R2018-199 A Resolution of the City Council of the City of Pearland, Texas, authorizing a contract with Stantec Consulting Services, Inc., for design services, associated with the Barry Rose Water Reclamation Facility Expansion Project, in an amount not to exceed $5,112,366.20. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That certain contract for engineering design services associated with the Barry Rose Water Reclamation Facility Expansion Project, a copy of which is attached hereto as Exhibit "A" and made a part hereof for all purposes, is hereby authorized and approved. Section 2. That the City Manager or his designee is hereby authorized to execute and the City Secretary to attest a contract for engineering design services associated with the Barry Rose Water Reclamation Facility Expansion Project. COKER CITY ATTORNEY EXHIBIT A CONTRACT FOR PROFESSIONAL SERVICES THIS CONTRACT is entered into upon final execution by and between the City of Pearland ("CITY") and Stantec Consulting Services Inc. ("CONSULTANT"). The CITY engages the CONSULTANT to perform professional services for a project known and described as Barry Rose WRF Expansion ("PROJECT"). (Project# WW 1502) SECTION I- SERVICES OF THE CONSULTANT The CONSULTANT shall perform the following professional services to CITY standards and in accordance with the degree of care and skill that a professional in Texas would exercise under the same or similar circumstances: A. The CONSULTANT shall perform engineering services. See Exhibit A, attached, for a detailed SCOPE OF WORK and PROJECT schedule.The PROJECT schedule shall be submitted in digital and hard copy form in the Microsoft Project for Windows format. B. The CONSULTANT shall prepare and submit a detailed opinion of estimated cost of the PROJECT. C. The CONSULTANT acknowledges that the CITY (through its employee handbook)considers the following to be misconduct that is grounds for termination of a CITY employee: Any fraud, forgery, misappropriation of funds, receiving payment for services not performed or for hours not worked, mishandling or untruthful reporting of money transactions, destruction of assets, embezzlement, accepting materials of value from vendors, or consultants, and/or collecting reimbursement of expenses made for the benefit of the CITY. The CONSULTANT agrees that it will not, directly or indirectly; encourage a CITY employee to engage in such misconduct. D. The CONSULTANT shall submit all final construction documents in both hard copy and electronic format. Plans shall be AutoCAD compatible and all other documents shall be Microsoft Office compatible. The software version used shall be compatible to current CITY standards. Other support documents, for example, structural calculations, drainage reports and geotechnical reports, shall be submitted in hard copy only. All Record Drawings electronic files shall be submitted to the CITY in TIF format. E. The CONSULTANT recognizes that all drawings, special provisions, field survey notes,reports,estimates and any and all other documents or work product generated by the CONSULTANT under the CONTRACT shall be delivered to the CITY upon request, shall become subject to the Open Records Laws of this State. F. The CONSULTANT shall procure and maintain for the duration of this Agreement, insurance against claims for injuries to persons, damages to property, or any errors Design 1 of 6 D2.Revised 2018 and omissions relating to the performance of any work by the CONSULTANT, its agents, employees or subcontractors under this Agreement, as follows: (1) Workers' Compensation as required by law. (2) Professional Liability Insurance in an amount not less than $1,000,000 in the aggregate. (3) Comprehensive General Liability and Property Damage Insurance with minimum limits of $1,000,000 for injury or death of any one person, $1,000,000 for each occurrence, and $1,000,000 for each occurrence of damage to or destruction of property. (4) Comprehensive Automobile and Truck Liability Insurance covering owned, hired, and non-owned vehicles, with minimum limits of $1,000,000 for injury or death of any one person, $1,000,000 for each occurrence, and $1,000,000 for property damage. The CONSULTANT shall include the CITY as an additional insured under the policies, with the exception of the Professional Liability Insurance and Workers' Compensation. Certificates of Insurance and endorsements shall be furnished to the CITY before work commences. Each insurance policy shall be endorsed to state that coverage shall not be suspended, voided, canceled, and/or reduced in coverage or in limits ("Change in Coverage") except with prior written consent of the CITY and only after the CITY has been provided with written notice of such Change in Coverage, such notice to be sent to the CITY either by hand delivery to the City Manager or by certified mail,return receipt requested, and received by the City no fewer than thirty (30) days prior to the effective date of such Change in Coverage. Prior to commencing services under this CONTRACT,CONSULTANT shall furnish CITY with Certificates of Insurance, or formal endorsements as required by this CONTRACT, issued by CONSULTANT'S insurer(s), as evidence that policies providing the required coverage,conditions,and limits required by this CONTRACT are in full force and effect. G. The CONSULTANT shall indemnify and hold the CITY, its officers, agents, and employees,harmless from any claim, loss, damage, suit, and liability of every kind for which CONSULTANT is legally liable, including all expenses of litigation, court costs, and attorney's fees, for injury to or death of any person, for damage to any property, or errors in design, any of which are caused by the negligent act or omission of the CONSULTANT,his officers, employees,agents, or subcontractors under this CONTRACT. H. All parties intend that the CONSULTANT, in performing services pursuant to this CONTRACT, shall act as an independent contractor and shall have control of its own work and the manner in which it is performed. The CONSULTANT is not to be considered an agent or employee of the CITY. Design 2 of 6 D2 Revised 2018 SECTION II -PERIOD OF SERVICE This CONTRACT will be binding upon execution and end December 31, 2022. SECTION III - CONSULTANT'S COMPENSATION A. The total compensation for the services performed shall not exceed the total noted in Section B. B. The CITY shall pay the CONSULTANT in installments based upon monthly progress reports and detailed invoices submitted by the CONSULTANT based upon the following: 1. Basic Services (Lump Sum) $4,800,356.20 2. Additional Services shall require independent and specific authorization and shall be billed as (Hourly Not to Exceed) $169,260.00 3. Bid Phase Services (Hourly Not to Exceed) $34,750.00 4. Construction Phase Services (Hourly Not to Exceed) 5. Reimbursables (Not to Exceed) $108,000.00 6. Total: $5,112,366.20 C. The CITY shall make payments to the CONSULTANT within thirty (30) days after receipt and approval of a detailed invoice. Invoices shall be submitted on a monthly basis. SECTION IV- THE CITY'S RESPONSIBILITIES A. The CITY shall designate a project manager during the term of this CONTRACT. The project manager has the authority to administer this CONTRACT and shall monitor compliance with all terms and conditions stated herein. All requests for information from or a decision by the CITY on any aspect of the work shall be directed to the project manager. B. The CITY shall review submittals by the CONSULTANT and provide prompt response to questions and rendering of decisions pertaining thereto, to minimize delay in the progress of the CONSULTANT'S work. The CITY will keep the CONSULTANT advised concerning the progress of the CITY'S review of the work. The CONSULTANT agrees that the CITY'S inspection, review, acceptance or approval of CONSULTANT'S work shall not relieve CONSULTANT'S responsibility for errors or omissions of the CONSULTANT or its sub- consultant(s) or in any way affect the CONSULTANT'S status as an independent contractor of the CITY. Design 3 of 6 D2 Revised 2018 SECTION V-TERMINATION A. The CITY, at its sole discretion, may terminate this CONTRACT for any reason -- with or without cause--by delivering written notice to CONSULTANT personally or by certified mail at 580 Westlake Park Boulevard, Suite 1000, Houston, TX 77079-2662. Immediately after receiving such written notice, the CONSULTANT shall discontinue providing the services under this CONTRACT. B. If this CONTRACT is terminated, CONSULTANT shall deliver to the CITY all drawings, special provisions, field survey notes, reports, estimates and any and all other documents or work product generated by the CONSULTANT under the CONTRACT, entirely or partially completed, together with all unused materials supplied by the CITY on or before the 15th day following termination of the CONTRACT. C. In the event of such termination, the CONSULTANT shall be paid for services performed prior to receipt of the written notice of termination. The CITY shall make final payment within sixty(60) days after the CONSULTANT has delivered to the CITY a detailed invoice for services rendered and the documents or work product generated by the CONSULTANT under the CONTRACT. D. If the remuneration scheduled under this contract is based upon a fixed fee or definitely ascertainable sum,the portion of such sum payable shall be proportionate to the percentage of services completed by the CONSULTANT based upon the scope of work. E. In the event this CONTRACT is terminated, the CITY shall have the option of completing the work, or entering into a CONTRACT with another party for the completion of the work. F. If the CITY terminates this CONTRACT for cause and/or if the CONSULTANT breaches any provision of this CONTRACT, then the CITY shall have all rights and remedies in law and/or equity against CONSULTANT. Venue for any action or dispute arising out of or relating to this CONTRACT shall be in Brazoria County, Texas. The laws of the State of Texas shall govern the terms of this CONTRACT. The prevailing party in the action shall be entitled to recover its actual damages with interest, attorney's fees, costs and expenses incurred in connection with the dispute and/or action. CONSULTANT and CITY desire an expeditious means to resolve any disputes that may arise between under this CONTRACT. To accomplish this,the parties agree to mediation as follows: If a dispute arises out of or relates to this CONTRACT, or the breach thereof, and if the dispute cannot be settled through negotiation, then the parties agree first to try in good faith, and before pursuing any legal remedies, to settle the dispute by mediation of a third party who will be selected by agreement of the parties. Design 4 of 6 D2 Revised 2018 SECTION VI—ENTIRE AGREEMENT This CONTRACT represents the entire agreement between the CITY and the CONSULTANT and supersedes all prior negotiations, representations, or contracts, either written or oral. This CONTRACT may be amended only by written instrument signed by both parties. SECTION VII—COVENANT AGAINST CONTINGENT FEES The CONSULTANT affirms that he has not employed or retained any company or person, other than a bona fide employee working for the CONSULTANT to solicit or secure this CONTRACT, and that he has not paid or agreed to pay any company or person, other than a bona fide employee, any fee, commission, percentage brokerage fee, gift, or any other consideration, contingent upon or resulting from the award or making of the CONTRACT. For breach or violation of this clause, the CITY may terminate this CONTRACT without liability,and in its discretion,may deduct from the CONTRACT price or consideration, or otherwise recover, the full amount of such fee, commission,percentage brokerage fee, gift, or contingent fee that has been paid. The work is separated into the following three phases: PHASE 1 - PRELIMINARY ENGINEERING SERVICES (COMPLETED) PHASE 2- FINAL DESIGN SERVICES (THIS PHASE) PHASE 3 - CONSTRUCTION MANAGEMENT AND START-UP SUPPORT SERVICES (FUTURE PHASE) The City is proposing to expand the Barry Rose Water Reclamation Facility (BRWRF) to accommodate the projected 2026 flows and loads. The Barry Rose Wastewater Reclamation Facility Preliminary Engineering Report (February 2018) will be used as the starting point for services related to the BRWRF. The City is also proposing to decommission the Longwood Water Reclamation Facility (LWRF) and transfer the flow to the expanded BRWRF via a new Longwood Transfer Lift Station and Force Main. The Wastewater Planning for the Longwood Study Area Report (June 2012) will be used as the starting point for services related to Decommissioning of Longwood Water Reclamation Facility and the design of the Longwood Transfer Lift Station (Longwood LS). Design flows are expected to be 1.0 MGD average day flow and 4.0 MGD peak hour flow. The Longwood Force Main anticipated length is approximately 20,000 linear feet. A baseline project schedule will be created and updated on a regular basis throughout the Project. PHASE II-SCOPE OF SERVICES Stantec shall provide Project Management, Basis of Design, Final Design, Permitting, and Additional Services to prepare one construction contract package including drawings and specifications for the BRWRF treatment plant work and another for the LWRF lift station and force main work. Page 4 of 30 Scope of Services for Final Design and Construction Phase Services Barry Rose Water Reclamation Facility and Decommissioning of Longwood Water Reclamation Facility November 1,2018 20100 Task 1 Project Management, Quality, and Safety This task includes project management, control systems and tools, and coordination activities required to execute services to be provided. Activities include project setup and planning, establishment and maintenance of project controls tools, development of the project schedule, coordination of internal and City meetings, sub-Stantec management, review of project schedule and budget, invoicing, and City communications. Project management activities will focus on coordinating the production of deliverables, including: 1.1 Regular Project Reporting, Invoicing, and Scheduling Stantec will prepare monthly progress reports for the duration of the project (one per month based on the project schedule) that will be used to monitor performance. The report will be produced and updated, as reasonably required, and will include the following information: • Master PROJECT Schedule • Key PROJECT Milestone Summary • Look-ahead Schedule • Regular Progress Report (monthly) • Project Risk Summary • Project Change Log The report will be stored on the Project Collaboration Portal (SharePoint Site). Stantec will Track the progress of the Project and Prepare a Microsoft Project schedule and provide updates including revisions to bring the Project back on schedule if behind. The updated Schedule will be provided to the Owner at monthly meetings during the Project. Stantec will prepare monthly invoices that reflect the services completed each month that aligns with the information provided in the monthly reports. Invoices will present information consistent with the reimbursement terms of the contract. The format for invoices will be Stantec's selected format that complies with all funding agency requirements. 1.2 Project Execution Plan Stantec will develop a specific PXP that will guide the project work. The PXP will include a Work breakdown Structure (WBS) that will be used as the basis for the development of the project schedule and identification of the critical path. Communications protocols will be developed as part of the PXP and will identify key communication pathways and serve to facilitate effective communications amongst key team members and stakeholders. In general, unless otherwise noted in this SOW or agreed upon by Stantec and the City, meeting agenda and materials will be provided by Stantec to the City a minimum of 24 hours in advance of the meeting, and Stantec will provide meeting summaries within ten (10) working days of meetings. The PXP will be provided to the City and updated as needed throughout the life of the project.The Stantec will load and the PXP on the Project Collaboration Portal site. The purpose of the kickoff meeting will be to identify success factors, obtain equipment and process preferences, identify previously studied alignments, brainstorm potential design solutions, and establish a clear set of objectives for the project based on the City's input and consultation with senior technical staff. In addition, the Project Kickoff meeting will address the following items: • WBS review • Project deliverables • Project schedule • Project team member responsibilities and authorities • Project management protocols • Communications protocols • Risk Management • Initial Project Delivery Framework • Project Working Groups composition, charters, and meeting schedules • Initial technical tasks to be accomplished • Guidelines to be applied during field activities • Coordination needs between Stantec and the City • Other topics identified by Stantec or the City The Stantec Project Manager will facilitate the Project Kickoff meeting. Stantec will prepare and distribute a meeting agenda and information 24 hours in advance of the meeting and prepare a meeting summary. A project responsibility assignment matrix (RAM) will be prepared that documents who is responsible and authorized to make PROJECT decisions. Deliverables: • Project kickoff meeting summary 1.4 Project Meetings and Workshops Stantec will prepare supporting materials to provide additional background and context to be discussed at monthly progress meetings, coordination meetings, and workshops. The level of effort is as follows: 1. Project meetings as follows: o Initial coordination meetings (up to five (5)) during the first 16 weeks to fast track basis design. o Monthly progress meetings with the City, provide meeting materials, agenda, and meeting minutes with action log. These reviews shall be performed on plans, specification, calculations, reports, and technical memorandum prior to the City's review. Stantec's QA/QC plan shall be provided in the PXP. Stantec shall conduct a Route Study Alternatives Definition workshop with the City to establish two preferred alignments. 3. The selected preferred alignments will be further evaluated based on the available data and developed selection criteria, including constructability, cost, traffic/community impacts, environmental impacts, right of way needs, obstructions, and serviceability. Develop Demolition Plans and Specifications. These plans will principally rely upon PDF markups to the existing record drawings for the LWRF, available aerial photographs of the site and site photos of key features. 2. Develop Longwood WWTP Decommissioning Plan as required per TCEQ. 3. Complete and submit the TCEQ "Request to Cancel a Water Quality Permit or Registration," including TCEQ Form 20029. 4. One coordination meeting with TCEQ regarding this task attended by Project Manager and Project Engineer. 5. Longwood WWTP Decommissioning Phasing Plan. 6. Meeting Minutes and Notes for TCEQ meeting. Deliverables • Longwood WWTP Decommissioning Plan • TCEQ Forms 2.4 Survey Services Stantec will provide Surveying Services for the development of the 30% Longwood Lift Station and Force Main Drawings and Specification.Aerial lidar and photogrammetry will be utilized for the entire alignment and confirmed with ground survey. Basic requirements are as follows and additional requirements will be submitted as a proposal to the City for approval. Deliverables • Survey Civil 3D CAD 2.5 Geotechnical Services Stantec will provide Geotechnical Engineering Services for the development of the 30% Longwood Lift Station and Force Main Drawings and Specification. Basic requirements are as follows and additional requirements will be submitted as a proposal to the City for approval. 1. Geotechnical Services for Route and Lift Station • Anticipated are six (6) bores at 50 feet deep each and one piezometer at 50 feet deep each for the Longwood Lift Station. • Anticipated are 24 (twenty) bores at 20 feet deep each and one piezometer at 20 feet deep each for the Force Main alignment. • Borings will be used to estimate site stratigraphy, and soil samples will be collected for lab testing. Stantec shall schedule the necessary contacts and initial correspondence with all agencies having permit jurisdiction over the PROJECT and provide information to facilitate approval of the required permits. The City will pay all fees for all permits. Stantec shall notify the City Project Manager a minimum of fifteen (15) working days in advance of permit application submittal of the required fees to allow the preparation of payment of the application fee and shall also provide a copy of the permitting Agency's fee schedule for each permit required. It is assumed that the permitting will not include endangered species permitting, and is not included in the Stantec Scope of Services. The major unit processes will be pre- validated.Therefore,it is assumed that no pilot testing will be required and is not included in the Stantec Scope of Services. 3.1 Prolect Permitting Plan &TCEQ Permittinq Identify permits required from agencies including the City of Pearland, TCEQ, and Brazoria County. Conduct a desktop level study of the following site factors and other factors as appropriate based on available public information to determine if further environmental assessment (phase 1 and/or phase 2) is needed. The findings will be incorporated into a TM as appropriate. • Environmental factors based on readily available public data. • Jurisdictional waters and wetlands. • Threatened and endangered species occurrence, soluble soils, and critical habitat. • Hazardous or contaminated sites based on readily available public data. • Archeological and historical sites based on readily available public data. Stantec shall prepare and submit the required documentation for the TCEQ Construction Permit including the following services: 1. Arrange, prepare agenda for, and conduct one pre-application meeting with TCEQ to discuss the requirements for the project's Construction Permit. 2. Following meeting, Stantec shall prepare meeting minutes and submit to TCEQ and the City. 3. Prepare and submit TCEQ required documentation including typical TCEQ permit to construct. 4. Follow through and respond to Requests for Additional Information (RAI). A maximum of two series of RATS shall be received and responded to by Stantec. 5. Prepare meeting minutes and submit to TCEQ and the City. 3. Coordinate with selected UV equipment manufacturer and TCEQ for permitting requirements (UV analyzer, operational and IC protocol, sampling locations, etc.). 4. Establish preliminary equipment evaluation criteria and testing protocol. This protocol will be reviewed with the City and TCEQ before being finalized. The review with TCEQ shall include dose-response issues,sampling and analysis parameters,duration of test, and minor treatment configuration modifications that may be needed. 5. Revise the protocols based on comments from TCEQ and the City. 6. Prepare and submit TCEQ required documentation including TCEQ required UV equipment approval documentation (sampling protocol, operational protocol, performance test, etc.) 7. Follow through and respond to two (2) requests for additional information. 8. Provide documents and test data for release to place system in operation. This includes the time required during the fifteen (15) day performance test. 9. Compile all required permitting documentation for submittal to the City for record. 3.3 City Building and Development Review Services Stantec shall provide the following services: 1 . Arrange, prepare agenda for, and conduct one pre-application meeting with the City Building and Development Review Services to discuss the requirements and costs for local permits. Stantec assumes that the City will either waive its fees for this service or pay for this permit directly. 2. Stantec will provide background information on the project to satisfy TCEQ Preliminary Engineering Report requirements as defined in the Texas Administrative Code Chapter 217. This would be a short summary of the submitted BRWRF Secondary Treatment Evaluations included in the PER. Deliverables Stantec shall deliver one hard copy and one electronic copy as required for TCEQ permitting and for use in support of the Final Design. Description of plant process and permit limits. 2. Operations of preliminary treatment. 3. Operations of secondary treatment. 4. Operations of disinfection. 5. Operations of NPW system. 6. Operations of air system. 7. Operations of solids processing. 8. Operations of SCADA and alarms. 9. Sampling Plan. 10. Pollution Prevention and Control. 11. Chemical Supply and storage life. 12. Electrical Supply and backup power. 13.This written plan does not include training or start up assistance. Training and start up assistance will be provided in Construction Phase Services. 6.4 Geotechnical and Survey Services Stantec will provide Geotechnical Engineering and Surveying Services for the development of the 30% Barry Rose Water Reclamation Facility Drawings and Specification. Basic requirements are as follows and additional requirements will be submitted as a proposal to the City for approval. 1. Survey Services for site. Based on the drawings, specifications, and the design review workshops, Stantec shall prepare 75% and final OPCCs for the construction of the Project. The OPCCs will be prepared in accordance with American Association of Cost Engineering (AACE) International Standards. 1. Construction plans shall be created in electronic format using AutoCAD or Revit and plotted digitally to a 22"x 34" pdf format. 2. Prepare technical construction specifications using Stantec's standard technical specifications shall be prepared in Construction Standards Institute format (2009 or later). Stantec shall provide the following services related to design workshops: 1. The 75% and 100% drawings will be reviewed at the design review workshops. 2. The City will attend up to two (2) 4 hour long design workshops based on work in progress, with "work in progress" electronic files provided two (2) business days prior to the on-board review.The City will ensure all required reviewers are present at the design workshop meeting. Stantec will log reviewer comments during the workshop and submit the log to the City with the meeting notes.The City will review the meeting notes and confirm all comments were captured. Page 22 of 30 Scope of Services for Final Design and Construction Phase Services Barry Rose Water Reclamation Facility and Decommissioning of Longwood Water Reclamation Facility November 1,2018 Deliverables: • Submit digital sets of 75 percent, 100 percent, and construction document plans with drawings, specifications, and OPCC. • Submit one (1) 22x34 hard copy set and project manual binder and electronic files of the final Bid set to the City. • Submit digital sets of design workshops agenda and minutes 7.2 Barry Rose Water Reclamation Facility Detailed Design On the basis of the approved BODR, Stantec shall prepare 75%, and final general, civil, architectural, structural, mechanical, HVAC, plumbing, fire protection, electrical, and instrumentation construction drawings and technical specifications as required to provide a Final Design package for the Project. Based on the drawings, specifications, and the design review workshops, Stantec shall prepare 75%, and final OPCCs for the construction of the Project. The OPCCs will be prepared in accordance with American Association of Cost Engineering (AACE) International Standards. 1. Construction plans shall be created in electronic format using AutoCAD or Revit and plotted digitally to a 22"x 34" pdf format. 2. Prepare technical construction specifications using Stantec's standard technical specifications shall be prepared in Construction Standards Institute format (2009 or later). Stantec shall provide the following services related to design workshops: 1. The 75% and final drawings will be reviewed at the design review workshops. 2. The City will attend up to three (3) 4 hour long design workshops based on work in progress, with "work in progress" electronic files provided two (2) business days prior to the on-board review.The City will ensure all required reviewers are present at the design workshop meeting. Stantec will log reviewer comments during the workshop and submit the log to the City with the meeting notes.The City will review the meeting notes and confirm all comments were captured. Page 25 of 30 Scope of Services for Final Design and Construction Phase Services Barry Rose Water Reclamation Facility and Decommissioning of Longwood Water Reclamation Facility November 1,2018 20900 Task 9 Additional Services As stated above, Tasks 1 through 8 will be completed on a lump sum basis and invoiced based on the percent complete of each task. This "Task 9 Additional Services" will be completed on a Time and Materials basis to the extend funding is available. The funding provided in the fee schedule under Additional Services for Task 9 is not anticipated to be enough to complete the entire scope of work provided below, but rather to begin critical path activities. Stantec will develop the complete scope of service and associated fees for the City to request additional funding, if required. 9.1 Visual structural inspections Visual structural inspections be utilized to determine the structural integrity of existing structures to be utilized for final design. If additional field investigations, third-party testing or evaluations or analysis is needed for this purpose, then scope of testing or services will be determined. 9.2 Right of Way Identification, Appraisal and Acquisition Stantec will provide support services relating to property investigation and research. An initial ROW easement/parcel analysis will be completed to identify restrictions and preliminary boundary conditions along the proposed routes. The results of this study will be incorporated into the Force Main route study to identify fatal flaws early and recommend the preferred route. This scope assumes investigation of approximately 5 separate properties and/or tracts. The specific activities include: 1. Establishment of Right of Way and easements utilizing GIS data. 2. Identification of the adjacent property for the purposes of establishing the existing property corners, as well as identification of adjacent easements and right-of-way for the purpose of accurately establishing buffer zone requirements. 3. Establishment Rights of Entry that would be needed during the final Design Phase. 4. Identification of temporary easements for construction access. 5. Develop Right-of-Way(s) restriction and preliminary boundary conditions along proposed alignment. 6. Coordinate with Pearland Staff to develop a streamlined process for accelerating required acquisitions to be completed. Conduct a workshop with the City to establish Right of Way needs. Deliverables: • Right of Way Study and backup documents 9.3 Real Estate and Easement Acquisition Stantec will provide support services relating to property investigation and research. This scope assumes preparation of approximately 2 separate properties and/or tracts. The specific activities include: 1. Obtain title reports on properties involving right-of-way acquisition, permanent easement or temporary construction access. 2. Write full legal descriptions for property and easement acquisition based on figures with metes and bounds. 3. Prepare property acquisition survey, metes and bounds in the listed parcel areas. 4. Prepare figures for existing encroachment conflict improvements in the listed parcel areas. Deliverables: • Easement exhibits and Metes & Bounds 9.4 Grant and Loan Assistance.Services Stantec Services may be utilized to apply for additional funding, including grants and loans. After completion of the initial funding assistance TM, and if assistance is needed for this purpose,scope of services and associated fees will be determined and submitted. 9.5 TWDB Funding NEPA Compliance Should the CITY elect to apply for Federal SRF, NEPA compliance will be required. This scope item will only be utilized if specifically authorized by the CITY should this task be required by the terms and conditions of the TWDB funding. CONSULTANT proposes to begin providing the following services, as authorized by the CITY, up to the allowance not-to-exceed amount specified in fee schedule. Specific scope items may include the following: 1. Documentation necessary for Categorical Exclusion (CE); or 2. Performance and submittal of an Environmental Assessment (EA); or 3. Preparation of an Environmental Impact Statement (EIS) 4. Preparing, presenting and attending public meetings as may be required by the Texas Water Development Board process. If the above services are authorized, a full budget estimate for each task will be prepared, submitted and authorized prior to commencement of work. Should the proposed budget exceed the remaining allowance, CONSULTANT shall perform work (if authorized) up to the maximum allowance. Additional funding will be requested, if required to complete the task. Page 27 of 30 Scope of Services for Final Design and Construction Phase Services Barry Rose Water Reclamation Facility and Decommissioning of Longwood Water Reclamation Facility November 1,2018 9.6 Other Services Below is a summary of Stantec Services that may be required but cannot be confirmed until the scope of services is determined in Basic Service (Tasks 1 -8). If these services are determined to be required,the scope of services and associated fees will be determined and submitted for City approval. 1. Subsurface Utility Engineering (SUE) 2. Material Testing-If determined by Stantec and agreed to by the City, certain non- destructive or other testing of equipment and structures may be required to adequately perform a condition assessment for facilities and equipment that may be re-purposed or re-used for the new treatment process. If additional testing or analysis is needed for this purpose, a full budget estimate for each task will be prepared, submitted and authorized prior to commencement of work. 3. USACE Permitting - Based on the desktop route study under this contract, Stantec will complete a jurisdictional delineation to determine presence and extent of potentially jurisdictional waters within the Project Area pursuant to the protocols set forth by United States Army Corps of Engineers ("USACE") Guidance on Ordinary High-Water Mark Identification (Regulatory Guidance Letter, No. 05-05) (USACE 2005). Should wetlands be identified on site, a significant nexus determination will be provided to determine if the wetlands are potentially jurisdictional.This analysis will be used to determine if the wetlands identified have a "significant physical, chemical, or biological connection" (Environmental Protection Agency, 2017) to a jurisdictional water. Should there be jurisdictional waters present, it is assumed that the Project will qualify for National Wide Permit Category No. 12 and will likely require a Preliminary Construction Notification. Stantec will provide the required pre-application meeting, permit preparation, permit submission, and permit coordination. 4. Field Investigations 5. CMAR Support If the above services are authorized, a full budget estimate for each task will be prepared, submitted and authorized prior to commencement of work. Should the proposed budget exceed the remaining allowance, CONSULTANT shall perform work (if authorized) up to the maximum allowance. Additional funding will be requested, if required to complete the task. Page 28 of 30 Scope of Services for Final Design and Construction Phase Services Barry Rose Water Reclamation Facility and Decommissioning of Longwood Water Reclamation Facility November 1,2018 PROJECT ASSUMPTIONS Coordination • The City shall assign a single point of contact to serve as the Project Manager. • All public notices and public meetings will be managed and handled by the City. Stantec will provide public meeting material, if required. • Project duration of 16 months through Final Design. SOW of construction phase and start up support services to be determined later. • The Stantec Project Manager and two Project Engineers to attend all meetings. • The City's comments will be consolidated, and conflicting comments will be internally resolved prior to submission to Stantec. • Meetings may be held at the City's office, Stantec's office, or via Skype, as approved by the City to meet the project schedule. • The Project Schedule is based on a 2-week review period for all deliverables to the City or all comments received at design workshops • Interim submittals will be posted on ProTrack (City) for printing by project team members (i.e. hard copies will not be provided). • The City will attend Design Review Workshop sessions and provide Stantec with review comments at the design review workshops. • Additional data may be requested as the project proceeds.The City shall use their best effort to provide all requested data within five (5) working days. Data • Stantec will receive any required water samples within two weeks of the date that the samples were taken. • Any effluent or influent water quality and toxicity samples required will be undertaken by others, and are not included in the scope of work. • H2S readings at the existing BRWRF influent lift station and LWRF on site lift station will be provided by the City. • GIS data is available and in sufficient detail to conduct a route study. A review of the data will be undertaken, and the result will be reported to the City. Additional Survey data may be recommended and requested under Additional Services to complete the route analysis and require ROW/Easement acquisitions. • The City will provide any existing survey, geotechnical, and other reports, data, and studies to Stantec. Stantec will review the information provided and inform the City if it is inadequate for performing the work. Delivery • The BRWRF and the LWRF plans will be as two plan sets and separate bid packages but bid simultaneously with combined meetings. • The draft TMs, developed as part of each task, will be finalized based on comments received and then compiled and reissued as the Draft Basis of Design Report to be submitted to City and internal Stantec reviewers. Based on Page 29 of 30 Scope of Services for Final Design and Construction Phase Services Barry Rose Water Reclamation Facility and Decommissioning of Longwood Water Reclamation Facility November 1,2018 comments received on the Draft Basis of Design Report, a final version of the Basis of Design Report will then be compiled and provided to the City and TCEQ. • The Opinion of Probable Construction Cost will be developed during the review period for the Draft Basis of Design Report because the draft report is needed to develop the estimate. The estimate will be in the Final Basis of Design , but not in the Draft Basis of Design. Design • Preliminary effluent limits will be subject to TCEQ approval as part of the Site application process, and will rely solely on current regulatory requirements. • An electrical room will be provided separate to the blower building. • Modeling of existing streams for additional flow at BRWRF is not included. • The 2017 Barry Rose Wastewater Reclamation Facility PER developed by Stantec will be used as a data source. • The City will provide to Stantec all easement and land use data required for the routing evaluation. • Price of proposed land easements will standardize on cost per square foot based on county appraisal district records. • Construction methods for Force Main will be as recommended by Stantec. • City will provide road improvements project limits where the ROW is determined to be best route for the new Force Main. • The Longwood Force Main maximum length is 20,000 linear feet with a maximum of five (5) road or creek crossings and no open cut under existing pavement. Permitting • Ninety (90) day TCEQ Maximum Review Period of Plans and Specifications. • One set of comments from TCEQ will be received and comments can be responded to without modification to drawings. • All water quality related data and design information are available through the City. • The permit amendment application will be prepared from existing and available data and information and all information required for the application will be assembled by the Stantec permit amendment team. If new or additional research is necessary to complete any part of the Permit Amendment Application, the Permit Amendment Application Team will immediately notify the Project Manager, and the Project Manager will determine whether an Additional Services request should be prepared for City review. The project consists of the following: • Barry Rose WWTP • Longwood Lift station which will replace the existing WWTP • Force main- about 20,000 LF of 20-inch FM,placed at a depth of 5 to 10 feet. It was noted that predominantly all the structures will be at/or above grade with the exception of lift station, filter building and wet well at Longwood Lift Station which are placed below grade. The below grade structure depths range from 5 to 30 feet. Purpose and Scope The purpose of this study is to explore the subsurface conditions at the proposed site and to develop geotechnical recommendations pertinent to the design and construction of the proposed Pearland Barry Rose WWTP at Pearland, Texas. The scope of services is based on the information provided to us on August 17, 2018, October 2, 2018 and consists of the following tasks: • provide utilities clearance for new boring locations. It includes: ■ all Texas One Call referencing with street name and Key Map block Mr. Andrew Swirsky, P.E. Proposal No. 1140437799 Page 2 October 3, 2018 number and • mark the borings location and coordinate with representative of utility companies as well as plant representatives to clear the marked boring location; • drill and sample: • twenty-nine (29) 40-foot deep and eight (8) 20-foot deep soil borings for the Barry Rose WWTP; • six(6) 50-foot deep soil borings at Longwood Lift Station; and • twenty-four(24) 20-foot deep soil borings for force main. • Convert five (5) 40-foot deep borings, one (1) 50-foot deep boring, and two (2) 20-foot deep borings into piezometer for steady state long term water level measurements. The proposed boring/piezometer program is shown on Attachment No. 1. • perform laboratory tests on selected representative soil samples including consolidation tests to determine the engineering properties of the soils and to select design soil parameters; • perform engineering analyses to develop geotechnical recommendations for the design and construction of the proposed structures; • perform a limited review of existing fault maps to identify the presence of known active faults that may impact the project; and • prepare a geotechnical report. It is understood that the survey information of the borings will be provided by Stantec Consulting Services, Inc. Project Schedule We should be able to start the field work within two (2) weeks after receiving your written authorization. The field work will be completed in about six (6) weeks, barring bad weather. The laboratory tests will be completed in about twelve (12) weeks. The geotechnical investigation report, which will include field and laboratory data and design recommendations, will be submitted in about seventeen (17) weeks after receiving the written authorization. Perform quality control/quality assurance throughout the project duration on all project deliverables, design calculations, and design report methodology. 5. Periodic Progress Meetings (-5-3 5engineering a. Attend and prepare for up to six (6) meetings (in-person or conference calls) through completion of Preliminary Engineering Phase and final design services. Prepare and distribute meeting summaries as required. Weekly status update conference calls are included. Task 2: Preliminary Engineering (Phase I) 1. Data Collection and Review a. Collect and review existing data associated with the Project as required,through the prime consultant. Review previous studies, reports, record documents and any other documents associated with the Project. 2. Longwood Lift Station a. Longwood WRF (LWWRF) is planned to be decommissioned and the existing on-site lift station will be retrofitted for the new force main.The new (1 MGD to 2 MGD ADF) transfer lift station will be designed to transfer flows from LWWRF to the existing BRWRF collection system. 5e will provide a TM section to be included in the overall design report. 3. Longwood Force Main a. Stantec will prepare and provide 5engineering with a Route Study for this new force main. 5e will provide a TM section to be included in the overall design report. b. The TM will include the forcemain calculations and simple exhibits.Stantec will provide all of the offsite forcemain exhibits. 4. LWWRF Decommissioning a. The existing LWWRF will need to be decommissioned as its function is replaced at the BRWRF. 5e will provide a sealed TM to be included in the overall basis of design and will include the route study that Stantec prepared as an attachment. 5. BRWRF Odor Control a. 5e will provide a TM to be included in the overall basis of design.The TM will include calculations and simple exhibits. 6. Deliverables a. Draft and Final TM i. Preparation and submission of TMs relating to each item identified in Task 2, item numbers 1 through 7. The report section will be prepared as a stand-alone document,with the intent of Stantec incorporating the document contents into City of Pearland (BRWRF) - (5e Project No.0086/02) Page 2 ci5engineering the overall TM. One draft will be submitted, review comments will be addressed, and the revised report will be finalized. b. Preliminary Design Drawings (30%) and Details will be provided. c. Preliminary Design Opinion of Probable Construction Cost i. 5e will develop an engineer's OPCC for the recommended improvements including scope and estimating contingency appropriate for the level of design. An AACE International Class 5 cost estimate is assumed for this level of design. Task 3: Final Design Engineering (Phase 2) 1. Data Collection and Review a. Collect and review any additional field data identified in the TMs. Design Phase Services (civil, mechanical, and control narrative) includes preparation of 60-percent, 90-percent, and final construction package submittals as well as construction cost estimates. 5e will provide electrical and structural design subconsultants for the Longwood transfer lift station. Electrical and structural design of all other facilities will be performed by Stantec. 2. Construction Drawings, Contract Documents, and Technical Specifications-5e will prepare 60%, 90%, and final construction drawings, contract documents, and technical specifications in accordance with Stantec's and the City of Pearland standard design and recommendations. The Construction Documents will include the following: a. LWWRF transfer lift station i. Bypass pumping plan to allow cleaning, repair and time to return the wet well to service. ii. Civil and site plan modifications iii. Mechanical modifications including pumps, pipes and fittings, and associated valve design. iv. Surface restoration and coating of the wet well. v. There are no structural design or repairs required to the reinforcing steel. b. Decommissioning of the LWWRF c. BRWRF Odor Control 3. Exclusions: 1.
