A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, APPROVING SUPPLEMENTAL AGREEMENTS NOS. 4 AND 6
FOR ENGINEERING AND SURVEYING SERVICES ASSOCIATED WITH
THE MAGNOLIA ROAD OVERPASS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain agreements by and between the City of Pearland and
Dannenbaum Engineering and C. L. Davis & Company are attached hereto as Exhibit "A"
and "B".
Section 2. That the work supplemental agreements #4 and #6 for engineering
and surveying services associated with the Magnolia Road overpass are hereby approved.

SUPPLEMENTAL AGREEMENT NO. 4
CONTRACT FOR ENGINEERING SERVICES
THIS SUPPLEMENTAL AGREEMENT to contract for engineering services is made by and
between the City of Pearland, hereinafter called the "City", and Dannenbaum Engineering
Corporation, hereinafter called the "Engineer", and becomes effective when fully executed by
both parties.
WITNESSETH
WHEREAS, the City and the Engineer executed a contract on the 25th day of October, 1999,
concerning advanced planning, final PS&E and review of shop drawings for improvement of
Magnolia Road from the proposed Burlington Northern/Santa Fe Railroad overpass to SH 35;
and ,
,WHEREAS, Article 3, Contract Period, limits the contract termination date to December 31,
2002 as executed in Supplemental Agreement No. 1 to the contract, dated June 25, 2001; and
WHEREAS, Article 2, Scope of Services, defines the current scope of work and it has become
necessary'to amend said scope of work; and
WHEREAS, Article 4, Compensation, limits the maximum amount payable of the contract to
$600,251.32 as executed in Supplemental Agreement No. 3 to the contract; and
WHEREAS it has become necessary to amend the contract;
AGREEMENT
NOW THEREFORE, premises considered, the City and the Engineer agree that said contract is
amended as follows:
Article 2, Scope of Services to be Provided by Engineer, is 'amended to provide:
additional survey services for expanded drainage and right-of-way requirements; and
II. Article 4, Compensation, is increased from the original contract amount of
$600,251.32 to $647,605.55, a total increase of $47,354.23.

stonnwater detention facilities; and
II. Article 4, Compensation, is increased from the original contract amount of
$659,059.98 to $694,206.78, a total increase of $35,146.80.

Gentlemen:
Pursuant to the published Notice to Bidders, the undersigned bidder hereby proposes to do all the
work and furnish all necessary superintendence, labor machinery, equipment, tools and
materials, and v hatever else may be necessary to complete all the work included under the
General Contract for the construction of approximately 38,937 SY of 9" jointed reinforced
concrete pavement (by slipform paver only), 12" lime stabilized subgrade, 112,104 CY
embankment, 24,500 SF of bridge, 18,207 LF 18' RCP thru 12' x 10' RCB storm sewer, inlets,
manholes, junction boxes, detention pond excavation, slope paving, retaining walls, tie-in to
Beltway 8, feeder road, B.W. 8 overhead and roadway signs, asphalt pavements, landscaping and
irrigation, electrical conduit, pollution prevention, Add -on Alternate for pavement marking and
signage, etc. with all related appurtenances, complete, tested and operational, in accordance with
the plans, and specifications prepared by the Engineer, Walsh/Freese & Nichols, Inc. -
Lockwood, Andrews and Newnam, Inc under the City of Pearland's inspection for the unit prices
set forth on the attached bid sheet which bears our signature for identification. It is understood
that, in the event any changes are ordered made in any part of the work, the unit prices bid shall
apply as additions to or deductions from the total prices for the parts of the work so changed.

The bidder binds himself upon acceptance of his proposal to execute a contract and furnish
performance bond and payment bond each in the amount of one hundred percent (100%) of the
total contract price, according to the specified forms within fifteen (15) days after notification of
award of contract, for performing and completing the said work within the time stated, and
furnishing a satisfactory maintenance bond indemnifying the Owner against defective
workmanship and material for a period of one (1) year

The undersigned bidder agrees to commence work within ten (10) days after the date of a written
notice to commence work. It is understood and agreed that the Contractor shall complete the
work and make ready for operation the portion of the project between Stations 116+00 and
186+00 by May 26, 2003 ($750.00 liquidated damages for not completing on time) and the entire
project within 365 calendar days (liquidated damages or early -completion bonus at $500 per
calendar day). Time for completion shall begin as stated upon the issuance of the notice to
commence work.
