Ord. 2000M-0175 2018-10-22 Ordinance No. 2000M-175 An Ordinance of the City Council of the City of Pearland, Texas, amending Ordinance No. 2000M, the zoning map of the City of Pearland, Texas, for the purpose of amending the text within an approved planned development located on certain property, Lot 3 in Block 1 being 7.443 acres of a subdivision of 11.759 acres located in the H.T. B. R.R. Co. Survey, Abstract No. 546 in the City of Pearland, Brazoria County, Texas. (South and east of property addressed 7110 Magnolia Road, Pearland TX.) Zone Change Application No. ZONE 18-00013, a request of Alan Mueller, applicant on behalf of Marilyn Bullard, owner; approval of amendments to the text within the Midtown at Magnolia Planned Development regarding development of the townhouse tract; on approximately 7.443 acres of land; providing for an amendment of the zoning district map; containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. WHEREAS, Alan Mueller, applicant on behalf of Marilyn Bullard, owner; is requesting approval of amendments to the text within the Midtown at Magnolia Planned Development regarding development of the townhouse tract on approximately 7.443 acres of land on the following described property; said property being legally described in the legal description attached hereto and made a part hereof for all purposes as Exhibit "A," and more graphically depicted in the vicinity map attached hereto and made a part hereof for all purposes as Exhibit "B"; and WHEREAS, on the 10th day of September 2018, a Joint Public Hearing was held before the Planning and Zoning Commission and the City Council of the City of Pearland, Texas, notice being given by publication in the official newspaper of the City, the affidavit of publication being attached hereto and made a part hereof for all purposes as Exhibit "C," said call and notice being in strict conformity with provisions of Section 1.2.2.2 of Ordinance No. 2000T; and WHEREAS, on the 11th day of September 2018, the Planning and Zoning Commission submitted its report and recommendation to the City Council regarding the proposed amendments to the text within the Midtown at Magnolia Planned Development regarding development of the townhouse tract on approximately 7.443 acres of land, said recommendation attached hereto and made a part hereof for all purposes as Exhibit "D"; and WHEREAS, upon receipt of the report from the Planning and Zoning Commission, City Council considered this application and the recommendation of the Planning and Zoning Commission at regular meetings on the 8th day of October 2018 and the 22nd day of October 2018; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and having been fully advised in the premises, finds that in the case of the application of Alan Mueller, applicant on behalf of Marilyn Bullard, owner; for approval of amendments to the text within the Midtown at Magnolia Planned Development regarding development of the townhouse tract; on approximately 7.443 acres of land; presented which, in the judgment of the City Council, would justify the 0 approval of said application; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section I. The following described property located within the corporate City Limits of the City of Pearland, Texas, and presently being located within the Planned Development zoning district, is hereby granted approval of amendments to the text within the Midtown at Magnolia Planned Development regarding development of the townhouse tract, in accordance with all conditions and requirements of the current Unified Development Code and the following conditions approved by the City Council Page 2 of 8 Ord. No. 2000M-175 and incorporated for all purposes, such property being more particularly described as: Legal Description: Lot 3 in Block 1 being 7,443 acres of a subdivision of 11.759 acres located in the H.T. B. R.R. Co. Survey, Abstract No. 546 in the City of Pearland, Brazoria County, Texas. General Location: South and east of property addressed 7110 Magnolia Road, Pearland TX. Section II. The City Council of the City of Pearland finds and determines that the recitations in the preamble hereof are true and that all necessary prerequisites of law have been accomplished and that no valid protest of the proposed change has been made. The City Council further finds and determines that there has been compliance with the mandates of law in the posting and presentation of this matter to the Planning and Zoning Commission for consideration and decision. Section III. The City Council of the City of Pearland finds and determines that the amendment adopted herein promotes the health, safety, and general welfare of the public and is a proper valid exercise of the City's police powers. Section IV. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section V. All rights and remedies, which have accrued in the favor of the City under this Ordinance and its amendments thereto, shall be and are preserved for the benefit of the City. Section VI. No. 2000M-175 Exhibit E Midtown at Magnolia Amendment #1 As to Tract 3 - Townhomes °I4t9114 44-°-1.1114 116/ July 24, 2018 Midtown at Magnolia Amendment #1 As to Tract 3 -Townhomes A Introduction This amendment pertains only to the Townhome Tract 3 (now platted as Lot 3, Block 1,Midtown at Magnolia). Unless specifically described in this amendment, all conditions of the original PD remain in effect. The original PD,approved in 2016,was written for a specific townhome builder that ultimately did not purchase the property. The original PD allowed 25-foot TH lots only when the homes had rear loaded garages with front yards opening on a common open space (instead of fronting on a traditional street). This amendment is intended to accommodate a front loaded 25-foot wide townhome product on a more conventional residential street. This amendment applies only to Lot 3, Block 1, of the Midtown at Magnolia plat, recorded October 18, 2016 (Exhibit 1). 1. Description of the Property From the original PD,Tract 1 has been developed as a CVS pharmacy;Tracts 2 and 3 remain vacant and undeveloped. Subsequent to approval of the PD, the property has been platted into 3 lots consistent with the original PD. 2. Description of Proposed Development The proposed development of Lot 3 consists of 44 individual 25-foot width townhome lots,open space, and other amenities and improvements consistent with the original PD. 3. Description of the Area The land subject to this amendment consists of Lot 3, Block 1, Midtown at Magnolia plat, containing 7.443 acres as shown in Exhibit 2. 4. Existing Zoning The property is currently zoned under the Midtown at Magnolia PD approved by Ordinance 2000M-142 on February 8, 2016. 2. Proposed Base Zoning Districts The proposed base zoning district for Lot 3 remains Townhouse(TH), consistent with the original PD with the acreages from the plat shown in Table 1. Lot 2 is slightly smaller, and Lot 3 slightly larger, than anticipated in the original PD due to the access flag to Magnolia Road being deducted from Lot 2 and added to Lot 3.
