A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, APPROVING CHANGE ORDER NO. 6 ASSOCIATED WITH THE
DIXIE FARM ROAD PROJECT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That Change Order No. 6 associated with the Dixie Farm Road Project,
a copy of which is attached hereto as Exhibit "A" and made a part hereof for all purposes, is
hereby authorized and approved.
Section 2. That the City Manager or his designee is hereby authorized to execute
and the City Secretary to attest Change Order No. 6 associated with the Dixie Farm Road
Project.

Dear Joe:
Per our coordinations and meetings with City, Harris County, and TxDOT, we prepared this
Supplemental #6 for the referenced project to revise TxDOT's Phase 1 PS&E to design a
left-turn lane bay, a cross-over, and pavement tie-in and all other related changes to plans and
quantities for the connection of Blackhawk Blvd. to Dixie Farm Road. As you know this
new roadway has been completed in the past 2 months and is about to be opened. Our
proposal also includes a signal warrant study and a signal design for the intersection. It is
assumed that no right-turn lane would be warranted. This proposal does not include any
potential R.O.W. acquisition (corner clip) surveying. It is assumed that Harris County would
undertake that if warranted.
Our proposal consists of FNI-LAN fees to design the roadway and drainage related items, a
fee from TEDSI Infrastructure Group to design the signal and conduct the signal warrant
study, a fee from Wilson Survey Group for gathering survey information on pipelines, and a
fee from Cobb, Fendley & Associates on SUE for more accurately locating pipeline(s) with

respect to a possible signal pole in the pipeline easement. Please note that SUE budget is
based on 10 hours of pipeline(s) locating with equipment and technicians. All pipelines will
be probed first by pipeline companies by conventional method. We will use SUE budget on
as-needed basis. Budget does not include SUE for all pipelines.
The breakdown for this Supplemental #6 is attached. The total fee is $49,233.11. Attached
are two (2) originals of Supplemental #6 for your review and approval. Please forward us
one signed copy if this fee proposal meets with your approval.

This letter is our proposal to provide surveying and mapping services at the intersection of
Blackhawk and Dixie Farm Road in Peafland, Texas. This roadway has been constructed
subsequent to the completion of the topographic survey update. We understand that we am to
locate pipelines that cross Blackhawk in the vicinity of this intersection after the pipeline
companies mark them horizontally and vertically. We will also provide you with additional
topographic information needed to design the signalization of this intersection.
We understand that we will provide you with the electronic field survey data and that you will
insert this information into your drawing. This information can be made available within six (6)
working days following written authorization to proceed. The cost to provide these services will
be $950.00. We understand that the issuance of a Purchase Order Number will serve as our
authorization to proceed.

Dear Mr. Bavarian:
TEDSI Infrastructure Group (TEDSI) appreciates the oppommity to submit this lump Sum
"Supplemental" proposal to Freese and Nichols, Inc. and Lockwood, Andrews & Newnam,
Inc., Joint Venture (FNI - LAN) to perform traffic engineering services required in conjunction
with the Dixie Farm Road Widening PHASE I, from Beamer Road to Farm to Market Road 518
(FM 518).
This proposal is based on our understanding of the Scope of Services as discussed in our recent
telephone conversation. The engineering services to be provided by TEDSI consist of
conducting a Traffic Signal Warrant Study, for the "future" intersection of Dixie Farm Road at
Blackhawk Boulevard, and if warranted, the Traffic Signal Design for this intersection.
PROJECT UNDERSTANDING
A Traffic Signal Warrant Study will be conducted for the intersection of Dixie Farm Road at
Black_hawk Boulevard. The study will be based on the proposed intersection geometry, existing
traffic counts and projected volumes for YEAR 2008 completion date.
Based on the results of the Traffic Signal Warrant Study conducted for this intersection, if
signalization is warranted and approved by TxDOT, a traffic signal design will be provided for
this intersection.
It is our understanding that FNI-LAN will provide TEDSI all the required electronic files for the
"approved" proposed geometry for the intersection and any other pertaining information available
to FNI-LAN.

TEDSI will include with the signal design all the recommended improvements. Since this
intersection falls within the jurisdiction of Harris County, the proposed traffic signal design will
be in accordance with Harris County Public Infrastructure Department Traffic & Transportation
Section (HCPID T&T) guidelines.
TEDSI would be required to complete the PS&E for the "Permanent" traffic signal and
incorporate the plans with the other signals located in PHASE I (Dixie Farm Road at Beamer
Road, Mc Donald, Mc Ginnis and FM 518 intersections).
SCHEDULE:
The services provided by TEDSI will be in collaboration with and in character, sequence and
timing so as to coordinate with the services provided by FNI-LAN.
We estimate fifteen to twenty-five (15-25) calendar days to complete the Traffic Signal
Warrant Study and, if warranted and approved by TxDOT, it will require thirty 00) calendar
days for the Traffic Signal Design, after a written notice to proceed is received from FNI-LAN.
These estimates are contingent upon the availability of information to be provided by FNI-LAN
and the electronic files. This estimate does not include the time necessary for agency review.
SCOPE OF WORK:
TASK A - TRAFFIC SIGNAL WARRANT STUDY:
TEDSI will obtain all the traffic-data required to conduct the study, such as 24-hour approach
counts, operating speeds, etc. Based on the traffic data obtained and information provided by
FNI-LAN, TEDSI will determine the projected traffic volumes and conduct a Traffic Signal
Warrant Study for the intersection of Dixie Farm Road at Black_hawk Boulevard, in accordance
with the guidelines published in the Texas Manual on Uniform Traffic Control Devices
(TMUTCD) and TxDOT procedures. Warrants will be based on opening day traffic volumes
(2008).
TEDSI will submit three (3) draft copies of the study to FNI-LAN for review and comments by
all the required agencies. The study will provide recommendations for improvements along with
construction cost estimates. After review comments are received, TEDSI will provide five (5)
copies of the "final" report.
TASK B - TRAFFIC SIGNAL DESIGN:
If signalization is warranted and approved by TxDOT, TEDSI will prepare Design Plans and
Cost Estimate for the proposed traffic signal installation for the intersection of Dixie Farm Road
at Blackhawk Boulevard. The design, drawings and estimates will conform to current Harris
County criteria.
The drawings will be based on electronic files provided by FNI-LAN, including the updated
topographic survey and design changes for the above-mentioned intersection.

The traffic signalization will consist of a full vehicle actuated system with a ground-mounted
controller/cabinet. Interconnect system is not considered at this time. The traffic signal hems
will be suspended from four steel strain poles in a catenary span wire system. The signal will
include two (2) standard luminaire arms with HPS luminaires. Pedestrian signal indications with
all required call buttons and signing for all approaches will be included as directed by HCPID.
It is assumed that the construction of the traffic signal will be bid and constructed with the
proposed roadway construction of Dixie Farm Road. It is our understanding that the proposed
ultimate intersection geometry will be constructed prior to the construction of the traffic signal
and as such, construction of "temporary traffic signal" during construction shall not be required.
COMPENSATION:
TASK A - TRAFFIC SIGNAL WARRANT STUDY:
The total Lump Sum Fee for providing the services described above is set at $5,900.00 (please
see attached break-down cost). The amount shown includes all necessary direct expenses
estimated for this project. This fee includes all labor and non-labor reimbursable expenses
required to complete the effort as specified above.
TASK B - TRAFFIC SIGNAL DESIGN:
The work as described above for the Signal Design will be performed at a Basic Fee of
$16,000.00 (please see attached break-down cost). The amount shown includes all necessary
direct expenses estimated for this project. This fee includes all labor and non-labor reimbursable
expenses required to complete the effort as specified above. Any work not specifically stated
above will be considered as additional work and will be subject to negotiation.

We recently received Supplemental Agreement Number 6 to the contract for the subject
project, between the City of Pearland and Freese and Nichols, Inc. (FN). The supplemental
agreement provides for additional work for the consultant to prepare the plans for a new
signalized intersection at a new Brazoria and Harris County roadway. This will change the
amount payable under the contract from $2,008,336.91 to $2,057,570.02.
We have reviewed this supplemental agreement and have determined that it adequately
describes the work to be performed and that it is for a fair and reasonable price.
Please let this letter serve as our official concurrence to Supplemental Agreement Number 6.
We request that you proceed to execute this supplemental agreement with FN at your earliest
convenience.
