A Resolution of the City Council of the City of Pearland,Texas,authorizing the
City Manager or his designee to enter into a contract with Ardurra Group,
LLC, in the amount of $3,775,000.00 for design services associated with the
John Hargrove Environmental Complex (JHEC) Water Reclamation Facility
Expansion Project.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain contract by and between the City of Pearland and Ardurra Group,
LLC, a copy of which is attached hereto as Exhibit "A" and made a part hereof for all purposes, is
hereby authorized and approved.
Section 2. That the City Manager or his designee is hereby authorized to execute and
the City Secretary to attest a contract with Ardurra Group, LLC, for design services associated with
the JHEC Water Reclamation Facility Expansion Project.

CONTRACT FOR PROFESSIONAL SERVICES
THIS CONTRACT is entered into upon final execution by and between the City of Pearland
("CITY")and Ardurra Group,LLC ("CONSULTANT").
The CITY engages the CONSULTANT to perform professional services for a project known and
described as JHEC WRF Expansion("PROJECT"). (Project#WW1603)
SECTION I-SERVICES OF THE CONSULTANT
The CONSULTANT shall perform the following professional services to CITY standards and in
accordance with the degree of care and skill that a professional in Texas would exercise under the
same or similar circumstances:
A. The CONSULTANT shall perform engineering services. See Exhibit A, attached,
for a detailed SCOPE OF WORK and PROJECT schedule.The PROJECT schedule
shall be submitted in digital and hard copy form in the Microsoft Project for
Windows format.
B. The CONSULTANT shall prepare and submit a detailed opinion of estimated cost
of the PROJECT.
C. The CONSULTANT acknowledges that the CITY (through its employee
handbook)considers the following to be misconduct that is grounds for termination
of a CITY employee: Any fraud, forgery, misappropriation of funds, receiving
payment for services not performed or for hours not worked, mishandling or
untruthful reporting of money transactions, destruction of assets, embezzlement,
accepting materials of value from vendors, or consultants, and/or collecting
reimbursement of expenses made for the benefit of the CITY. The CONSULTANT
agrees that it will not,directly or indirectly; encourage a CITY employee to engage
in such misconduct.
D. The CONSULTANT shall submit all final construction documents in both hard
copy and electronic format. Plans shall be AutoCAD compatible and all other
documents shall be Microsoft Office compatible. The software version used shall
be compatible to current CITY standards. Other support documents, for example,
structural calculations, drainage reports and geotechnical reports, shall be
submitted in hard copy only. All Record Drawings electronic files shall be
submitted to the CITY in TIF format.
E. The CONSULTANT recognizes that all drawings, special provisions, field survey
notes,reports,estimates and any and all other documents or work product generated
by the CONSULTANT under the CONTRACT shall be delivered to the CITY upon
request, shall become subject to the Open Records Laws of this State.
F. The CONSULTANT shall procure and maintain for the duration of this Agreement,
insurance against claims for injuries to persons, damages to property,or any errors

and omissions relating to the performance of any work by the CONSULTANT, its
agents, employees or subcontractors under this Agreement, as follows:
(1) Workers' Compensation as required by law.
(2) Professional Liability Insurance in an amount not less than $1,000,000 in
the aggregate.
(3) Comprehensive General Liability and Property Damage Insurance with
minimum limits of $1,000,000 for injury or death of any one person,
$1,000,000 for each occurrence, and $1,000,000 for each occurrence of
damage to or destruction of property.
(4) Comprehensive Automobile and Truck Liability Insurance covering owned,
hired, and non-owned vehicles, with minimum limits of $1,000,000 for
injury or death of any one person, $1,000,000 for each occurrence, and
$1,000,000 for property damage.
The CONSULTANT shall include the CITY as an additional insured under the
policies, with the exception of the Professional Liability Insurance and Workers'
Compensation. Certificates of Insurance and endorsements shall be furnished to
the CITY before work commences. Each insurance policy shall be endorsed to
state that coverage shall not be suspended, voided, canceled, and/or reduced in
coverage or in limits ("Change in Coverage") except with prior written consent of
the CITY and only after the CITY has been provided with written notice of such
Change in Coverage, such notice to be sent to the CITY either by hand delivery to
the City Manager or by certified mail,return receipt requested,and received by the
City no fewer than thirty (30) days prior to the effective date of such Change in
Coverage. Prior to commencing services under this CONTRACT,CONSULTANT
shall furnish CITY with Certificates of Insurance, or formal endorsements as
required by this CONTRACT,issued by CONSULTANT'S insurer(s),as evidence
that policies providing the required coverage,conditions,and limits required by this
CONTRACT are in full force and effect.
G. The CONSULTANT shall indemnify and hold the CITY, its officers, agents, and
employees,harmless from any claim,loss,damage, suit,and liability of every kind
for which CONSULTANT is legally liable, including all expenses of litigation,
court costs, and attorney's fees, for injury to or death of any person, for damage to
any property, or errors in design, any of which are caused by the negligent act or
omission of the CONSULTANT,his officers,employees,agents,or subcontractors
under this CONTRACT.
H. All parties intend that the CONSULTANT,in performing services pursuant to this
CONTRACT, shall act as an independent contractor and shall have control of its
own work and the manner in which it is performed. The CONSULTANT is not to
be considered an agent or employee of the CITY.

SECTION II-PERIOD OF SERVICE
This CONTRACT will be binding upon execution and end December 31, 2022.
SECTION III-CONSULTANT'S COMPENSATION
A. The total compensation for the services performed shall not exceed the total noted
in Section B.
B. The CITY shall pay the CONSULTANT in installments based upon monthly
progress reports and detailed invoices submitted by the CONSULTANT based
upon the following:
1. Basic Services(Lump Sum) $3,509,000.00
2. Additional Services shall require independent and specific authorization
and shall be billed as(Hourly Not to Exceed): $116,000.00
3. Bid Phase Services (Hourly Not to Exceed) $75,000.00
4. Construction Phase Services(Hourly Not to Exceed)
5. Reimbursable Expenses (Not to Exceed) $75,000.00
6. Total: $3,775,000.00
C. The CITY shall make payments to the CONSULTANT within thirty(30)days after
receipt and approval of a detailed invoice. Invoices shall be submitted on a monthly
basis.
SECTION IV-THE CITY'S RESPONSIBILITIES
A. The CITY shall designate a project manager during the term of this CONTRACT.
The project manager has the authority to administer this CONTRACT and shall
monitor compliance with all terms and conditions stated herein. All requests for
information from or a decision by the CITY on any aspect of the work shall be
directed to the project manager.
B. The CITY shall review submittals by the CONSULTANT and provide prompt
response to questions and rendering of decisions pertaining thereto, to minimize
delay in the progress of the CONSULTANT'S work. The CITY will keep the
CONSULTANT advised concerning the progress of the CITY'S review of the
work. The CONSULTANT agrees that the CITY'S inspection,review, acceptance
or approval of CONSULTANT'S work shall not relieve CONSULTANT'S
responsibility for errors or omissions of the CONSULTANT or its sub-
consultant(s) or in any way affect the CONSULTANT'S status as an independent
contractor of the CITY.

SECTION V-TERMINATION
A. The CITY, at its sole discretion,may terminate this CONTRACT for any reason--
with or without cause--by delivering written notice to CONSULTANT personally
or by certified mail at 2032 Buffalo Terrace, Houston, TX 77019. Immediately
after receiving such written notice,the CONSULTANT shall discontinue providing
the services under this CONTRACT.
B. If this CONTRACT is terminated, CONSULTANT shall deliver to the CITY all
drawings, special provisions, field survey notes, reports, estimates and any and all
other documents or work product generated by the CONSULTANT under the
CONTRACT, entirely or partially completed, together with all unused materials
supplied by the CITY on or before the 15th day following termination of the
CONTRACT.
C. In the event of such termination, the CONSULTANT shall be paid for services
performed prior to receipt of the written notice of termination. The CITY shall
make final payment within sixty(60)days after the CONSULTANT has delivered
to the CITY a detailed invoice for services rendered and the documents or work
product generated by the CONSULTANT under the CONTRACT.
D. If the remuneration scheduled under this contract is based upon a fixed fee or
defmitely ascertainable sum,the portion of such sum payable shall be proportionate
to the percentage of services completed by the CONSULTANT based upon the
scope of work.
E. In the event this CONTRACT is terminated, the CITY shall have the option of
completing the work, or entering into a CONTRACT with another party for the
completion of the work.
F. If the CITY terminates this CONTRACT for cause and/or if the CONSULTANT
breaches any provision of this CONTRACT, then the CITY shall have all rights
and remedies in law and/or equity against CONSULTANT. Venue for any action
or dispute arising out of or relating to this CONTRACT shall be in Brazoria County,
Texas. The laws of the State of Texas shall govern the terms of this CONTRACT.
The prevailing party in the action shall be entitled to recover its actual damages
with interest, attorney's fees, costs and expenses incurred in connection with the
dispute and/or action. CONSULTANT and CITY desire an expeditious means to
resolve any disputes that may arise between under this CONTRACT. To
accomplish this,the parties agree to mediation as follows: If a dispute arises out of
or relates to this CONTRACT, or the breach thereof, and if the dispute cannot be
settled through negotiation, then the parties agree first to try in good faith, and
before pursuing any legal remedies, to settle the dispute by mediation of a third
party who will be selected by agreement of the parties.

SECTION VI—ENTIRE AGREEMENT
This CONTRACT represents the entire agreement between the CITY and the CONSULTANT and
supersedes all prior negotiations, representations, or contracts, either written or oral. This
CONTRACT may be amended only by written instrument signed by both parties.
SECTION VII—COVENANT AGAINST CONTINGENT FEES
The CONSULTANT affirms that he has not employed or retained any company or person, other
than a bona fide employee working for the CONSULTANT to solicit or secure this CONTRACT,
and that he has not paid or agreed to pay any company or person,other than a bona fide employee,
any fee, commission, percentage brokerage fee, gift, or any other consideration, contingent upon
or resulting from the award or making of the CONTRACT. For breach or violation of this clause,
the CITY may terminate this CONTRACT without liability,and in its discretion,may deduct from
the CONTRACT price or consideration, or otherwise recover, the full amount of such fee,
commission,percentage brokerage fee, gift, or contingent fee that has been paid.
SECTION VIII-SUCCESSORS AND ASSIGNS
This CONTRACT shall not be assignable except upon the written consent of the parties hereto.

Ardurra Group (Engineer)will perform the necessary tasks to complete Final Design Phase Services and
Bid Phase Services for the John Hargrove Environmental Complex Water Reclamation Facility(JHEC
WRF) Expansion Project for the City of Pearland (City)as defined in this Scope of Services.The work

BASIC SERVICES
Task 1 General Project Management and Coordination
A. Engineer will conduct a project kick-off meeting with City staff.The project kick-off meeting will
discuss project expectations, schedule, deliverables and confirm project goals.The project kick-
off meeting will also include a discussion of the design approach and confirmation of the design
concept.
B. Engineer will conduct monthly progress meetings during the Final Design Phase with City staff to
review work completed to date, project schedule, and other issues.These meetings will be
approximately 2 hours in duration. Engineer assumes a total of twelve (12) project
progress/coordination meetings.
C. Engineer will coordinate with project team and subconsultants to complete project tasks and
meet project goals.
D. Engineer will perform quality assurance/quality control procedures during the Final Design
Phase.Those procedures will include a technical review of the 30 percent, 60 percent and 90
percent design deliverables.
E. Engineer will coordinate client review meetings in accordance with City procedures. Reviews are
anticipated at 30 percent,60 percent and 90 percent completion of design. Engineer will review,
consolidate and prepare written response to City's review committee.
F. Engineer will coordinate external regulatory review with the TCEQ. Meet requirements for
notification and submission to the TCEQ for review/approval of documents and design.
G. Engineer will perform miscellaneous project management and coordination duties throughout

the project, including tracking budget, maintaining the project schedule and preparing monthly
invoices and progress reports.
Task 2 Final Design Phase Services
A. Engineer will provide Final Design Phase Services for the JHEC WRF Expansion and associated
improvements identified as defined in the Final Preliminary Engineering Report(PER). The
project will include provisions for expansion of the JHEC WRF from a permitted average daily
flow(ADF)treatment capacity of 4 MGD to an ADF treatment capacity of 6 MGD,with some
provisions to account for a future ultimate ADF of 8 MGD as documented below in the detailed
description of each process area.
B. Design Definition:The Final Design Phase includes 30 percent, 60 percent,90 percent and Final
design deliverable milestone. Specific tasks associated with each design milestone are defined as
follows:
a. 30 Percent Design Deliverable
1) Engineer to facilitate the Project Kickoff Meeting. Discuss recommendations in the
PER and establish any updates for design requirements or City preferences.
2) Engineer to schedule and facilitate an Architectural Programming Workshop to
define space planning required for the Operations Building and Maintenance Shop.
3) Engineer will perform additional geotechnical and survey investigation, if required.
4) In consultation with the City, Engineer will communicate with permitting,
regulatory, and funding agencies as required.
5) Engineer will hold an internal multi-disciplinary design workshop.
6) Engineer will finalize design criteria requirements.
7) Engineer will review the City's front-end documents for construction contracts and
procurement and develop a preliminary table of contents for the technical
specifications.
8) Engineer will develop and submit 30%design deliverable, including updated Opinion
of Probable Construction Cost.
9) Engineer will perform the technical review of the 30%design deliverable.
b. 60 Percent Design Deliverable
1) Engineer will review and incorporate City's comments on the 30%design
deliverable. Identify elements of the design that will be "frozen" and elements that
are still under review by the City.
2) Engineer will develop preliminary versions of all technical specifications.
3) Engineer will advance the process mechanical design to 80%completion.
4) Engineer will hold an internal multi-disciplinary design workshop.
5) Engineer will advance other design disciplines to 50-60%completion.
6) In consultation with the City, Engineer will communicate with permitting,
regulatory, and funding agencies as required.
7) Engineer will perform initial reviews of biddability and constructability.
8) Engineer will develop and submit the 60%design deliverable, including updated
Opinion of Probable Construction Cost.
9) Engineer will perform the technical review of the 60%design deliverable.

c. 90 Percent Design Deliverable
1) Engineer will review and incorporate City's comments on the 60%design
deliverable.All elements of the design will be "frozen"following incorporation of
the City's 60%design deliverable comments.
2) Engineer will advance the process mechanical design to 95%completion, and all
other design disciplines to a 90%or higher completion.
3) Engineer will prepare the 90% project manual with complete technical
specifications,the Bid Form and completed "front end documents".
4) Engineer will perform internal back-checking and cross-checking between design
disciplines and between drawings and specifications.
5) Engineer will perform final biddability and constructability reviews.
6) In consultation with the City, Engineer will communicate with permitting,
regulatory, and funding agencies as required.
7) Engineer will develop and submit the 90%design deliverable, including updated
Opinion of Probable Construction Cost.
8) Engineer will perform the technical review of the 90%design deliverable.
d. Final Design Deliverable
1) Engineer will review and incorporate City's comments on the 90%design
deliverable.
2) Engineer will hold final coordination meetings and reviews.
3) Engineer will prepare final Project Manual.
4) Engineer will prepare the final Drawings.
5) Engineer will Sign and Seal the Final Design Deliverable for advertisement and
bidding.
C. Plans and Specifications
1. Engineer will prepare complete contract documents(plans and specifications)for bidding of
a single construction contract for the work associated with the JHEC WRF Expansion project
as defined in the Final PER.
2. Engineer will use a combination of the City's and Engineer's standard specifications modified
as necessary to accommodate local conditions. Specification format will be the Engineer's
standard format.The specification Table of Contents will be submitted with the 30 percent
design deliverable. Full technical specifications will be submitted with the 60 percent design
deliverable.The Bid Form and completed "front end documents"will be included in the
specifications with the 90 percent design deliverable.
3. Anticipated components of the JHEC WRF Expansion Project include, but may not be
exclusive or limited to the following:
a. Proposed Influent Screening Facility
1) Two(2),fully redundant, 32 MGD capacity multi rake mechanical bar screens(1/2"
bar spacing)each with a dedicated screening wash press.
2) One bypass channel.
3) Electric actuated slide gates for channel isolation.

2) Two (2) stacked tray gravitation vortex grit removal systems, each rated for 95%
removal of all grit(specific gravity>2.65)>_ 75 microns at interim and ultimate
peak flows of 24 and 32 MGD, respectively.Structure to be designed for three(3)
stacked tray gravitational vortex grit removal systems. Equipment installed in two
(2)grit removal trains.
3) Two (2)grit washing units and two (2) grit classifiers.
4) Three (3) recessed impeller grit pumps.
5) Integral flow splitter structure to distribute flow to SBR No.1,SBR No. 2 and the SBR
Splitter Box for SBR Nos. 3 through 6.
d. Proposed SBR Flow Splitter Box
1) Flow splitting structure to distribute flow to existing SBR Nos. 3 and 4, Proposed SBR
Nos. 5 and 6 and Future SBR Nos.7 and 8.
e. Existing SBR Rehabilitation and Proposed SBRs
1) Demolition of existing SBR equipment, pumps and piping at SBR Nos. 1, 2, 3 and 4.
2) Modification of existing SBR Nos. 1, 2, 3 and 4 to convert from true batch SBR tanks
to continuous flow SBR tanks, including internal equipment,fine bubble diffusers,
waste sludge pumps, actuator driven decanters and necessary piping modifications.
3) Two (2) continuous flow SBR tanks(SBR Nos. 5 and 6), including internal equipment,
fine bubble diffusers,waste sludge pumps, actuator driven decanters and necessary
piping modifications.
4) Eight (8) new blowers for all SBRs (magnetic bearing high speed turbo blowers of
._ ' _ . . -- - _ _ - ). Blowers for SBR Nos. 1 and 2 will be in Blower
Building No. 1. Blowers for SBR Nos. 3,4,5 and 6 will be in Blower Building No. 2.
Each SBR will have a dedicated blower with one standby blower in each Blower
Building.
f. Tertiary Filter Expansion
1) Construction of four(4) new cloth-disk filter concrete basins adjacent to the existing
filters.The new filter basins will be tied into the existing common influent channel.
2) Installation of two (2) new cloth-disk filters with associated backwash pumps and
piping.

g. Proposed Aerated Sludge Holding Tanks
1) Two (2) additional common wall aerated sludge holding tanks including coarse
bubble aeration equipment and telescoping valves for decanting.
2) Four(4) new positive displacement blowers for all aerated sludge holding tanks.
Blowers will be located in Blower Building No. 1.
3) Belt Press Feed Pump Station containing three (3) new double-disk or progressing
cavity pumps to supply sludge to the new belt filter presses.
h. Proposed Solids Handling Building
1) Single story concrete masonry unit (CMU) or precast concrete panel Solids Handling
Building with exterior to match existing JHEC WRF building architecture.
2) Two (2) 2-meter high-rate belt filter presses with associated wash water booster
pumps, hydraulic units, piping and controls.
3) Two (2) packaged polymer systems and associated piping to deliver polymer to the
belt filter presses.
4) Screw conveyors to distribute dewatered sludge from each of the belt filter presses
to either of two dewatered sludge hauling trailers or roll-off containers.
i. Proposed Non-Potable Water(NPW) System
1) NPW transfer pumps to pump effluent from the existing NPW wet well to the NPW
storage tank.

j. Proposed Operations Building
1) An Architectural Programming Workshop to discuss the Operations Building will be
scheduled at the Project Kickoff Meeting.
2) Single story concrete masonry unit (CMU) or precast concrete panel Operations
Building with SCADA Control Room,Training Room (accommodate up to 25 people),
Kitchen (meal preparation for 15 to 20 people)and three (3)workspaces and
document storage.The Operation Building scope does not include a new laboratory.
The Operations Building exterior to match existing JHEC WRF building architecture.
3) Based on results of the Architectural Programming Workshop the Operations
Building may combine with the Maintenance Shop and covered storage area.
k. Proposed Maintenance Shop and Covered Storage Area
1) Maintenance Shop for wastewater treatment and collection system equipment(not
vehicle maintenance). Shop to include 3 phase electrical power,welding area,tool
storage,overhead crane and outdoor covered/lockable parts storage.

m. Proposed Corrosion/Odor Control
1) Influent Screening Facility: Exhaust from the influent screening facility will be
contained by installing a solid decking cover system over the open channels as welt
treatment unit will be installed to treat the odorous exhaust from this location.The
treatment unit will be either a biological or physical system.
2) Influent Lift Station: Exhaust from the lift station will be treated with a vapor phase
corrosion/odor control treatment unit,which will be either a biological or physical
system.
3) Headworks: Exhaust from the headworks will be contained by installing a solid
decking cover system over the open channels as well as by enclosing the bar
screens. A vapor phase corrosion/odor control treatment unit will be installed to
treat the exhaust from this location.The treatment unit will be either a biological or
physical system.
4) Where advantageous, corrosion/odor control units may be combined to treat
multiple sources.
n. Site Security and Building Automation
1) The site security system will include security monitoring cameras across the site,
access and egress security gate monitoring,video surveillance for major process
areas to monitor treatment process and card access control and overhead door
monitoring at all new and existing doors on site.
2) The building automation system includes HVAC monitoring at all new and existing
buildings.
o. Electrical Improvements
1) Rerouting of CenterPoint Energy incoming electrical service from north of site. New
service routed along eastern and southern perimeter fence.
2) Replace the two (2) existing main power transformers with a single new transformer
sized to accommodate JHEC WRF electrical loads.
3) Main switchboards, motor control centers and other electrical upgrades necessary
to accommodate improvements associated with the JHEC WRF Expansion.
4) New emergency generator to accommodate equipment at 6 MGD (24 MGD peak)
and possibly 8 MGD (32 MGD peak).
p. SCADA improvements to provide monitoring and control of all process areas in a single
location within the proposed Operations Building.

r. Site civil design including grading, paving, drainage, and a stormwater pollution
prevention plan (SWPPP)to address erosion and sediment control strategies during
construction.
s. Architectural design for the new Operations Building and Maintenance Shop, perform
building code and life safety analysis, coordinate with the City for Building Permit
Review, coordinate with Texas Department of Licensing Regulation (TDLR) and prepare

t. Demolition of existing facilities as required to facilitate new work. Major demolition

D. Cost Estimate
a. Engineer will develop a quantity take-off and prepare an opinion of probable
construction cost (OPCC)for inclusion with each design deliverable (30 percent, 60
percent, 90 percent and Final).
E. Design Deliverables(30 percent, 60 percent, 90 percent and Final design milestones)
a. Five (5) 11"x17" (half-size) copies of the design deliverable Drawings.
b. Five (5) copies of the design deliverable Technical Specifications (Project Manual) as
defined in Task 2, Paragraph C.2 above.
c. Five (5)copies of the OPCC.
d. One electronic copy of the Drawings,Technical Specifications and OPCC in PDF format
via USB Flash Drive or download link.
Task 3 Bid Phase Services
Bidding services will be performed as described below:
A. Engineer will provide Notice to Bidders(NTB) and list of bid items to the City's Project Manager
in an electronic form appropriate for the City's E-bid system format. City is responsible for
advertising.
B. Engineer will provide electronic copy of bid-ready plans to the City's Project Manager for the E-
bid system.
C. Engineer will chair the pre-bid conference and attend bid opening.
D. Engineer will respond in writing to questions from bidders and prepare addenda, coordinate
with City's Project Manager as necessary.
E. Engineer will prepare Engineer's Recommendation of Award Letter that includes the following
required content:
a. Check for math errors and reconciliation of any mathematical discrepancies.

b. Review for unbalance bid items.
c. Certified Bid Tabulation including Engineer's Opinion of Probable Construction Costs

f. Recommendation to award.
F. Engineer will attend City Council Meeting and present recommendation for award of Contract
for Construction, as required.
G. Engineer will produce and transmit three (3) hard copies of the Conformed Drawings (11x17)
and Project Manual to City's Project Manager, ready for execution by the selected Contractor,
with the City's Notice of Intent to Award (NOI).
ADDITIONAL SERVICES
Task 4 Additional Site Topographic Survey
Engineer requires additional site topographic survey outside of the existing JHEC WRF fence line in area
of the proposed Influent Screening Facility NPW Storage Tank and associated roadway improvements.
This area was not surveyed previously because the Influent Screening Facility was not in the original PER
scope and all work was planned to be within the existing fence line.The additional survey will be
incorporated into the existing survey developed during the PER.
Task 5 Additional Geotechnical Investigation
Engineer requires two(2) additional geotechnical borings as part of the Final Design Phase. One
additional geotechnical boring is may be required to determine the existing soil conditions at the
Influent Screening Facility proposed NPW Storage Tank.The second additional boring will be a deep
boring in the footprint of proposed SBR Nos. 5 and 6 to allow the Geotechnical Report to include
recommendations for deep foundations as an alternative to removal and replacement of 10 feet of
existing soils below the structures. A revised Final Geotechnical Report will be issued for the JHEC WRF
Expansion project.
Task 6 Influent Lift Station Wet Well Physical Model
If the Engineer determines that the Influent Lift Station wet well(s) are not adequately configured to
meet Hydraulic Institute (HI) Design Standards at buildout peak flow, Engineer will subcontract with
Clemson Engineering Hydraulics to perform a physical model study of the wet wells.The objectives of
the physical model study will be (1)to evaluate pump approach flow hydraulics within the wet well(s)
and identify issues that may adversely impact pump performance, (2)to develop wet well modifications
and/or corrective measures to mitigate or eliminate problems associated with adverse approach flow
conditions and (3)to test and document approach flow conditions with the final recommended wet well
modifications in place.
SCHEDULE
A. The Engineer shall initiate each phase of work described herein immediately upon the execution
of the Agreement and upon issuance by City of Notice to Proceed.
B. Engineer shall submit the 30%design deliverable within 105 calendar days of Notice to Proceed.

C. Engineer shall submit the 60%design deliverable within 112 calendar days of receipt of City's
comments on the 30%design deliverable.
D. Engineer shall submit the 90%design deliverable within 70 calendar days of receipt of City's
comments on the 60%design deliverable.
E. Engineer shall submit the Final design deliverable within 35 calendar days of receipt of City's
comments on the 90%design deliverable.
CLARIFICATIONS
A. Engineer assumes that the JHEC WRF Expansion project will be confined to the existing property.
No work will be done outside of the existing plant fence except for modifications associated
with the proposed Influent Screening Facility NPW Storage Tank depending upon the final site
location. Also, Engineer assumes that no modifications to the outfall or discharge piping will be
made as part of the project.
B. Engineer assumes that storm water detention requirements shall be met off-site and no design
of detention structures shall be required. Also, Engineer assumes no separate report shall be
required for documentation of storm water management plan. Engineer will provide storm
water and cut and fill calculations as part of the final design package for City documentation.
C. Engineer shall provide the number of hard copies of each deliverable as shown in the deliverable
task above for each phase. Engineer assumes no costs for reproduction of bid documents for
distribution to bidders.Any additional copies as required in writing from the City of Pearland via
letter,email, or fax will be invoiced "at cost"to Engineer plus 5%.
D. City and Engineer agree that only deliverables as defined in this Exhibit shall be provided as final
construction documents, support documents, and work products referenced.These documents
will be provided in PDF format,except for modified City specifications and Record Drawings.
Modified City specifications will be provided in Microsoft Word format. Record Drawings will be
provided in both PDF format and AutoCAD compatible single-layer format, except for standard
details,which will be provided in PDF format only.

Fee Proposal for Civil Engineering & Surveying Services
Dear Mr. Munson,
BC&E, LLC is pleased to provide this fee proposal for professional engineering and
surveying services for the above-referenced project at the City of Pearland John Hargrove
Environmental Center WRF. Based on the provided scope of work, our project meeting,
along with our understanding of the engineering and surveying requirements for the
surrounding area of interest, we propose the following scope and fee.
Design Phase L30%, 60%, 90% and Final Deliverables)
Provide civil drawings and specifications for the following:
• Existing Paving and Drainage Demolition as required
• Proposed Paving for the JHEC WRF Expansion
• Proposed Grading and Drainage for the JHEC WRF Expansion
• Stormwater Pollution Prevention Plan and Details
• Civil Details as required to support the paving, grading and drainage work. Some
of these may be covered by City of Pearland Standard Details.
• Three dimensional CADD files will be uploaded weekly on the project shared
folder. Briones did the survey work for the previous project, which was set up in
AUTO CADD, Civil 3D.
Bid Phase
• Provide answers to Bidders questions and prepare addenda items as required.
Additional Topographical Survey
• Establish Vertical and Horizontal Control using GPS
• Survey Existing Topographical within the project Scope
• Provide Base File on the Project Shared File System

In accordance with your e-mail request on October 5, 2018 Geotest Engineering, Inc.
(Geotest) is pleased to present this proposal for additional geotechnical investigation of the
referenced project. The additional scope includes providing deep foundation recommendations
for proposed SBR structure and foundation recommendations for Influent Screening Facility
(about 35 feet deep).
The scope of the project includes drilling and sampling one (1) 80-foot deep boring for
SBR structure and one (1) 60-foot boring for the Influent Screening Facility, abandon previously
installed piezometers, performing laboratory tests, perform engineering analyses and prepare an
addendum report to the original geotechnical report. The cost for drilling, abandoning
piezometers, laboratory testing and additional analyses is a lump sum cost of$13,405.00. A cost
breakdown is presented on Attachment No. 1. If you have any questions,please contact us.

The proposal is developed per our understanding, discussion, and scope of work to provide
electrical design and support services for expansion of John Hargrove WRF.
A. Scope of Work
1. Design will include a new CenterPoint Energy Service as described in the PER
2. Design will include modifications and additions to existing Switchgear and MCCs to
support the process upgrades as described in the PER.
3. Electrical design to support process units and buildings as described in the PER.In general,
these consist of the following:
a. Influent Lift Stations
b. Proposed Headworks
c. Odor Control (Influent Lift Stations and Proposed Headworks)
d. Sequencing Batch Reactors and Blowers
e. Filters (existing and proposed)
f. UV Disinfection (existing)
g. Aerated Sludge Holding Tanks and Blowers (existing and proposed)
h. Proposed Dewatering Facility
i. Proposed NPW Pumping, Storage,and chemical feed system
j. Operations Building and Maintenance Shop and modification to existing operation
building miscellaneous electrical and lightings
4. Additions to site and structure lighting as required.
5. Operations Building(^3,400 square feet)—the preliminary space planning is in the table
below. Since this was put together,the City has designated the JHEC WRF to be a staging
area during emergency events (hurricanes,flooding, etc.), so the facility needs a kitchen
capable of preparing meals for 15 to 20 people.The site will also need shower and
locker room facilities.
6. Maintenance Shop and Locker Room Facilities—The maintenance shop(^2,100 square
feet)will include work and storage areas. It is possible that these two areas could be
combined with the Operations Building. If so,the Operations Building will likely need to
move to the area where the Maintenance Shop and Locker Rooms are shown on the site
plan.
7. The City currently uses Convergint(https://www.convergint.com/)for building and site
security, so we will need to coordinate with then during the design phase.

8. The City currently uses Climatec for building automation
(http://www.climatec.com/services/building-automation/)so we will need to
coordinate with them during the design phase.
B. Engineering Services
1. Prepare design document including drawings and specifications development per
scope of work defined above.
2. Provide 30%, 60%, 90%, and final drawings and specifications and construction
cost estimate.
3. Use the City of Pearland building codes
4. Drawings will be provided per level of effort proposed list of sheets that include
only electrical drawings and specification for a construction bid document and
associated construction costs.
5. GAI will provide drawings and specification in PDF for delivery per item 2 above.

Dear Mr. Munson:
The office of PGAL is pleased to present this scope of work and fee proposal for the
architectural design of the new City of Pearland John Hargrove Water Reclamation
Facility Expansion Project. PGAL is currently working on other projects with the City of
Pearland and Ardurra Group and are prepared to complete this project providing
architectural design services for schematic design,design development,construction
documentation and bidding. We can also provide services for construction
administration, but have not provided a fee as part of this proposal at this time,as those
services will be contracted separately at a later date. PGAL will be a consultant to
Ardurra Group,who will manage the project and contract with the remainder of the
consultants,such as Structural, Civil and MEP Engineers, Landscape Architect,and other
specialty consultants.
PROJECT UNDERSTANDING
The project consists of an approximately 3,400 GSF operations building to include a
training room for 50 people,and operation control room,document room,
breakroom/kitchen,two offices,reception,janitor closet, restrooms and associated
mechanical electrical and telephone rooms. The facility will also include an
approximately 2,100 FSF maintenance shop with locker room facilities,work and
storage areas. It is possible that the operations and maintenance buildings will be
combined into a single building. Other structures on the campus include a non-potable
water facilities building,a dewatering building and a 50'x 50'covered storage canopy.
The existing control building will also require some renovation work to both interior
and exterior.

SCOPE OF WORK
To start off the project, PGAL will conduct architectural programming meetings in order
to determine the needs and desires of the users and create a program document of all
spaces in each building. In the upcoming final design phase of the work PGAL and the
A/E team will complete the construction documents for bidding/pricing and provide
construction administration services through the completion of the project.
Documentation will be provided for the buildout of all spaces.
COMPENSATION
As requested,we have provided a lump sum fee:
• Schematic Design (I 5%) $ 26,440
• Design Development(20%) $ 35,255
• Construction Documents (40%) $ 70.510
• Bid/Negotiating(5%) $ 8,815
• Construction Administration (20%) $ 35,255
• Total(100%) $ 176,275
Reimbursable Expenses: PGAL would expect to be reimbursed for any out of pocket
expenses we incur on behalf of this project,to include, but not limited to, printing,
plotting, photography, permits,fees,special handling or delivery, mileage and travel (if
necessary). Reimbursable expenses will be billed at our cost,and are estimated not-to-
exceed $4,675 to complete the project through construction.
Additional Services: If services other than those described above are requested and
approved by the City of Pearland or the Ardurra Group, they will be billed in addition to
the above compensation in accordance with PGAL's personnel rate schedule for 2019.
Terms: PGAL will invoice monthly based on a percentage of project completion.
Payments are due within thirty(30) days of receipt of invoice.

understanding that the expansion at the facility will include the following items:

It appears that some soil improvements will be required at various heavily loaded structures.
These soil improvements may consist of over-excavation and/or possibly deep foundations
such as drilled shafts.
SCOPE OF SERVICES
Wekiva proposes the following work task:
Task 1:Prepare Drawings and Specifications(30%, 60%, 90%&Final): Wekiva staff will prepare
drawings and specifications for the design items noted above. It is anticipated that there will
be approximately 60 drawings and standard Division 3, 4, and 5 specifications along with a
Division 13 pre-engineered metal building specification. Wekiva will prepare 3D CAD drawings
of each structure for sharing with other disciplines on a weekly basis.
Task 2: Services during Bidding: Wekiva staff will assist Ardurra by responding to questions
during bidding and assisting in the preparation of addenda for structural items. We will also
prepare conformed drawings and specifications based on the addenda.

As I mentioned yesterday,our team was selected by the City of Pearland to perform Professional Engineering and
Construction Phase services for the John Hargrove Environmental Center(JHEC)WRF Expansion Project. I am working
with Jeff Peters to prepare the Final Design Phase, Bid Phase and Construction Phase Services level of effort for the
project.To assist with this, could you please provide a level of effort estimate to provide the site civil design services
(paving,grading and drainage), including bidding and construction phase support,for the project?
I have attached the existing paving,grading and drainage plan for the site form the 2007 Expansion Project for your
reference. Please let me know if you want to discuss.
Also attached is the proposed Site Plan,which includes highlighted areas and callouts for my best estimate of new
pavement at this time.The site will also require various sidewalks to process units and other building for personnel
access. Note that the Operations Building and Maintenance Shop could get combined in the location of the Maintenance
Shop,which would have some impact of paved area.This decision will be made at the beginning of the Final Design
Phase during an Architectural Programming Workshop.
Design Phase(30%,60%,90%and Final Deliverables)
Provide civil drawings and specifications for the following:
• Existing Paving and Drainage Demolition as required
• Proposed Paving for the JHEC WRF Expansion
• Proposed Grading and Drainage for the JHEC WRF Expansion
• Stormwater Pollution Prevention Plan and Stormwater Pollution Prevention Plan Details
• Civil Details as required to support the paving,grading and drainage work.Some of these may be covered by City
of Pearland Standard Details.
• 3D CAD will be used for the design of the project. For the 3D model, we will set up a shared Dropbox and ask
each discipline to upload a DWG version of their current model on a weekly basis (e.g. Friday afternoon).This
will allow us to review progress and create the Navisworks file as needed.The Dropbox will also provide all
disciplines with access to updated files for backgrounds, XREFs, etc. Briones did the survey work for the project,
which was set up for the use of Civil 3D.

Could you please provide a proposal to perform two (2) additional borings at the John Hargrove WRF and update the
Final Geotechnical Report accordingly?
One would be a boring deep enough in the vicinity of GB-2 to allow for deep foundation recommendations to be
developed and the second would be in the vicinity of the Influent Screening Facility(structure will be 35' deep)to
determine existing soil conditions in that location.
Also,the piezometers can be abandoned when you are onsite for the new borings.
We plan on turning in our Final Design Scope and Fee early next week,so a quick turnaround on your proposal would be
much appreciated!

Bid Phase
• Provide answers to Bidders questions and prepare addenda items as required.
Construction Phase
1
• Provide structural related submittal and shop drawing review.
• Assist with response to Contractor RFIs relating to structural work.
• Conduct site visits as necessary to review status of structural work.
I have also attached a LOE spreadsheet that you can use if you want (add sheets and task names as needed).The fields
should calculate as hours are populated.We'd like to have our level of effort pulled together by the end of the month,
so if you could get this turned around in a week or so that would be helpful!
