1993-01-25 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTES211 MINUTES OF A JOINT PUBLIC HEARING BY THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON JANUARY 25, 1993, AT 7:00 P. M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS The Hearing was called to order with the following present: Mayor C. V. Coppinger Mayor Pro Tem/Councilmember Randy Weber Councilmember D. A. Miller Councilmember Benny Frank Councilmember Joy Colson Councilmember David Smith Planning & Zoning Chairman Richard Tetens Planning & Zoning Vice Chairman Emil Beltz Commissioner Helen Beckman Commissioner Pat Lopez Commissioner James Garner Commissioner Mary Starr City Manager Paul Grohman City Attorney Lester Rorick City Secretary Pat Jones Also present were Division Directors Richard Burdine and Glen Erwin and Assistant to the City Secretary Sharon Parks. PURPOSE OF THE HEARING: APPLICATION NO. 34 REQUEST OF ALFRED E. LENTZ, AGENT FOR L. F. GOZA, OWNER, FOR AN AMENDMENT TO THE LAND USE ORDINANCE FROM CLASSIFICATION GENERAL BUSINESS (GB) TO COMMERCIAL (C) ON THE FOLLOWING DESCRIBED PROPERTY, TO -WIT: 7.1913 ACRES OUT OF LOT 26, GEORGE W. JENKINS SUBDIVISION (1000 E. BROADWAY) NUMBER OF SIGNATURES ON ATTENDANCE ROSTER: 9 SPEAKING FOR THE PROPOSED REQUEST: 1. Al Lentz, 5703 Rockland. Mr. Lentz discussed the location of the property, the nature of the proposed business, area zoning, and buffer zones. Mr. Lentz introduced a drawing of the area and showed it to Council, Staff, and the Commission as well as the audience. Mr. Lentz stated he felt this rezoning request was within keeping of the area zoning which has a commercial tract across the street from it. 2. Rick Gautney, 915 Glenlea. Mr. Gautney stated he wished to construct an automobile customizing facility for new car dealerships. His present site on the western side of the City, outside of the city limits, has no room to expand. The new proposed facility will have approximately 6,000 square feet, with a brick facade, fencing, and the building will be aesthetically pleasing to the area, Mr. Gautney said. When questioned about the amount of body work, Mr. 212 Gautney responded that some body work may be required at times if a customized vehicle has been wrecked but primarily his business is paint customizing. SPEAKING AGAINST THE PROPOSED REQUEST: 1. Tracy Devillier, 3228 Lee Circle. Ms. Devillier stated she brought a petition opposing the paint and body work facili- ty. (This petition was not presented to the City Secretary, but was found on the table at the entrance to the Council Chambers and contained one signature.) Ms. Devillier stated her objections were based on contamination from chemicals used in the processes and potential environmental hazards. 2. Dorothy Burgett, 2406 John. Ms. Burgett also stated her objection because of the possible disposal of toxic waste in the creek. QUESTION AND ANSWER PERIOD: Council and Commission discussed questions concerning state and federal regulations for the disposal of any chemicals used in the operation of this business. It was stated that this type of business is governed by strict federal regulations. Ingress and egress to the business, amount of chemicals used and stored at any one time, hours of operation, and EPA regulations were dis- cussed. The Hearing adjourned at 7:29 P. M.
