance No. 788 on its first reading. City Attorney McCullough advised Council that this is the ordinance that replaces the ordinance that was repealed at the last meeting. This ordinance outlines the procedures for Right -of -Way Abandonments, cleaning up the wording. Voting "Aye" Councilmembers Beckman, Tetens, Richardson, and Wilkins. Voting "No" None.
