AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON OCTOBER
7, 1991, AT 7:00 P. M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBER-

The Hearing was called to order with the following present:

At the request of Mayor Coppinger, it was the consensus of the Council
that Application No. 25 would be heard first.

PURPOSE OF THE HEARING:
APPLICATION NO. 25, REQUEST OF C. DAVIS WILSON, AGENT FOR
FEDERAL DEPOSIT INSURANCE CORPORATION, OWNER, FOR AN AMEND-
MENT TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF SAID
CITY FROM CLASSIFICATION R-4, PLANNED UNIT DEVELOPMENT TO R-
3, SINGLE FAMILY DWELLING DISTRICT, ON THE FOLLOWING DE-
SCRIBED PROPERTY, TO -WIT:
A 50.154 ACRE TRACT OF LAND BEING THE SOUTHERLY PORTION OF A
63.956 ACRE TRACT BEING A PORTION OF A 12.12 ACRE TRACT AND
A PORTION OF A 67.88 ACRE TRACT IN SECTION NUMBER 15 OF THE

SPEAKING FOR THE PROPOSED REQUEST:
1. C. Davis Wilson, Agent for Wilson/Zetty Associates. Mr.
Wilson introduced a preliminary sketch of the proposed
subdivision of approximately 187 home sites and explained
this requested change in zoning is an upgrade from an R-4 to
an R-3.
SPEAKING AGAINST THE PROPOSED REQUEST: None
QUESTION AND ANSWER PERIOD:
There followed a general discussion regarding the development of the
proposed subdivision.

Commission would meet immediately following the closing of the Joint
Public Hearing to consider these two requests for zone changes.

BEING A TOTAL OF APPROXIMATELY 39.8 ACRES (EXTENSION OF
LEROY STREET FROM HAZELDALE)
SPEAKING FOR THE PROPOSED REQUEST:
1. Tom Heeter, Heeter & Associates Corporate Real Estate Serv-
ices. Mr. Heeter spoke in favor of the rezoning, discussing
zoning methods in general.
2. Daniel Rucker, Agent for proposed zone change. Mr. Rucker
spoke in favor of the rezoning, highlighting the advantages
to the area if the proposed development is allowed.
3. James Barnett, Developer of Hazeldale. Mr. Barnett spoke in
favor of the proposed rezoning, stating he owns land nearby
and felt this would be a good use of the land.
4. Linda Heeter, 5303 Glenmont, Houston. Ms. Heeter spoke in
favor of the zone change.
5. John Garner, Municipal Engineering. Mr. Garner spoke in
favor of the rezoning and stated he will be the engineer on
the project and is available to answer any questions.
6. George Slaughter, 4206 Argentina Circle, Pasadena. Mr.
Slaughter spoke in favor of the zone change, stating he was
one of the owners of the land proposed to be rezoned.
SPEAKING AGAINST THE PROPOSED REQUEST:
A number of people spoke against the proposed request to rezone citing
among various reasons the following: increased traffic, preference for
the R-1 zone rather than an R-2, drainage, flooding, strain on city
services, and increased crime rate.

In addition, a petition was received in the City Secretary's office
containing 29 signatures opposing the rezoning. An addendum to this
petition was presented at the hearing containing an. additional nine
signatures. A second petition was presented at the hearing containing
approximately 135 signatures opposing the rezoning.
QUESTION AND ANSWER PERIOD:
There followed a general discussion between Council, Planning Commis-
sioners, and Staff regarding the development of the area should the
zone change be approved.
