TEXAS, APPROVING CHANGE ORDER NO. 5 ASSOCIATED WITH THE
DIXIE FARM ROAD PROJECT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That Change Order No. 5 associated with the Dixie Farm Road Project,
a copy of which is attached hereto as Exhibit "A" and made a part hereof for all purposes, is
hereby authorized and approved.
Section 2. That the City Manager or his designee is hereby authorized to execute
and the City Secretary to attest Change Order No. 5 associated with the Dixie Farm Road
Project.

Dear Joe:
Per your request please find enclosed our Change of Contract No. 5 for the referenced
project. The proposed scope of changes is the result of several coordination/progress
meetings we have had with the City staff in the past several months and coordination
meetings we had with TxDOT representatives. The changes to PS&E include updating
topography, sound wall design and workshop, specifications update, surveying,
coordinations, signals update, additional geotechnical, environmental and landscape design
services. It also included the requested phasing of the referenced project.
It is the intent of the City to construct Dixie Farm Road in two (2) phases. Phase 1 is from
Beamer Road to approximately 1,500' south of Broadway (FM 518). Phase 2 is from 1,500'
south of Broadway (FM 518) to State Highway 35 (SH 35). This change of contract only
covers the tasks and efforts needed to undertake the preparation of Phase 1 PS&E. In doing
this, the current plans which are at the 90% level would have to be separated, the Phase 1
plans for the limits mentioned above would have to be updated and completed in accordance
with the tasks enumerated below and submitted to City and TxDOT for 95% complete review
and comments and the eventual completion. The changes and updates for Phase 2 are not
included in this change of contract.
For the purpose of this change order which TxDOT will participate in funding, the change
order for water and sewer design and update are not included. A separate fee is provided for
this City-funded design services.
Below is a brief summary of major tasks which need to be undertaken to update, redesign,
modify, and separate the plans for Phase 1 PS&E:

Topo Update: Since August 2001 which was the time the Project's aerial
mapping was flown, topography has changed considerably in some areas, which
would affect the roadway and storm sewer designs, traffic control plans,
intersection layouts, quantities, and numerous other related items. Some of these
changes include roadway widenings for left-turn lanes at McDonald and
McGinnis within Phase 1 limits, installation of a number of culverts and drives,
widening of comers at FM 518, placement of sidewalks, landscaping and other
items. This update would require additional engineering and drafting to update
construction plans, quantities, and other related items. Fee for this task is
$17,213.33.

Phasing: Due to funding, the City requested a phased implementation plan.
Phase 1 will be from Beamer Road to 1,500' south of FM 518. Phase 2 will be
from 1,500' south of FM 518 to SH 35. For this supplemental, the original plans
and quantities will be revised to remove the plans, details, computations,
quantities, and all other related items for the segment from 1,500' south of FM
518 to SH 35 out of plan set; modify the design of roadway, storm sewers,
drainage area map, traffic control, and other related items, for the transition
segment; and revise other appropriate plans, details, quantities, and standards.
Fee for this task is $32,397.15. This fee is to supplement what is remaining in the
contract to complete the PS&E for Phase 1.

2004 Specifications: Study the 2004 specifications and revise necessary plans,
details, typical sections, units of measure, pay items, recompute the necessary
quantities, and any other component which require change. Fee for this task is
$18,818.61.
Sub-Consultants Coordiantions: Extra manhours needed to meet, coordinate and
provide the necessary information to our sub-consultants to revise their portion of
work. Fee for this task is $4,280.73.

Sound Wall Workshop: This budget is to assist the City in preparation and
conducting a workshop with residents in Dixie Hollow and Dixie Woods
subdivisions whose homes are adjacent to Dixie Farm Road which will be
affected by the placement of sound walls. Fee for this task is $2,154.94.
Sound Wall Design & Details: This budget is to cover the design and preparation
of plans and foundations design for the sound walls along Dixie Hollow and Dixie
Woods subdivisions. Fee for this task is $15,683.87.
The total fee for Items A thru F is $90,548.63.

3. Reimbursable Expenses:
An extra budget of $1,990 is proposed for extra printing, mileage, deliveries.
The attached spread sheets show the breakdown for each of the above tasks to be done by
FNI-LAN. Also attached are sub-consultant's proposals. Please note, all changes are for
Phase 1 PS&E only. The total proposed Supplemental (Change of Contract No. 5) is
$122,876.50 therefore, the original TxDOT-funded contract amount would increase from
current $1,885,460.41 to $2,008,336.91.
Finally, we would like to mention that the original FNI-LAN contract fee has been impacted
throughout the design by numerous changes. Some of these are: 1) raising of roadway
profile from north of Mary's Creek Bypass thus changes to profile, median, widths,
sidewalks, etc., 2) due to restricted R.O.W., we had to provide in some segments, retaining
walls, 3) as result of potential conflict with waterline, the sidewalks south of Mary's Creek
Bypass had to be relocated closer to curb line, 4) monthly meetings with City staff since mid
or late 2003 (these meetings have been very helpful in keeping everyone abreast of all
components of project being worked on). We hope above requested fees will supplement the
current fees to complete the Phase 1 PS&E.
As mentioned previously a separate fee budget will be provided for the water and sewer
design and updates. Please also note that. A totally separate fee would be required in the
future to complete the plans for Phase 2 PS&E.

the above captioned project, please be advised that we have reviewed our breakdown of' man-
hours required to accomplish the traffic engineering services required to perform the revisions to
our design plans, as submitted on our Supplemental Proposal dated September 29, 2004, and we
kindly submit the following explanation for consideration:
These are some of the items that need to be addressed when revising the drawings: · Coordinate project issues and updates with FNI-LAN, TxDOT, City of Pearland and

· Revise temporary signal layout at Beamer Road and FM 518 to accommodate new
geometry.

DIXIE FARM ROAD WIDENING PROJECT
SH 35 TO BEAMER ROAD
PEARLAND, BRAZORIA AND HARRIS COUNTIES, TEXAS
Dear Mr. Bavarian:
Tolunay-Wong Engineers, Inc. (TWEI), is pleased to submit this proposal to provide additional
geotechnical services for the referenced project. The additional work in this project consists of the
construction of a Sound Wall for the proposed Dixie Farm Road widening project. Preliminary project
details were provided by you during our telephone conversation on September 11, 2004. The proposed
Sound Wall will be constructed in three areas. Site No. 1, in the vicinity of Boring CB-9, Site No. 2, in the
vicinity of Boring CB-10, and Site No. 3, in the vicinity of Boring CB-21. The proposed three sites are
anticipated to be no deeper than about 15-ft. The proposed Sound Wall is about 8 feet high and should be
designed to withstand 125 miles per hour wind force. TWEI prepared a geotechnical report for this project
on November 30, 2002.
Scope of Services
Our scope of services covered in this proposal will consist of the preparation of the final
geotechnical engineering report for this project which will include TWEI geotecl-mical design
recommendations for the proposed Sound Wall.
Field Exploration. There will be no additional field wok for the proposed Sound Wall. Borings
CB-9, CB-10, and CB-21 from TWEI project No. 02-071 submitted on November 30, 2002 will be utilized
for the proposed Sound Wall foundations.
Engineering Report. We will interface with the FNI design team during the course of the study to
discuss the geotechnical information for the proposed Sound Wall. We will prepare a final engineering
report that will present our findings and provide you with geotechnical design and construction
recommendations for this project, including the geotechnical design recommendations for the proposed
Sound Wall.
The lateral load analyses for the drilled shafts will be analyzed using the p-y method in which the
soil is modeled as a series of non-linear springs. This procedure with appropriate computer codes (i.e.,
LPILE by Ensoft, Inc.) has the advantage that the major factors influencing soil resistance are inherently
included in the semi-empirical p-y design criteria. We will utilize the computer code software "LPILE

4.0m" by Ensoft, Inc. to analyze the single foundation resistance to lateral loads. This LPILE 4.0m program
runs under the Microsoft® Windows operating systems.
Budget
Our estimated cost for the above-described services is $990 and will not be exceeded without your
prior written authorization for the proposed Sound Wall including issuing the Dixie Farm Road Widening
final geotechnical report.
Schedule
We can complete the analyses and issue our final geotechnical report within 10 days after receiving
authorizations to proceed and loading conditions for the proposed Sound Wall. We can furnish you with
verbal preliminary information upon completion of the analyses.

Update Topographic Survey
Dear Mr. Bavarian,
This letter is our proposal to provide surveying and mapping services to update the topographic
survey information on the Dixie Farm Road-Phase One Project in Pearland, Texas. The project
commences at the Mary's Creek Bypass and extends to Beamer Road. The existing
topographic information is based on aerial photography prepared in August, 2001. There have
been numerous changes in the features such as turning lanes, ddves, utilities constructed
and/or relocated, drainage courses altered, etc. The project route will be visually inspected and
any changes in the topographic and planimetric features will be horizontally and vertically
located. This will include, but not be limited to: changes in pavement, changes in back of curb
locations, additions or deletion of utility structures and/or poles, and changes to drainage
channels. These changes will be limited to the area within the proposed right-of-way lines and
25-feet outside of the proposed right-of-way lines. We will supply a digital file containing all of
the changes· Freese-Nichols can then modify their design drawings accordingly.

As requested, Corrigan Consulting, Inc. (CCI) has prepared and submitted the Statement of
Continuous Activity for submittal to the Texas Department o'f Transportation (TxDOT)
Houston District for the Dixie Farm Road project. In reviewing our file information, we
determined that the U.S. Army Corps of Engineers (USACE) Nationwide Permit (NWP) 14,
Linear Transportation Crossings, (Permit No. D-11737) for the project expired in 2002. The
permit provided authorization for the construction activities at three bridge crossings: Cowart
Creek and Mary's Creek in Brazoria County, and Mud Gully in Harris County, Texas. The
authorization was based on the provision that no work would be done at the Clear Creek
crossing and that Mary's Creek Bypass, a m~'m-made ditch, was determined to be non-
j urisdictionai.
Frccse & Nichols, Inc. has requested CCI to conduct a wetlands delineation and obtain the
enviromnental permits in order to meet the USACE and TxDOT requirements. The scope of
services and estimated cost is detailed below.
Item 1: Statement of Continuous Activity
Based on verbal authorization, CCI has already prepared and submitted thc Statement of
Continuous Activity. Thc Statement included a stunmary of the 2003 supplemental traffic
noise study and the status of right of way acquisitions, utility adjustments, PS&E and other
routine project activities. Based on a conversation with Mr. Jim Roscher of TxDOT Houston
District, he has received the Statement and has forwarded it to the FItWA.
Item 2: Project Coordination and Review
As mentioned above, the NWP 14 for the Dixie Farm Road project (Permit No. D-11737),
authorized by the USACE on November 17, 2000, expired in March 2002. In 2002, the
USACE reissued new NWPs and General Conditions, including a modified NWP 14.

According to thc USACE, a new NWP 14 for the project can be obtained by resubmitting a
report with a current wetland delineation and supporting attachments. Thc USACE will then
conduct a wetland delineation verification prior to authorizing the NWP 14.
CCI will review our previous pro. ject files and determine if all the attachments previously
submitted for the NWP can be utilized in the new submittal. CCI will coordinate with Freese &
Nichols, Inc. to review the Typical Bridge Crossing diagram and quantity of fill material used
in the previous submittal and verify that there have not been any significant changes since the
last NWP application. We will also coordinate with Freese & Nichols to obtain and reviewed
current construction plans, including maps and bridge cross-sections, to verify that the new
NWP 14 provisions and General Conditions will apply to the project.
For the purpose of this proposal, it is assumed that the NWP 14 will be applicable and the only
impacts will be thc road crossings at Cowart Creek, Mary's Creek, and Mud Gully. tfthe new
NWP i4 conditions cannot be met, we will coordinate with Freese & Nichols, and prepare a
revised scope of work if necessary.
Item 3: Wetland Survey and Delineation
We would conduct a field survey of the project area in order to assess the proposed impacts and
perform a wetland delineation and survey the ordinary high water tree at bridge crossings. We
will verify that conditions along the roadway meet NWP 14 criteria. We will delineate any
wetlands within the right-of-way at the bridge crossings using the routine field method from the
1987 "Corp of Engineers Wetland Delineation Manual" (Technical Report Y-87-1). Any
wetland areas will be staked by CC!.
In order to qualify for NWP 14, the discharge to non-tidal waters may not cause the loss of
greater that 55-acre of waters of the U.S. To re-confirm the total acreage of impact, a survey of
the location and dimension of the wetland boundaries and ordinary high water marks of Cowart
Creck, Mary's Creek and Mud Gully by a registered land surveyor will be required. Wilson
Survey Group will be responsible for completing the surveying and providing a map with the
surveyed wetlands and waters.
Item 4: Wetlands Report and NWP 14 Request
Upon receipt of the new surveyed maps, CCi will verify that the impacts to waters of the U.S.
are less than ½-acre, as required fbr the NWP 14. We will also verify that the impacts are less
than 0.10 acre, as previously reported. In the event that impacts are greater thm~ 0.10 acres, the
NWP may still be applicable, but a Pre-Construction Notice will also be required fbr the
project. In this event, CCI will immediately coordinate with Freese & Nichols to submit a
revised scope of work for including additional information in the submittal to thc USACE.
Assuming that the impacts are less than 0.10 acre, CCI will prepare the wetlands report and
request fbr a NWP 14, including the following ite~ns:
· Snmmary of the project area vegetation, soils and hydrology;

· Description of any wetlands and impacts to waters of the U.S. at bridge crossings;
A wTitten statement explaining how avoidance and minhnization of losses of waters
were achieved;
· New wetland data sheets and photographs;
· New smweyors drawings with delineated wetlands m~d ordinary high water lines;
· Typical bridge cross-section; and
· Maps showing project boundaries on a USGS Topographic Quadrangle, USFWS
National Wetland Inventory Map, FEMA Map, and a NRCS Soil Survey Map. For the
purpose of this proposal, we are assuming that the previous maps wili not require
modification, other that the title blocks.
CCI will submit a copy of the Draft Report for review by Freese & Nichols. Any comyncnts
will be incorporated and the Report will be submitted to the USACE.
Item 5: USACE Coordination
After submitting the application for N WP 14, CCI will coordinate with the U SACE to schedule
the fietd verification. CCI will accompany the USACE personnel to orient them to the site and
answer any questions. We will then coordinate with the USACE throughout the permitting
process to ensure that a timely response is obtained. Currently, the time required by the
USACE to complete an authorization to proceed under a NWP is approximately 45 days. UPon
receipt of the NWP from the USACE, CCI will forward the docmnentation to Freese &
Nichols. The new permit will be effective until March 2007.
Schedule and Cost
We arc prepared to begin work on this project within one week of receiving a signed
Authorization and Agreemcnt Fom~ fi-om Freese & Nichols, Inc. Based on our experience, this
project can be completed according to thc following schedule.

TEDSI Infrastructure Group (TEDSI) appreciates the opportunity to submit this lump Sum
"Supplemental" proposal to Freese and Nichols, Inc. and Lockwood, Andrews & Newnam,
Inc., Joint Venture (FNI - LAN) to perform traffic engineering services required in conjunction
with the Dixie Farm Road Widening PHASE I, from Beamer Road to Farm to Market Road 518
(FM 518).
This proposal is based on our understanding of the Scope of Services as stated in your E-Mail
dated September 21, 2004, and our recent telephone conversations.
The traffic engineering services includes the Final Design Service only. The Contract Phase
and Construction Phase are not included with this proposal.
PROJECT UNDERSTANDING
Due to project funding, the Texas Department of Transportation (TxDOT) and the City of
Pearland (COP) have decided to separate the original project (from Beamer Road to SH 35) into
two (2) Phases. TxDOT and COP would like to proceed with the completion of the design of
PHASE I (from Beamer Road to 1500 ft. south of FM 518). In addition, since the original plans
were designed under the "old" specifications, standards and guidelines, it will be required to
update the design plans to the new 2004 Specifications, Standards and Guidelines.
TEDSI would be required to complete the PS&E for all the "Permanent" and "Temporary" traffic
signals located in PHASE I (Dixie Farm Road at Beamer Road, Mc Donald, Mc Ginnis and FM
518 intersections).

The revised drawings will be based on electronic files provided by FNI - and/or LAN, including
the updated topographic survey and design changes for the above-mentioned intersections.
The revisions would be for PHASE I only and will require the updating of the basis of estimate,
overhead signs, warning signs, push buttons, power service requirements, video camera detection
layouts, modification of stop bars, pedestrian poles and all the required coordination with FNI -
LAN, TxDOT, COP and with Harris County.
SCHEDULE
TEDSI shall perform the services in collaboration with, character, sequence and timing so that it
will coordinate with services provided by FNI - LAN under the Prime Agreement. We estimate
twenty-one calendar days (21) for the completion of the Design Modifications for PHASE I,
from the date on which an executed supplemental contract and written notice to proceed is
received from FNI - LAN. The completion of work is contingent upon the availability of
required information from FNI - LAN and does not include the time necessary for agency review.
COMPENSATION
The work as defined in the Scope of Services will be performed at a Lump Sum Fee $12,037.41.
The cost proposal includes all the necessary direct expenses estimated to complete these tasks as
specified in the Scope of Services. Any work not specifically stated in the Scope of Services will
be considered as additional work and will be subject to negotiation.

I. GENERAL
All items in this addendum shall be considered additional to those of the basic contract
unless noted otherwise herein.
II. PROJECT DESCRIPTION
The project as stated in the basic contract to which this is a supplement is the Dixie Farm
Road Widening from State Highway 35 to the Pearland city limit. For the purposes of this
addendum, the project is to be modified to include only the Phase 1 portion which extends
south from the City of Pearland city limit to a point 1500 feet south of FM 518.
III. ADDITIONAL SCOPE OF SERVICES
The construction drawings most recently submitted (90% completion) and commented upon
by TxDOT encompass the original project limits but are to be revised to include only the
Phase 1 area. In addition, the drawings and specifications will be modified as necessary to
conform to the new TxDOT 2004 standard specifications.
IV. FEES
The lump sum fee required to perform the Additional Scope of Services will be $640.00.

Dear Joe:
Per your request please find enclosed our Change of Contract No. 5 for the referenced
project. The proposed scope of changes is the result of several coordination/progress
meetings we have had with the City staff in the past several months and coordination
meetings we had with TxDOT representatives. The changes to PS&E include updating
topography, sound wall design and workshop, specifications update, surveying,
coordinations, signals update, additional geotechnical, environmental and landscape design
services. It also included the requested phasing of the referenced project.
It is the intent of the City to construct Dixie Farm Road in two (2) phases. Phase 1 is from
Beamer Road to approximately 1,500' south of Broadway (FM 518). Phase 2 is from 1,500'
south of Broadway (FM 518) to State Highway 35 (SH 35). This change of contract only
covers the tasks and efforts needed to undertake the preparation of Phase 1 PS&E. In doing
this, the current plans which are at the 90% level would have to be separated, the Phase 1
plans for the limits mentioned above would have to be updated and completed in accordance
with the tasks enumerated below and submitted to City and TxDOT for 95% complete review
and comments and the eventual completion. The changes and updates for Phase 2 are not
included in this change of contract.
For the purpose of this change order which TxDOT will participate in funding, the change
order for water and sewer design and update are not included. A separate fee is provided for
this City-funded design services.
Below is a brief summary of major tasks which need to be undertaken to update, redesign,
modify, and separate the plans for Phase 1 PS&E:

3. Reimbursable Expenses:
An extra budget of $1,990 is proposed for extra printing, mileage, deliveries.
The attached spread sheets show the breakdown for each of the above tasks to be done by
FNI~LAN. Also attached are sub-consultant's proposals. Please note, all changes are for
Phase 1 PS&E only. The total proposed Supplemental (Change of Contract No. 5) is
$122,876.50 therefore, the original TxDOT-funded contract amount would increase from
current $1,885,460.41 to $2,008,336.91.
Finally, we would like to mention that the original FNI-LAN contract fee has been impacted
throughout the design by numerous changes. Some of these are: 1) raising of roadway
profile from north of Mary's Creek Bypass thus changes to profile, median, widths,
sidewalks, etc., 2) due to restricted R.O.W., we had to provide in some segments, retaining
walls, 3) as result of potential conflict with waterline, the sidewalks south of Mary's Creek
Bypass had to be relocated closer to curb line, 4) monthly meetings with City staff since mid
or late 2003 (these meetings have been very helpful in keeping everyone abreast of all
components of project being worked on). We hope above requested fees will supplement the
current fees to complete the Phase 1 PS&E.
As mentioned previously a separate fee budget will be provided for the water and sewer
design and updates. Please also note that. A totally separate fee would be required in the
future to complete the plans for Phase 2 PS&E.
We look forward to begin the above changes in order to complete plans, specifications, and
quantities/estimate, for the Phase 1 plan set. Please call me if you have any questions.

Pursuing a request from The Texas Department of Transportation (TxDOT) in conjunction with
the above captioned project, please be advised that we have reviewed our breakdown of man-
hours required to accomplish the traffic engineering services required to perform the revisions to
our design plans, as submitted on our Supplemental Proposal dated September 29, 2004, and we
kindly submit the following explanation for consideration:
These are some of the items that need to be addressed when revising the drawings: · Coordinate project issues and updates with FNI-LAN, TxDOT, City of Pearland and
Harris County.

geometric improvements and updated information.

· Update proposed conditions to reflect the latest in VIVDS detection and specifications.
· Revise signing and striping.

· Include new/latest Standards.
· Revise Index of Drawings.
· Revise Basis of Estimates to show new/latest items, codes, quantities, etc. for all signals.
· Revise temporary signal layout at Beamer Road and FM 518 to accommodate new
geometry.
