A Resolution of the City Council of the City of Pearland, Texas, accepting the
Final Report of the Ad Hoc Committee on the Unified Development Code
(UDC).
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain Final Report of the Ad Hoc Committee on the Unified
Development Code, a copy of which is attached hereto as Exhibit"A"and made a part hereof for all
purposes, is hereby accepted and staff is authorized to proceed with the UDC amendment process.

Re: Recommendations on proposed amendments to the Unified
Development Code and development related items
On October 8, 2018, City Council approved Resolution No. R2018-193 creating an ad
hoc committee to review development policies within the Unified Development Code
(UDC). City Council appointed Councilmembers Carbone and Hernandez and Mayor
Pro-Tem Perez to the Committee and requested they report back to Council within six
months.
The Committee met eight times with representatives of the city's Community
Development, Engineering, and Legal Departments, representatives of the Planning
and Zoning Commission, members of the development community, business owners,
and citizens, reviewing the chapters of the UDC as well as engineering standards set
forth for development in Pearland.
Working with city staff, the following recommendations were accepted as actions that
can be implemented at an administrative level:
• Improve publicity of the Community Development outreach programs (Pre-
development meetings, consultations, and assistance with building/construction
issues) through use of the City's website, partnerships with the Chamber of
Commerce, and other available methods; and
• Review the City's website to ensure proper correlation between documents,
handouts, and the UDC; and
• Update the plat submittal checklists to remove the requirements for a traffic
impact analysis (TIA) and a drainage study and replace with a TIA worksheet and
a drainage proof of concept.
The following recommendations require amendment to the UDC:
• Chapter 2, Zoning Regulations
o Change the prohibition on parking in the front yard included in Section
2.4.3.4, OT, Old Townsite District to allow parking in front yard only on
approved surfaces.
o Replace Article 5, Division 2 — Land Use Matrix with a new schedule of
uses that increases ease of use and understanding;
■ Remove all definitions currently in the Land Use Matrix and
incorporate them in to Chapter 5, Definitions.
■ Remove references to parking in the Land Use Matrix and relocate
to Chapter 4, Site Development.
o Remove outdoor activity references currently spread throughout Article 4,
Zoning Districts, and Article 5, Division 2 - Land Use Matrix and create a
new, singular section for the topic.
• Chapter 3, Subdivision Regulations
o Remove the landscape plan requirement from the amending, preliminary,
and final plat processes;
o Redefine the master plat as a "master plan" with approval vested in the
Administrative Official.
o Include an allowance for the approval of a final plat prior to the completion
of all infrastructure improvements that would allow the Planning and
Zoning Commission to approve the final plat, but the plat would not be
filed until all infrastructure is accepted by the City. This would require the
developer to sign an agreement to such.

• Chapter 4, Site Development
o Amend Article 1, Division 3 — Improvements Required Upon Expansion, to
■ Remove the requirement for dumpster screening and sidewalks
when expanding a paved area, and
■ Separate landscaping requirements for street trees and parking lot
trees based on type of expansion.
o Update Article 2, Division 1 — Parking, to include parking requirements
currently included in Chapter 2, Land Use.
• Chapter 5, Definitions
o Merge definitions currently included under the Land Use Matrix in Chapter
2.
dditionally, the Committee spoke of the need to update the Unified Development Code
as a whole, and the need to bring in a consultant to work with staff on this in the next
few years.
Though not directly included within the UDC, the following development related items
were identified as matters to be more fully reviewed:
1. The inconsistencies in regulations regarding the length of cul-de-sacs between
the UDC, Engineering Design Criteria Manual(EDCM), and the Fire Code;
2. Partnerships between the Pearland Economic Development Corporation and
local businesses that may assist in bringing commercial properties into
conformance with today's UDC standards; and
3. Appendix D, Section D107, One- or Two- Family Residential Developments,
regarding the separation of access roads versus EDCM distance requirements.
The Committee recommends that staff works with the Planning and Zoning;Commission
to finalize these proposed amendments and to bring final recommendations forward for
a Joint Public Hearing and consideration by City Council at a future meeting.
