Ord. 1064 06-10-02ORDINANCE NO. 1064 AN ORDINANCE TERMINATING THE OPERATION AND EXISTENCE OF REINVESTMENT ZONE NUMBER ONE, CITY OF PEARLAND, TEXAS, MAKING CERTAIN FINDINGS RELATED THERETO, AND DECLARING AN EMERGENCY. WHEREAS, by City of Pearland, Texas, Ordinance No. 834 adopted the 8th day of December, 1997, the City created Reinvestment Zone Number One over the area described in Exhibit "A" and depicted in the map attached to said Ordinance (the "Zone"). WHEREAS, pursuant to Chapter 311 of the Texas Tax Code, a reinvestment zone may terminate on the date designated by an ordinance adopted subsequent to the ordinance creating the zone; and WHEREAS, the Zone has been fully developed and all project costs have been paid in full and no further need exists for the Zone. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. Findings. That the facts and recitations contained in the preamble of this Ordinance are hereby found and declared to be true and correct and are adopted as part of this Ordinance for all purposes. That the City Council finds that the Zone meets the criteria of Section 311.017 of the Texas Tax Code because the operation of the Zone may be terminated by an ordinance adopted subsequent to the ordinance creating the Zone. Section 2. Termination of the Zone. That the City Council, acting under the provisions of Chapter 311, Texas Tax Code (the "Act"), including Section 311.017(a)(1), does hereby terminate the operation and existence of the Zone. Section 3. Effective Date. This Ordinance shall become effective immediately upon its passage and approval by City Council. ORDINANCE NO. 1064 Section 4. Declaration of Emergency. The Council finds and determines that this Ordinance shall be adopted as an emergency measure, and that the rule requiring this Ordinance to be read on two (2) separate occasions be, and the same is hereby waived. Section 5. Conflicts. All ordinances and agreements and parts of ordinances and agreements in conflict herewith are hereby repealed to the extent of the conflict only.
