AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS,
AMENDING ORDINANCE NO. 509, THE LAND USE AND URBAN DEVELOPMENT
ORDINANCE OF THE CITY OF PEARLAND, TEXAS, FOR THE PURPOSE OF
DESIGNATING THE CLASSIFICATION OF CERTAIN REAL PROPERTY
LOCATION BEING 20.5 ACRES OF LAND OUT OF VILLA VERDE SECTION 2
ACCORDING TO THE PLAT THEREOF FILED IN FILM CODE NO. 537152 OF
THE HARRIS COUNTY MAP RECORDS AND VILLA VERDE SECTION 3
ACCORDING TO THE PLAT THEREOF FILED IN FILM CODE NO. 533093 OF
THE HARRIS COUNTY MAP RECORDS, W.D.C. HALL SURVEY, ABSTRACT 23,
CITY OF PEARLAND, HARRIS COUNTY, TEXAS (GENERALLY LOCATED EAST
OF SCARSDALE BOULEVARD, AND SOUTH OF BLACKHAWK BOULEVARD)
(APPLICATION NO. 1218) AS CLASSIFICATION SINGLE FAMILY DWELLING
DISTRICT (R-2) AT THE REQUEST OF THE CITY OF PEARLAND, APPLICANT,
PROVIDING FOR AN AMENDMENT OF THE LAND USE DISTRICT MAP;
CONTAINING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, AN EFFECTIVE
DATE AND OTHER PROVISIONS RELATED TO THE SUBJECT.
WHEREAS, on April 25, 2005, the City Council of the City of Pearland, by
Ordinance No. 1213, annexed into the City the territory described in Exhibit "A"
attached hereto; and
WHEREAS, on the 21st day of March, 2005, a Joint Public Hearing was held
before the Planning and Zoning Commission and the City Council of the City of
Pearland, Texas, notice being given by publication in the official newspaper of the City,
the affidavit of publication being attached thereto and made a part hereof for all
purposes, as Exhibit "B", said call and notice being in strict conformity with provisions of
Section 28.3 and 28.4 of Ordinance No. 509; and
WHEREAS, on the 31th day of March, 2005, the Planning and Zoning
Commission of the City submitted its report and recommendation to the City Council
regarding the proposed zoning classification for the property described in Exhibit "A",
whereby the Commission recommended and approved the classification of the property
described in Exhibit "A" as Single Family Dwelling District (R-2); and
WHEREAS, upon receipt of the report from the Planning and Zoning
Commission, the City Council considered this application and the recommendation of

the Planning and Zoning Commission at a regular meeting on April 11, 2005; and
WHEREAS, the City Council having fully heard the testimony and argument of all
interested parties, and having been fully advised in the premises, finds that the property
described in Exhibit "A" in the judgment of the City Council, should be assigned the
zoning classification herein proposed; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
The following described property located within the corporate City limits of the
City of Pearland, Texas, is hereby for all purposes classified as Single Family Dwelling
District (R-2), such property being more particularly described as:
20.5 acres of land out of Villa Verde Section 2 according to the plat thereof
filed in Film Code No. 537152 of the Harris County Map Records and Villa
Verde Section 3 according to the plat thereof filed in Film Code No. 533093 of
the Harris County Map Records, W.D.C. Hall Survey, Abstract 23, City of
Pearland, Harris County, Texas (Generally Located East of Scarsdale
Boulevard, and South of Blackhawk Boulevard)
II.
The City Council of the City of Pearland finds and determines that the recitations
in the preamble hereof are true and that all necessary prerequisites of law have been
accomplished and that no valid protest of the proposed change has been made. The
City Council further finds and determines that there has been compliance with the
mandates of law in the posting and presentation of this matter to the Planning and
Zoning Commission and to the City Council for consideration and decision.

III.
The City Council of the City of Pearland finds and determines that the
amendment adopted herein promotes the health, safety, and general welfare of the
public and is a proper valid exercise of the City's police powers.
IV.
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance
is for any reason held invalid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct, and independent provision and such
holding shall not affect the validity of the remaining portions thereof.
V.
All rights and remedies, which have accrued in the favor of the City under this
Ordinance and its amendments thereto, shall be and are preserved for the benefit of
the City.
VI.
The City Secretary is hereby directed to cause to be prepared an amendment to
the official Land Use District Map of the City, pursuant to the provisions of Section 2 of
Ordinance No. 509 and consistent with the approval herein granted for the
reclassification of the herein above described property.
VII.
This Ordinance shall become effective after its passage and approval on second
and final reading.

Honorable Mayor and City Council Members:
At their regular meeting of March 21, 2005, the Planning and Zoning Commission
considered the request for a zone change from Suburban Development District (SD) to
Single Family Dwelling District (R-2) on the following property:

plat thereof filed in Film Code No. 537152 of the Harris County
Map Records and Villa Verde Section 3 according to the plat

General Location: Generally Located East of Scarsdale Boulevard, and South of

Commission Member locco made a motion to recommend approval of the zone change
request, which was seconded by Commission Member West. No further discussion
occurred. The motion to approve was passed 5 — 0. The zone change was
recommended for approval by the Planning and Zoning Commission.

Planning & Zoning Chairperson Ruby Sandars read the purpose into the record.
Senior Planner Theresa Grahmann presented the Staff Report.
Deputy City Manager Alan Mueller stated that a presentation was made to the Home Owner's
Association in January regarding annexation of Villa Verde. Many questions were answered at"
that meeting, and the attendees of that meeting were advised of this Public Hearing.
There were no persons wishing to speak for or against the proposed request.
Council/Planning Commission, Staff discussion ensued. Councilmember Marcott asked Mr.
Mueller if the Villa Verde property located in the northwest area is in Houston. Mr. Mueller stated
that this property is not part of Villa Verde, but is located in one of the Green Tee subdivisions. It is
in the Houston ETJ and the Clearbrook City MUD.

GENERAL
LOCATION:
Generally Located East of Scarsdale Boulevard, and South of
Blackhawk Boulevard
APPROVAL PROCESS: After this Joint Public Hearing, the requested zone change
application will be considered as follows:
Planning and Zoning Commission: March 21, 2005
City Council for First Reading: April 11, 2005
City Council for Second Reading: April 25, 2005
SUMMARY: The City of Pearland is initiating the proposed zone change to R-2 due to a
City initiated annexation of the subject property, consisting of approximately 20.5 acres of
land, and being parts of Villa Verde Section 2 and Section 3.
The subject land is currently in City of Pearland's ETJ in Harris County. The rest of the
Villa Verde subdivision is within the City of Pearland. The area under consideration was
recently ceded by Houston through an ETJ adjustment agreement so that the entire
subdivision could be under one City's jurisdiction.

Should the City Council approve the annexation next month, the area is proposed to be
zoned R-2. The existing single-family residential subdivision conforms to the requirements
of the R-2 zone.

CONFORMANCE TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE: The
City has evaluated the existing lot sizes and has 'determined that all lots meet the R-2
standards of the Land Use Ordinance.
CONFORMANCE TO THE COMPREHENSIVE PLAN: The Comprehensive Plan does not
cover this area, as it has not been in the City limits. However, the Comprehensive Plan
does indicate that the properties directly to the south be developed as "Medium Density
Residential." Since the subject property is already developed with R-2 size lots, the
proposed zone change does not 'conflict with the Comprehensive Plan.
CONFORMANCE TO THE THOROUGHFARE PLAN: The subject property has several
local/residential streets that were constructed as part of the public improvements for the
subdivision.
Blackhawk Boulevard and Scarsdale Boulevard, both major thoroughfares near the subject
property, provide connections to Yost Boulevard and Dixie Farm Road.
AVAILABILITY OF UTILITIES: Adequate water and sewer service is available to serve the
subject property, provided as part of the subdivision development.

IMPACT ON EXISTING AND FUTURE DEVELOPMENT: The subject property is
surrounded on three sides by either existing or future single family residential lots and
subdivisions. It is anticipated that the property to the north that is located within the City of
Houston ETJ will develop as single family residential in the future.
PUBLIC COMMENTS: Public notice/comment forms were mailed to property owners
within 200 feet of the subject property under consideration. A legal notice of public hearing
was published in the local newspaper, and a Zoning Sign was placed on the subject
property.
STAFF RECOMMENDATION: Staff recommends approval of the zone change for R-2,
for the following reasons:
1. The subject property will be annexed by the City of Pearland and should be zoned
appropriately.
2. The proposed zone change is consistent with existing R-2 zoning districts within the
overall area.
3. The subject property is developed with R-2 size Tots.
