R2001-0042 04-26-01 RESOLUTION NO. R2001-42 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, APPROVING A CHANGE ORDER WITH PATE & PATE ENTERPRISES, INC. FOR CONSTRUCTION SERVICES ASSOCIATED WITH THE MAGNOLIA/HARKEY SANITARY SEWER IMPROVEMENT PROJECT. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That certain change order by and between the City of Pearland and Pate & Pate Enterprises, Inc., a copy of which is attached hereto as Exhibit "A" and made a part hereof for all purposes, is hereby authorized and approved. Section 2. That the City Manager or his designee is hereby authorized to execute a change order with Pate & Pate Enterprises, Inc. for construction services associated with the Magnolia/Harkey Sanitary Sewer Improvement Project. Change Order Number: 2-AMENDED Owner's Project Number: B00-052 Contractor's Project Number: 2786 Engineer's Project Number: 99-3064-030 Explanation of this Change Order: This change order is being issued to authorize the following items: 1) Offset of the sewer line by 2 feet due to a utility conflict between stations 167+70 and 187+ 10. 2) Payment of additional cement stabilized sand and additional asphalt road removal and replacement due to unsatisfactory soil conditions. 3) Additional improvements on parcel # 3 that were authorized by City staff. 4) The boring of a stub-out at Sharondale Drive due to utility conflicts. 5) Time extensions associated with the above changes. 6) Reductions in sodding quantities to only include private property and not City ROW. A contract close out change order will be issued at a later date to adjust line item quantities to match the final as built quantities. 1) Sewer Line Offset A SWBT buried cable was found to be installed at the same location as the proposed sewer line. The sewer line offset was adjusted from 8.0 feet west of the center line of the future ROW to 6.0 feet west of the center line of the future ROW between station 167+70 to station 187+10. No change in cost or quantities is associated with this offset. 2a) Additional Cement Stabilized Sand During the excavation for the 36" sewer line from Station 167+70 to Station 185+90, the contractor encountered different soil conditions than were anticipated. The geotechnical report stated that the excavation could be made vertically and shored with bracing or trench boxes. The soil located under Harkey Road was unstable and did not support the vertical trench through the use of a trench box. This required the contractor to over excavate and replace the material with cement-stabilized sand (CSS). To potentially avoid unstable soil conditions, after they were discovered, the relocation of the sewer line to the west of the original alignment would have been required. This alignment would have placed the sewer line closer to a water line and approximately in the center of an existing ditch which would have lead to additional utility conflicts, the replacement of several driveways and culverts and caused interference with the future boulevard section planned for Harkey Road. This additional work would have resulted in additional cost and time delays for the City of G:\1999-\99-3064.030\CONSTR ADMIN\CO2-AMENDED.DOC Magnolia / Harkey Sanitary Sewer Change Order No. 2 - Amended Page 1 of 3 Pearland. Offsetting the sewer line to the west would not have guaranteed that unstable material would be avoided. As a result, the adjusted alignment under Harkey road was maintained. These soil conditions resulted in 2116 cubic yards of additional CSS being installed by the contractor. Calculations showing the bid amount of CSS and delivery tickets for the actual installed-amount are attached. The unit cost for the removal of unsatisfactory soil and the installation of additional CSS is set at $23.95 per cubic yard. This results in a total cost of $50,678.20. 2b) Additional Asphalt In addition to the poor soil conditions under the road, the base and sub-base material was inadequate in certain places. The geotechnical report indicated a 3 inch thick asphalt pavement with between 12 and 33 inches of base material. In several locations along Harkey Road the base material was less than indicated, which resulted in the failure of the asphalt pavement during construction. The Engineer, Inspector and Contractor reviewed the condition of the road and determined the appropriate limits of replacement. The replacement of additional asphalt is between Stations 167+18 and 187+39. This results in an increase in asphalt restoration (line item 10) by 2,950 square yards and the removal of 960 CY of excess asphalt and sub-grade material. The removal of asphalt and sub- grade material shall be at a lump sum cost of $7,680.00. The replacement of the base material and the asphalt surface shall be at the bid price of $26.70 per square yard. This results in a cost of $78,765.00. 3) Parcel # 3 Improvements Additional improvements were performed on Parcel 3. The 8" sanitary sewer was extended 85 LF to the east at the City of Pearland's request. This work included removing and replacing 118 LF of 18" RCP and two (2) storm water inlets. The additional length of 8" sanitary sewer will be incorporated into the quantity adjustment change order. The removal and replacement of the 18" RCP shall be paid at a unit price of $39.50/LF. The removal and replacement of the storm water inlet shall be paid at a unit price $200.00/EA. 4) Stub-out at Sharondale At Sharondale Drive, existing utility conflicts made the installation of the proposed 8" sanitary sewer stub out impractical by open-cut methods. Therefore, trench-less installation was used to install the 35 LF of 8" sanitary sewer stub-out at Sharondale Drive for a lump sum of $2,500.00. 5) Time Extension The contractor has requested 30 days of additional time to complete the project due to the increased amount of excavation and backfill required and for the other additional work. These additional 30 days shall extend the time for substantial and final completion; however, the time for the early completion bonus expired on January 17, 2001 and shall not be extended.
